(631) 765-1809 Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 15, 2023 ZBA FILE# 7776 NAME OF APPLICANT: Gwen Hyman and Andrew Carmell PROPERTY LOCATION: 4565 Nassau Point Road, Cutchogue, NY SCTM# 1000-111-9-8 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated March 1,2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards.The LWRP Coordinator issued a recommendation dated May 22,2023.Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the location of the structures landward of the top of the bluff as INCONSISENT, but that the proposed setbacks are considered an EXEMPT Action from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 35,170 square foot parcel located in ari R-40 Zoning District. The parcel has 100.03 feet of bulkhead frontage along Little Peconic Bay, runs 100.59 feet along Nassau Point Road, runs +/- 359.71 feet on the North side and +/- 344.78 feet on the South side. The parcel is improved with a one-story frame dwelling, a wood walk, a wood wall, and wood platform and steps leading to Little Peconic Bay. There is a bluff located on the property. All is shown on a survey by Gary J. Benz L.L.S. last revised December 16, 2022. BASIS OF APPLICATION: Request for Variances from Article XXII, Section 280-116A(1); Article XXIII, Section 280-124; and Building Inspector's January 31, 2023 Notice of Disapproval based on an application for a permit to construct alterations and additions to an existing single family dwelling at; 1) located less than the code required 100 feet from the top of the bluff, 2) located less than the code required minimum side yard setback of 15 feet; 3) located less than the code required minimum combined side yard setback of 35 feet; located at 4565 Nassau Point Road, (Adj.to Little Peconic Bay)Cutchogue,NY. SCTM No. 1000-111-9-8. Page 2,June 15,2023 #7776, Hyman SCTM No. 1000-111-9-8 RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations to a single family dwelling that include a proposed two story addition for a garage and living space above, a new rear deck and the replacement in kind of an existing deck, that will result in a top of the bluff setback of 32 feet 2 inches where town code requires a minimum 100 feet, a single side yard setback of 10 feet, 7 inches and a combined side yard setback of 25 feet, 7 inches where town code requires a minimum single side yard setback of 15 feet and a minimum combined side yard setback of 35 feet. ADDITIONAL INFORMATION: The survey shows the southern lot line bordering Carpenter Road. Site inspection shows that Carpenter Road is not passable by car. Carpenter Road is a foot path that allows pedestrians to walk with stairs down to the beach. The applicant has the benefit of Southold Town Board of Trustees Permit No. 10274A, dated November 9, 2022 to replace an existing sanitary system with an Innovative Advanced (I/A) wastewater system. The applicant also has the benefit of a Board-of Trustees Permit No. 8838, dated June 22, 2016 to install a deck and steps down to the bulkhead and Board of Trustees Permit dated January 14, 1993 to replace 100 feet of bulkhead. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a single-family neighborhood which consists of waterfront homes. The parcel has an existing deck setback of 32 1/4 feet from the top of the bluff and the applicant is proposing to construct a new deck in the in the same location. The proposed non- conforming side yard setback is to accommodate a proposed garage and outdoor kitchen. The proposed non- conforming setback of 15 feet is along an unopened pedestrian foot path. The proposed non-conforming side yard setback will have no impact side the side property lines are very heavily screened from view by large evergreens and mature landscaping and the decks are not visible from the street. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The non-conforming bluff setback and non- conforming single side yard setback are existing and will not be changed. The subject parcel has un-even topography. Due to the uneven topography the applicant cannot feasibly design a driveway that leads to a garage in a location different than the proposed location. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial is, representing 68% relief from the code for the non-conforming bluff setback; 28% relief from the code for the non- conforming single side yard setback and 27%relief from the code for the non-conforming combined side yard setback. However,the non-conforming bluff setback and non-conforming single side yard setback are existing and will remain the same as the existing setbacks. The proposed non-conforming combined side yard setback is for an attached garage and the topographical limitations and proposed placement of the new sanitary system make this the only feasible location to place an attached garage on the property. 4. Town Law 4267-b(3)(6)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law&267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck, garage, and outdoor kitchen while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variances as applied for,and shown on the Site Plan and Architectural Plans prepared by Jeffrey C. Bak, Architect, labeled R.100; A100, 101; 200-202; 300; 301, last revised January 9, 2023, This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration,grant an extension not to exceed three (3) consecutive one(1)year terms. The addition is attache and located m the PP front to increase setbacks to the top of the bluff/bank. Carpenter Road is 1. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The lot width is 100.59 in the filed map of Nassau Point which is a preexisting nonconforming width. The proposed addition to the house is located in the front yard to maximize the setbacks to the top of the bluff/Bank. The existing house is 10' from the northerly side yard. The topography of the property contains slopes toward the street and towards the Bay. The garage is level with the lower floor of the existing house and in line with the existing topography of the property. The music room is on the primary level of the existing house(1St floor). A new sanitary system has been designed for the existing house and addition. The design of the sanitary system also had to follow the existing topography. The sanitary system is in front of the existing house. 2. The amount of relief requested is not substantial because:Expansion of the house along the existing setbacks of the house are not proposed because of the existing topography of the house. Expansion is proposed landward of the existing structures. The replacement of the existing deck is normal maintenance. The house was constructed in 1976. It appears that the deck was originally constructed as a porch and modified as a deck later. When the applicants purchased the property a Trustees permit was obtained for all the existing structures. The prior owner had constructed all the decks and walkways prior to Trustees jurisdiction. The existing easterly side yard setback is not changed,the addition is 15 from the westerly side yard. Because of the lot width,the total side yards (35')are not practical. A 15' side yard is reasonable for a lot which is only 100' in width. 3. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The proposed design was intended to avoid variances or encroach toward the water. The Bluff wraps around the side yard to the unopen Nassau Point Road(Carpenter Road). This is a pedestrian access. The bulkhead continues through Carpenter Road. The waterfront is protected by both a retaining wall and a bulkhead. The bluff/bank is stable,and the top of the bluffibank has a wood tie wall to prevent erosion. 4.
