No. 449q- Richard and Pamela Frerking 1900-115-12~9 STREET & LOCALITY: 680 l)eep ttole Drive, Matlimck, NY DATE OF PUBLIC tlEARING: Augusl 28, 1997 F1NI)INGS OF FACT PROPERTY FACTS:/DESCRIPTION: This property is located in an R-40 Low DensiW R. esidential Zone District, being situate on the westerly side of Deep Hole Drive, Mattituck. This lot contains a total aves of approximately 9972 sq. ft. and an inspection of lhe premises shows that lhe premises is improved with the following: one-story and two-stocy dwelling with additioas set back at 32 feel from the front prepepty line at its (,Iosesl point. BASIS OF APPEAB: Building lnspeelop's Action of Disapproval dated &dy 1, 1~7, uudep which applicant applied foe a building permit to constmtet an addition to dwelling which will have an insufficient fpo~lt setback as a pphlcipal building at less than the existing, eslablished 32 fl.. noneolffocming setback, under Article XXtV, Section 100-2,1.lB. The Building Inspector has also confirmed that lhe setback is less than a 35 ft. setlmek (vel: setback schedule fop pnvcels having 9972 SCl. ft. in size). AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate 17'4" wide by 13' deep additioa at lbo front of the existing dwelling leaving a reduced setback at 19 fet. t from the front property line. (2) The benefit sought by tile applicant, call be achieved by alternative relief; however, the benefit cannot be achieved by some method, feasible for applicant to pursne, other than ail area variance due to the substandard size of the property, the I/m/ted buildable yard areas for this waterfront lot, and setbacks of the principal building at it presently exists. (3) The requested area variance is not substantial representing a reduction of four feet from the existing 32 ~t. setback to acquire the new 28 ft. setback (alternatively). Note: The applicant's original request for a 19 ft. setback is substantial representing a reduetion of 13 feet ill tile front yard. (4) Tile proposed variance, as alternatively granted, will not have an adverse effect or i~npact on the physical or environmental (,mditions itl the neighborhood or district because other houses ill ~bp area have similar setbacks. (5) The situatioa has not been self-created and is m~iquely related to tile ctmracteristics of tile layout of the land, its sabstandard size at 9972 sq. ft., and location of existing buildings. RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Ostermana, it was RESOLVED, to DENY 1he relief requested for a frmlt yard at 19 feet, and BE IT FURTIIER RESOLVED, to GRANT ALTERNATIVE RELIEF for a setback in tile front yard to 28 feel at its ctoses~ points. GOEPrRINGER, ,g~IAIRMAN ..~ Resolutioa Dated 9/11/97 Acfions.all/115-12-9 PROJECT DESCRIPTION Objectives: 1. To gain usable sheltered space that can be used to store garden tools, furniture, and machinery. Also a place to use for hobby activities such as woodworking. 2. To improve the aesthetics of the front of the existing structure. Note: The functions described above would normally be served by~ structure such as a garage. However, we felt that c~tmcting a garage in the front of t~effi~ting structure would impose too severely on the setback"r.~uirements and are there,.fi:~e~submitting a compromise plan that will maximize the use of.the ex.~.' g verandal~., bye_ cl_osing it, while extending the structure only 13 feet forward (to the existin~'stxone w~m the fr6nt garden) in order to make it more usable. This will result in a setback of')~om the propertyline (approximately 29' from the road). This is approximately the sa~setbac~the garage located on the third property north of the proposed addition site. T~altemative of~structing a building or garage at the rear of the house would be impra~easons. The'~ting septic system placement would preclude putting it imme~tely behind the house. Sett'mg~har back would seriously impair the water views of theMeighbor~r 'es. And such place~nt would necessitate approvals from the environmental groups. ~ The materials used for the proposed addition will match those used on the existing structure Eg.. Cedar Shingles with a 7" exposure, Anderson double hung windows, and architectural roof shingles to match the shingles of the existing structure, and will significantly enhance the street side appearance of the property. All construction will conform to existing ordinances. The owner intends to do some of the work, and will use licensed subcontractors when necessary. Please note that though the construction site is less than 300' from wetlands, it is 24 feet further landward than the previous addition to the house (implemented in 1993) for which a letter of non-jurisdiction from the DEC, Trustee approval and CO are already on file with the Southold Building Department.
