The above building permit has expired and no construction was done. This permit has been voided.

Dear Mr. Fish:
I am writing to you to ask if you can think cfa way to help me in this Catch-22 situation 1
find myself in.
Although I thought: 1 would be OK with thc bank in my re-finance cttbrts; it tums out that
I am not.
Let me explain the problem, The title company found an Opan/Expired permit on their
first Occupancy Search on 5/9/01. (copy attached) This was unacceptable to the bank,
Based on your inspection and our conversation that lhe work on permit ~24607Z wa.q
never done, this permit record subsequent to 5/9/01 was closed and no longer a problem.
However, the when the title company went back on July I I th to confirm that #24607Z
was closed, they found NEW notations (see attached), briefly "the inspection thnher
revealed that a de~;k h~ been constructed which requires a Building Permit and
subsequant Certtificate. To date, the building department has no record cfa Building
Permit Application on file".
I have the permit application completed and ready to file. I have delayed submitting it
because I know I cannot refinance with an OPEN building permit application. So, I
wanted to refinance first, then submit it.
The problem then, ia a nutshell: I cannot refinance with an OPEN new building permit,
Nor can I refinance With tiffs record cfa "deck" which requires a permit. The bank
considers the re4uirement a potential violation. If I submit the permit application, which
is ready to go, the bank will not close with an open perufit application.
This leaves mc with the choice of ripping up the shower walkway or losing the refinance
commitment,

Do you have any suggestions that would help? I nccd a clean Inspection. I am happy to
try and fill any obligations I need to do with you to get it. At lazt resort I will have the
walkway ripped up on Wednesday, c, omplele the refinace el'thy property, submit the new
permit application, ind re-install it..., but, it seems like a lot of effort if there is a more
sensible way to deal with this situation.
Any suggestions )'au have would be greatly appreciated. To complicate matters I am
now working against tho clock as the refinance commitment expires early August.
