No. 4607. Based on another inspection on April 2, 1999, the entire patio with the retaining wall (height above ground) is the same construction addressed throughout the appeal process and was existing at the time it was approved by the Board on September 30, 1998. The August 19, I997 survey shows a lot size of 19,476 sq. ft. (including land underwater) and the following buildings: 2-1/2 story frame single- family dwelling and accessory storage shed. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is for approval of the "as built" raised, unroofed patio (addition) at 14.5~-- feet from the southerly front property line, along Old Harbor Road, as more particularly shown on the August 19, 1997 survey prepared by Stanley .1. Isaksen, Jr. REASONS FOR BOARD ACTIONr DESCRIBED BELOW: (1) The granting of the area vadance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the "as built" patio Is~not more than seven (7) inc~hhes above grade at any point. ~' (2) ..The benefit sou/ght by the applicant canno, t be achieved by some method, feasible for apphcant to pursue, other than an area variance. Your office has the approval. November 4, 1998. There is a misunderstanding. Your first turn down was for building a structure (brick patio) too close to the town road because it was about 7½" above the earth and grass grade (see photos). Of course the patio could have been at grade level but it was raised to keep muddy water and ice off the surface. No one knew the code restriction applying to waterfront locations. In your first turn down there was no mention of the East side retaining wall or railing because they were already approved in the Home C of O. Before the house was purchased, the engineer and architects noted water in the ground floor and therefore the owners put in the retaining walls and dry wells and a concrete lip on the foundation to prevent the soil and water from getting into the home. (See photo) The code railing is set in concrete for safety and the bricks were cut around the treated posts to fit. I also question why your inspector in the attached inspection did not mention the railing or the obvious objective of controlling surface water and erosion down a former steep hill?. The 2 to 4 foot height requires a railing. Please review this and give the patient owners a C of O for their patio. The Zoning Board asked if any additional structures were planned on the terrace. No. I respectfully suggest you might see the finished home with a new evergreen hedge hiding the patio and home from the road. I would be pleased to show it to you. (734 4182) These new owners have improved the environment with sea side plants and grass, landscaping, provided jobs for local professionals, renovated an older house grandfat~ered before your code which is now up to current code, amd it cost them $1,250 for special surveys, blue prints, engineering inspections and then the appeal ordered by your department for things the builder and architects had anticipated and planned. We, their neighbors, should give them a medal for improving our community.
