Dorf PROPERTY LOCATION: 620 North Drive (Adjacent to Mattituck Creek), Mattituck,NY SCTM#1000-106-6-27.1 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated February 28, 2023stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated May 23, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 52,806 square foot(1.2 acres)lot located in the Residential R-40 Zoning District. The northerly property line measures 564.09 feet, the easterly property line measures 66.83 feet and is adjacent to Mattituck Bay (Mattituck Creek)the southerly property line measures 237.82 then dips south 40.00 feet and continues westerly 380.00 feet and the westerly property line measures 128.67 feet and is adjacent to North Drive. The parcel is improved with a one-story frame residence. There is an upper wood deck with stairs leading to a lower wood deck with a patio and a hot tub located seaward of the dwelling towards Mattituck Bay, all as shown on the survey map prepared by John Minto, LS and dated December 16, 2021. BASIS OF APPLICATION: Request for Variance from Article IV, Sections 280 -18 and the Building Inspector's February 2, 2023,Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling; at; 1) located less than the code required minimum side yard setback of 15 feet; located at 620 North Drive, (Adjacent to Mattituck Creek Mattituck,NY. SCTM41000-106-6-27.1. RELIEF REOUESTED: The applicant requests a variance to construct additions and alterations to an existing single- family dwelling. The proposed construction is not permitted pursuant to the Bulk Schedule for Residential Districts. The required minimum side yard setback is 15 feet. The construction will have a minimum side setback of 10.2 feet. The applicant wishes to add a small addition to the first floor then add a partial second story over that addition with a Page 2,June 15,2023 97783,Dorf SCTM No. 1000-106-6-27.1 small balcony on the second-floor addition as shown on the Site Plan drawing prepared by Mark Kevin Schwartz, Architect,and dated November 21,2022. ADDITIONAL INFORMATION: The applicant's represented informed the Board that an Innovative Advanced(I/A) Septic System as approved by the Suffolk County Department of Health Services, has already been installed on the property. The applicant provided the Board with two comparable prior decisions located in the applicant's neighborhood; ZBA file #5892 at 500 North Drive, and ZBA file 96116 at 372 North Drive, both granting side yard setback relief for additions to an existing dwelling. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This request for side yard setback relief is not unique in this neighborhood containing many long and narrow lots, resulting in similar approvals for additions and alterations for several nearby properties. The lots in this area, like the subject property, have significant sloping terrain. As a result, the two-story dwelling on the lot that is adjacent to the subject dwelling is sited at a much higher elevation, and the applicant's proposed two-story addition will still be lower in height from the existing grade than the neighbor's dwelling, which is the only property that could be impacted by the proposed addition. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance.The existing footprint of the subject dwelling places the northwest corner of the existing dwelling within the minimum side yard setback and the second-floor addition can't avoid being nonconforming and requiring a variance. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 32% relief from the code. However,the westerly side of the dwelling's first floor bedroom is the only feasible location to create a second-floor addition which will add two more bedrooms. Additionally, the side property line is not parallel to the subject one-story dwelling which has an 8.6-foot side yard setback on the northerly corner; whereas the proposed two story addition will have a more conforming side yard setback of 10.2 feet. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. North Drive is an unpaved dirt road. The proposed addition will not create any erosion from excavating or further ground disturbance. In addition, an Innovative Advanced(I/A) Septic System as approved by the Suffolk County Department of Health Services, has already been installed on the property. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a of a first-floor alterations and a second-story addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LINHTS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The rear yard width will increase from 98.77 feet to 116.42 feet. c) GARAGE: A setback variance of one foot is not substantial,given the size of the proposed lot size of 1.46 acres and the pre-existing location of the garage structure. 4.
