Forbes PROPERTY LOCATION: 1075 and 1455 Narrow River Road, Orient,NY. SCTM No. 1000-27-3-6.2 &27-3-5 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 3,2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING BOARD: The application was referred to the Southold Town Planning Board for comment. The Planning Board issued a Memorandum, dated May 31, 2023, supporting this action, citing the following: • While the smaller parcel after the transfer will remain undersized by the standards of the R-80 Zoning District, the net effect of this transfer is not substantial because the existing condition is one where an encroachment occurs and would be remedied by the transfer. • The transfer area is necessary to meet the minimum separation distance of a potable private well and the sanitary system on-site. • Although the area does not contain access to public sewer and water, there would be no net increase in density on the parcels resulting from this proposed change. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 11,717 square feet, .27 acre rectangular- shaped property, located in the R80 Zoning District known as Lot#2 (SCTM#: 1000-27-3-6.2) for the purpose of this application, measures 148.72 feet along Narrow River Road, then runs north 70.80 feet along a residentially developed lot to the west, then runs east 157.62 feet along a residentially developed lot to the north, known as Lot #1 (SCTM# 1000-27-3-5)for the purpose of this application, and continues back to the roadway, south, 82.60 feet along a residentially developed lot to the east. Lot #2 is developed with a single-family dwelling with attached wood deck, a gravel driveway and gravel walks, a brick patio, a small shed straddling the northern lot line and a well located on the neighbor to the north's property. The subject, conforming, 634,565 square feet, 14.57 acre, irregular-shaped Page 2,June 15,2023 #7782,Forbes SCTM Nos. 1000-27-3-6.2 and 1000-27-3-5 lot, located in the R80 Zoning District known as Lot#1 (1000-27-3-5) measures 651.02 feet along Narrow River Road,then runs north 105.10 feet along a residentially developed lot and continues 258.94 feet west(to the marker where Lot#2 begins)and continues 157.62 feet west along the common boundary between Lot#1 and Lot#2,then runs north 53.63 feet, 241.05and continues 121.24 feet along three residentially developed lots before running east 503.04 feet and 164.96 feet along three lots to the north, then returns south 94.70 feet and continues east 512.83 feet along another lot before running south, 667.57 feet, back to the roadway. Lot#1 is developed with a single- family dwelling with attached decks,entry stairs,a garage building with arbor and paved patio,a pool with attached deck, a gravel driveway and post/wire fencing all as shown on the survey prepared by Kenneth M. Woychuk, Licensed Land Surveyor and dated September 1, 2022. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-14; Article XXIII, Section 280- 124; and the Building Inspector's February 13, 2023 Notice of Disapproval based on an application for a lot line modification (conveyance of land) and to maintain a dwelling subsequent to a lot line modification; at; 1) lot measuring less than the minimum code required lot size of 80,000 sq.ft.;2)lot measuring less than the code required minimum lot width of 175 feet; 3) lot measuring less than the minimum lot depth of 250 feet;4)dwelling is located, less than the code required minimum rear yard setback of 35 feet; located at 1075 Narrow River Road and 1455 Narrow River Road, Orient,NY. SCTM No. 1000-27-3-6.2 & 1000-27-3-5. RELIEF REQUESTED: The applicant requests four(4)variances to achieve a lot line change, in order to remedy an encroachment, where Lot#2,remaining non-conforming after the transfer,will increase in size by 4,240 square feet received from Lot#1,which will remain conforming. The variances required are: • Bulk schedule requires a minimum lot size of 80,000 square feet. Once the land transfer is received Lot#2 will have a non-conforming lot area of 15,957 square feet. • Bulk schedule requires a lot width of 175 feet. Once the land transfer is received Lot#2 will have a non- conforming lot width of 173.16 feet. • Bulk schedule requires a lot depth of 250 feet. Once the land transfer is received Lot#2 will have a non- conforming lot depth of 124.43 feet. • Bulk schedule requires a rear-yard setback(from the primary residence)of 35 feet. Once the land transfer is received Lot#2 will have a non-conforming rear yard setback of 33.5 feet. ADDITIONAL INFORMATION: Improvements on Lot#1 (SCTM: 1000-27-3-5)are covered by the following Certificate of Occupancy: #Z-39566 dated March 24,2018 covering an inground pool with fence to code. #Z-39565 dated March 26,2018 for a single-family dwelling with porch,decks,trellis and outdoor shower #Z-39567 dated March 27,2018 covering an accessory garage/pool house with half bath&outdoor shower, Lot#2 (SCTM: 1000-27-3-6.2) is,the beneficiary of two prior Zoning Board of Appeals determinations, #1161 in 1968 relative to non-conforming lot size and#3825 in 1989 relative to the,construction of a deck. Improvements on this parcel are covered by the following Certificate of Occupancy: #Z-452 dated December 1, 1959covering a private one-family dwelling #Z-18804 dated February 15, 1990covering a deck addition per ZBA appeal#3825 #Z=23100 dated July 14, 1994 covering a two-story addition as applied for Lot#2 has an open building permit,#48886,for the installation of a generator and there is a small shed that straddles the lot line between Lot #1 and Lot #2. Furthermore, potable water is delivered to Lot #2 from a private well, owned and maintained by the applicant, which is located on Lot #1. Impetus to achieve the lot line transfer originated upon the discovery that the well servicing Lot#2 was not located on site; additionally,the applicant Page 3,June 15,2023 #7782,Forbes SCTM Nos. 1000-27-3-6.2 and 1000-27-3-5 proposes to make additional improvements to their property, including the addition of an inground pool, which is not subject to this application. A letter of support from a neighbor was received prior to the public hearing. During the public hearing,a neighbor spoke via Zoom in opposition to the proposed future inground swimming pool identified in this application. No other immediate neighbor or member of the community spoke in favor of or against this application. Town of Southold Planning Board Approval is required. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject "receiving" property (Lot #2) along with two neighboring parcels on Narrow River Road, south of Lot#1, are all non-conforming in lot size. While Lot 41 is more in character of the surrounding area, greater in size than the minimum 80,000 square feet as required, the transfer of area between the two lots will make Lot #2 more conforming, while still remaining non-conforming. Immediate neighbors and those using the public roadway will not be able to discern the lot size nor the addition of 4,240 square feet of area. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Lot #2 as created is substandard in area relative to the Zoning requirements of the R80 Zoning District and has pre-existing, non-conforming setbacks. As a result of its small size, there is no way to make the property `more conforming' other than by transferring land area from Lot #1 to Lot#2; in so doing,an encroachment will be corrected—placing the applicant's potable well and shed on their property. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial for the lot size representing 80% relief from the code, and the lot depth representing 50% relief from the code. The variances granted herein are not mathematically substantial for the lot width representing 1% relief from the code, and the rear yard setback representing 4.7%relief from the code. However, as presently existing Lot#2 is non-conforming on all aspects of the code as currently written. Furthermore, by granting relief and increasing the overall lot size, the subject parcel is actually more conforming to the code and also corrects an existing encroachment(subject parcel potable well located on Lot#1)and existing shed straddling the existing property line. The distance between wells and sanitary systems are non-conforming due to the small size of the parcel and the additional land, transferred, enables the separation between the well and the sanitary system to be more conforming with Suffolk County Board of Health requirements and enhances the areas water quality. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law§267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. However,by Page 4,June 15,2023 47782,Forbes SCTM Nos. 1000-27-3-6.2 and 1000-27-3-5 transferring 4,240 square feet of area from Lot#1 to Lot#2 a significant benefit is achieved and makes the receiving parcel more conforming. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an additional lot area of 4,240 square feet,making Lot#2 after the transfer, a total of 15,957 square feet, .37 acres, and maintaining Lot #1 as a conforming 630,325 square feet, 14.47 acres while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member , and duly carried, to GRANT the variances as applied for,and shown on the survey prepared by Kenneth M. Woychuk, Licensed Land Surveyor and last revised January 25, 2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall receive Town of Southold Planning Board approval for this action. 2. The applicant shall provide the Town of Southold Zoning Board of Appeals a copy of a new deed, as filed with Suffolk County Real Property Department within one (1) year of the final approval of the subdivision by the Southold Town Planning Board. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The premises in question is a parcel of land containing a total lot area of 11,325+_ square feet situated along the north side of Narrow River Road in the Hamlet of Orient, Town of Southold, and more particularly identified on the Suffolk County Tax Maps as District 1000, Section 27, Block 3, Lot 6.2. 3. The subject parcel is improved with an one-story single-family house set back 25.7+- feet from its closest point to the south (front) property line {exclusive of the subject deck and portico extension). 4. Article III, Section 100-31, and Column iii of the Bulk Schedule of the Zoning Code provides for a minimum front yard setback for parcels in the R-80 Zone District to be 60 feet. 5. Article XIV, Section 100-244 of the Zoning Code provides relief to legal nonconforming lots with an area of less than 20,000 square feet for a minimum front yard setback of a principal building at 35 feet. 6. The area of jurisdiction before this Board is that area toward the street within the 35 ft. front yard restriction. The setback at its nearest point (at the southwest corner) requested by this application is at 14-1/2 feet. The portion of the extention in front of the dwelling extends out eight feet (see architect's sketch and site plan) . 7. The amount of relief requested in relation to the requirement is substantial, being a variance of 20-1/2 feet, or 58%, for a 14-1/2 feet setback (in lieu of the required 35 feet) . The reduction in relation to the existing nonconforming setback is also substantial, being a variance of 31%, or eight feet. 8. It is the opinion of this Board that an alternative to the requested variance, which would allow for a lesser percentage of relief, is a four-foot deck extension from the front of the house.
