Tasker. 3:40 P.M. - The Board reviewed, briefly, the Regular Meeting agenda. Supervisor Murphy announced that future work sessions would be held for scheduled appoint- ments and audit purposes only. The agenda will be openly discussed for the first time at the public meetings, unless a Councilman asked that a specific resolution be discussed at the work session. The Board again discussed the proposed 1984 salary of Confidential Secretary to the Supervisor Christina J. Hogan, and could not reach an agreement. REGULAR MEETING 7:30 P.M. A Regular Meeting of the Southold Town Board was held at 7:30 P.M., Tuesday, January 3, 1984 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Murphy opened the meeting with the Pledge of Allegiance to the Flag. Present: Supervisor Francis J. Murphy Councilman Joseph L. Townsend, Jr. Justice Raymond W. Tasker SUPERVISOR MURPHY: I'd like to welcome everybody here to the first meeting of this new Town Board. We look forward to your participation over the next two years in helping us make decisions and see what help you could be for us. I would like to set the next meeting date at January 17, 1984 at 3:00 P.M. Moved by Justice Edwards, seconded by Councilman Stoutenburgh, it was RESOLVED that the next Regular Meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, January 17, 1984 at the Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes: Councilman Schondebare, Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY:. Moving on to the first item on the agenda, the Reports. This is a short agenda tonight, being that we took care of most everything right before the end of the year. I. REPORTS. COUNCILMAN MURPHY: The only report we have on file with the Town Clerk is the November Cablevision report. These reports--normally there's eight or ten of them given each month by the various departments in the Town and they are on file with the Town Clerk for anyone who wants to see them. JANUARY 3, 1984 - Regular Meeting 2. Councilmen's reports. Councilman Townsend? (Nothing right now.) Councilman Schondebare? (Nothing.) Justice Edwards? (Nothing, thank you.) Councilman Stoutenburgh? (Too early in the game.) We just had a Work Session this morning and our Organizational Meeting. We will be setting up committees. We set up two that had to be set up right away, and we've got quite a bit of work ahead of us. II. PUBLIC NOTICES. JUSTICE EDWARDS: 1. U. S. Army Corps of Engineers. Applicant is New York Power Authority. Activity is a power line crossing of navigable waterways and a docking pier. All comments regarding the permit and application must be prepared in writing and mailed to reach this office before the expiration date of this notice, which is 31 January 1984. What this is is they are bringing a power line down and it doesn't really affect us here in Southold. I believe it's crossing the Hudson River about half way up. Ail comments to the U.S. Army Corps of Engineers by 31 January 1984. 2. Complete application to the N.Y.S.-D.E.C. by applicant Joan Harris, East Meadow, New York. Tital Wetlands, Protection of Waters, Water Quality. It's to construct a 50 ft. timber bulkhead at high water. The project is located approximately 100 feet south of the intersection of Manhasset Avenue and Champlin Place in the Village of Greenport. Contact person is Daniel J. Larkin, and all comments no later than January 20, 1984. SUPERVISOR MURPHY: Thank you, Ray. I'd like to comment on that first public notice. Environmentally it has very little to do with us in one way, but this is the start of the Marcy-South transmission line that the New York Power Authority would like to have go through so presently there is no way to bring the cheap hydroelectric power to the lower part of the state, mainly Long Island, New York City, south of Albany, and this will start the ball rolling to allow us to buy the cheap hydroelectric power from Canada, enter into a contract with them, and eventually, hopefully, lower or maintain our rates with LILCO, and this is what we're trying to do. We will have a little publicity out on this. The Assembly--on Long Island--the members are petitioning and getting together petitions for various people to talk to the Public Service Commission to make sure that they approve this line, and there will be more coming in over the next two months. III. COMMUNICATIONS. SUPERVISOR MURPHY: 1. Letter from Scott Sutcliffe, Director of The Nature Conservancy, concernin9 the acquisition of the Madowitz property. Would you want to comment on that, Paul? COUNCILMAN STOUTENBURGH: Nature Conservancy is a national organization that's goal is to preserve open space. We own--and I say we, happening to be a member of that organization--own about five properties now in Southold Town. We've just acquired two of them out in Orient. The purpose of the ones in Orient is to preserve the great marshes of Orient. If you know anything about Orient, the Long Beach State Park--think of across on the mainland, all those beautiful marshes along there--the hope would be that people would contribute these pieces of land to a block that would be kept forever in its natural state, and slowly but surely we're working on that, and this happens to be a parcel which we've just gotten and it goes right along side of another one which we have. So we have two right down there on that particular area and they'll be kept forever open space. SUPERVISOR MURPHY: Thank you, Paul. Number 2 is from the Greenport- Southold Chamber of Commerce concerning the dog problem in Greenport. We are working towards, we hope, a solution by the addition to additional pens in the Dog Pound in Peconic. 3. From the Greenport-Southold Chamber of Commerce also, concerning a trailer truck that was selling furniture from a restaurant's parkin~ lot. This has been stopped and we have the assurance of the owner of the property that this violation will not happen again. 4. From the General Services Administration notifying the Town that the government's acceptance of our offer to purchase the waterfront and housin9 tracts on Fishers Island. This is $695,000.00, all of which has been donated to the Fishers Island Ferry District, which turns it over to the Town for us to buy. It's not costing the taxpayers on the mainland anything and it is allowing the Ferry District to pick up a very valuable piece of property. We should be very proud of those people over there. JUSTICE EDWARDS: Thank you. 5. Information on Social Security. These letters are file also in the Town Clerk's Office for anyone who would like to read them. JANUARY 3, 1984 - Regular Meeting 43 J SUPERVISOR MURPHY: IV. is Public Hearings which we will hold at 8:00 o'clock. We'll move on to the few resolutions we have tonight before we recess for a public hearing. V. RESOLUTIONS. 1. Moved by Justice Edwards, seconded by Councilman Stoutenburgh, it was RESOLVED that the Town Board of the Town of Southold hereby appoints John Talbot a member of the Southold Town Board of Housing Appeals, effective January 10, 1984 through January 9, 1987. Vote of the Town Board: Ayes: Councilman Schondebare, Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. 2. Moved by Councilman Townsend, seconded by Councilman Schondebare, it was RESOLVED that the application of Oscar Goldin for renewal of his single family house trailer permit, which expires on January 22, 1984, for trailer located on Lot No. 69, Greenport Driving Park, south side Linnet Street, Greenport, New York, be and hereby is granted for a period of six (6) months. Vot--~['~-'~ the Town Board: Ayes: Councilman Schondebare, Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Councilman Stoutenburgh asked me to explain these trailer permits. They are good for--these renewals are good for six months. There has been very very few trailer permits--I think two in the last three years that I can remember of new permits. These are renewals that had been-- most of them had been in existence I guess since before zoning. COUNCILMAN TOWNSEND: But, Frank, the reason we have to bring it up every six months or so is because they were outlawed by our zoning and not grandfathered in by a lot of other pre-existing uses, so consequently the Town Board has to vote on them every six months because the trailers are not included as a pre-existing use, whereas a grocery store in a residential district, or a factory in a commercial district wouldn't normally be allowed, is grandfathered in and doesn't need any special permission. 3. Moved by Councilman Schondebare, seconded by Councilman Townsend, it was RESOLVED that Supervisor Francis J. Murphy be and he hereby is authorized and directed to execute the agreement between the Town of Southold and the Southold Town Police Benevolent Association, Inc. for the terms and conditions of employment for the period of two (2) years, effective January 1, 1983, and terminating on December 31, 1984. Vote of the Town Board: Ayes: Councilman Schondebare, Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. 4. Moved by Councilman Townsend, seconded by Councilman Schondebare, it was RESOLVED that the application' of Bauer Farms, Inc. for renewal of a single family house trailer permit, for trailer located off south side of North Road ~CR48), Peconic, New Yrok, which permit expires on January 4, 1984, be and hereby is 9ranted for a six (6) month period. Vote of the Town Board: Ayes: Councilman Schondebare, Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. 5. Moved by Justice Edwards, seconded by Councilman Stoutenburgh, WHEREAS, the Fishers Island Ferry District will be operating its ferry vessels and terminals with District employees, effective January 15, 1984, and WHEREAS, the Board of Commissioners desires to organize its operation utilizing the following ten (10) full-time positions as the core: Position Salary or Pay Rate 1. Captain (Operator) (2) ................ $ 8.00 per hour WHEREAS, effective January 15, 1984 the Fishers Island Ferry District wishes to organize its operation by the establishment of positions as enumerated above other than those of Manager-Secretary, Senior Purser, Bookkeeper, and Reservation Clerk which have been previously established, and WHEREAS, effective January 15, 1984 those persons hired into newly created positions and those incuments in existing positions not affected by other contractual considerations (see * above) shall be compensated in accordance with the salary scale or pay rate established for each positions, now, there- fore, be it RESOLVED that the Town Board of the Town of Southold hereby approves the organization and remuneration as presented above, and grant the Board of Commissioners of the Fishers Island Ferry District the authority to proceed with the hiring of personnel in vacant positions. Vote of the Town Board: Ayes: Councilman Schondebare, Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. JUSTICE EDWARDS: What this is is the Fishers Island Ferry District has been runing its operation since it began, probably thirty years ago, on a contract basis. It is now going "civil service", whereas the Ferry District itself will hire the men. They're more or less going to take over the men that have been working as a contract. It will make it a lot easier for the District to run its operation. SUPERVISOR MIJRPHY: Okay, at this time we've finished the resolutions that we had planned for today. We still have--- COUNCILMAN TOWNSEND: Frank, I do want to offer one more resolution on the letter to the Governor. Remember I spoke about that this morning? SUPERVISOR MURPHY: Oh, okay, yes, I'm sorry, Joe. Moved by Councilman Townsend, seconded by Councilman Schondebare, it was RESOLVED that the Town Board of the Town of Southold hereby sends a request to Governor Mario Cuomo to schedule a special election for the vacant Councilman positionr said special election to be held at the time of the Presidential Primary on April 3, 1984. COUNCILMAN TOWNSEND: I believe April 3rd is Primary Day and would eliminate the extra expense of polls and so forth. Vote of the Town Board: COUNCILMAN SCHONDEBARE: Yes. COUNCILMAN STOUTENBURGH: I would prefer it at a different date, no. JUSTICE EDWARDS: Yes. COUNCILMAN TOWNSEND: Yes. SUPERVISOR MURPHY: I would vote, Joe, if you're sure of this date. I don't think--- TOWN CLERK TERRY: There ~s a Presidential Primary on April 3rd. SUPERVISOR MURPHY: Why don't we leave the resolution to say the date of the Presidential Primary? COUNCILMAN STOUTENBURGH: I'll buy that. Yes. COUNCILMAN SCHONDEBARE: As amended, I'd second that. TOWN CLERK TERRY: Councilman Stoutenburgh, do you care to amend your vote ? COUNCILMAN STOUTENBURGH: Yes. TOWN CLERK TERRY: Supervisor Murphy, how are you voting on the amendment? SUPERVISOR MIJRPHY: Yes. TOWN CLERK TERRY: This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Is there anyone who would like to address the Board before we recess for a few minutes? Sir? MR. TOM FLURRY, New Suffolk: I think I understood Joe Townsend to say Governor Carey. JANUARY 3, 1984 - Regular Meeting COUNCILMAN TOWNSEND: Did I say Carey? Sorry, I'm living in the past. SUPERVISOR MURPHY: We'll have the right governor.---Okay, would anyone like to address the Board? I realize most everybody is here tonight because of the two public hearings, and would like to address the Board on anything but the two public hearings at the present time? (No response.) If not, I would move that we recess this Town Board meeting. We did have a snag in some negotiations on some salaries that the Town Board would like to continue the negotiations, now maybe we can have this resolved, or after the public hearings we can have two more resolutions. Moved by Supervisor Murphy, seconded by Councilman Schondebare, it was RESOLVED that a recess be called at 7:55 P.M., meeting to reconvene following the two public hearings (Hodor-Stalle~' Relief Petition, and Marine Associates Change of Zone Petition.) Vote of the Town Board: Ayes: Councilman Schondebare, Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. WORK SESSION 7:56 P.M. - Supervisor Murphy addressed the Board and the public on the comparisons of salaries of civil service clerks in the Town Hall and the salary of Confidential Secretary to the Supervisor Christina J. Hogan. He outlined the CSEA Contract for 1983-84 giving an 8% and a 7% salary increase. 7% effective 1/1/84, as well as the one hour increase in the workday, which meant a 16-2/3% increase in salaries to compensate for a 7 hour workday. Supervisor Murphy said that he has always felt the starting salary for the Confidential Secretary to the Supervisor was too Iow and feels she should be compensated a little better, and would like to see the salary at $1fi,000.00.--Councilman Townsend stated that for someone with four years of experience, no clerical employee is making more than what he suggested as a compromise with the additional hour. He objects to a $5,000.00 raise in a period of two weeks, which included the 18% raise retroactive to January 1, 1983. When he compromised on that raise he did not have in mind another $4,000.00 raise at this time, however, he modified his position to $13,000.00 when the extra hour was discussed. He feels it is unfair to other people who have been working in Town Hall for a longer period of time to give the Confidential Secretary a substantial raise higher in a much shorter period of time. He is agreeable to $13,600.00, which represents a substantial increase, and hardly a reason to hold the whole Town hierarchy captive or hostage, and is not a reasonable position.--Supervisor Murphy stated that, rather than delay the public hearing, the discussion will be continued after the hearings. (Public Hearings - 8:00 P.M. - Hodor-Staller Relief Petition, and 8:10 P.M. - Marine Associates Change of Zone Petition.) (Following the close of the Marine Associates hearing, at which time the Petition was withdrawn,Supervisor Murphy asked if there was anyone in the audience, before reconvening the Regular Meeting, would like to address the Board.-- The following individuals addressed the Board in opposition to the Marine Associates Petition: Joseph Fenton, Danny Lyon, Tom McGowan, Floyd D. Houston, Jean Tiedke, F. R. Schrieber, Cai Grathwohl, John Sitera, Mary Ferguson, Laura Avent. In favor: Nancy Wickham.) WORK SESSION 8:35 P.M. - The Board again discussed the 1984 salary of Confidential Secretary to the Supervisor Christina J. Hogan, and reached an agreement of $14, 000. 00.--They then discussed the 1984 salary of Community Develop- ment Administrator James C. McMahon and reached an agreement of $25,500.00. REGULAR MEETING - reconvened at 8:55 P.M. SUPERVISOR MURPHY: This was a very long day. Before we go into these last two resolutions, for those who missed this morning, I came in about 7:30 and the first thing that was put on my desk was a check for one million dollars to Frank Murphy, Supervisor, so it was really worth campaigning. I didn't even mind coming in early. If he does that every day it will be fine. Okay, we move on to Resolution No. 7, which is revised Resolution No. 12. Who would like to make it? 7. Moved by Justice Edwards, seconded by Councilman Schondebare, it was RESOLVED that the Town Board of the Town of Southold hereby sets the following per annum salaries, effective January 1, 1984 through December 31, 1984, and the same shall be paid in reqular semi-monthly payments: JANUARY 3, 1984 - Regular Meeting Deputy Superintendent of Highways Raymond Jacobs ....... ~$27,027.00 Confidential Secretary to the Supervisor Christina J. Moved by Supervisor Murphy, seconded by Councilman Stoutenburgh, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine whent he same shall be payable and that the salaries of the members of the Town Board, the elected Town Clerk and an elected Superintendent of Highways shall not be fixed in an amount in excess of the amounts respectively specified in the notice of hearing in the preliminary budget published pursuant to Section 108 of the Town Law, now, therefore, be it RESOLVED that the annual salaries for the followin9 elected town officials shall be as follows, to wit: Supervisor Francis J. SUPERVISOR MURPHY: Does anyone--any member of the Town Board like to comment? Anything further? COUNCILMAN SCHONDEBARE: Are all Board meetings like this? SUPERVISOR MURPHY: No, Jay, this was one of the better ones though. Anyone in the audience like to make a comment? (No response.) If not, I would like to have a motion to adjourn.
