Higgins Dear Mr. Forrester: After our conference on June 4, 1998 with Gary Fish I reviewed the records at the Southold Town Zoning Board and discovered that the Zoning Board has ruled on the language of Southold Town Code Article XXIV 100-242 (A) and (B). The Zoning Board ruled that if the owner has complied with 100-242(A)then 242 (B) does not apply. Specifically in Matter of McCarthy, Appeal No. 4350 dated November 8, 1995 and most recently in Matter of Dorothy Thoet, Appeal No. 4557 dated April 30, 1998, the Zoning Board ruled that 100-242 permits the reconstruction and alteration of the existing structure within the existing footprint. The building Inspector has issued a Stop Work Order based on an alleged violation of Article XXIV 100-242 B (1). The owner is reconstructing an existing accessory structure all in conformance with 100-242 (A), in the same footprint with a nonconforming setback and conforming use. Accordingly, the Zoning Board rulings referenced above are controlling. The building department is legally bound to follow the interpretation of the Zoning Board. The Stop Work Order must be removed, and the reconstruction proceed pursuant to a validly issued building permit. In accordance with established procedures in the building department, the plans will be revised to reflect any and all changes or modifications to the original sealed plans made by the contractor during the course of construction, prior to issuance of the certificate of occupancy. WHEREAS, on July 12, 1995, a building permit was issued under No. 22881Z by the Building Inspector for an addition and alterations to an existing one-family dwelling to include an enclosed porch as applied for, and which was thereafter amended to show handwritten changes for new construction (additional fee of $75.00 charged by the Building Department and receipted July 28, 1995); and . WHEREAS, the building plans submitted under the original building permit are substantially the same as that which was stopped under the Stop Work Order issued October 18, 1995; and WHEREAS, the basis of the Stop Work Order is stated as " . .failing to comply with Article XXIV, Chapter 100-242A and B(1) of the Zoning Code of the Town of Southold. . . ," and WHEREAS, an application for a formal Interpretation of Section 100-242A has been requested by the applicant, based upon the reasons for issuance of the subject Stop Work Order dated Octo- ber 18, 1995, and after due notice a public hearing was held on November 8, 1995; and WHEREAS, at said public hearing, all testimony was submitted - in support, in rebuttal, and in general regarding this project, and a duplicate of the Building Permit file and records, together with all prior actions rendered by the Board of Appeals pertaining to this property and transcripts have been made a permanent part of this record; WHEREAS, Article XXIV, Section 100-242, Subsection A which is appropriate and applicable for this conforming residential use with a nonconforming sideyard setback, is noted in the following excerpt at page 10143 of the Zoning Code: "Page 2 - Appl. J4350 Interpretation - 100-242A ZBA Resolution Adopted 11/8/95 1 100-242. Nonconforming buildings with conforming uses. A. Nothing in this Article shall be deemed to prevent the remodeling, reconstruction or enlargement of a nonconforming building containing a conforming use, provided that such action does not create any new nonconformance or increase the degree of nonconformance with regard to the regulations pertaining to such buildings; and NOW, THEREFORE, on motion by Member Tortora, seconded by Member Villa, it was RESOLVED, that it is hereby DETERMINED in interpreting Section 100-242A that the term 'reconstruction' may include the term "rearrangement" in the structural parts of the building, and/or the term "alteration," defined at Section 100-13 of the Code as follows: ALTERATION: As applied to a building or structure, a change or rearrangement, or an enlargement, whether extending on a side or by increasing in height, or the moving from one location or position to another"; and a building permit for building alterations and addition or enlargement which does not extend into a new nonconforming yard or which does not increase the degree of nonconformance with regarding to the regulations pertaining to such buildings; and BE IT FURTHER RESOLVED, that the reason given by the Building Inspector dated October 18, 1995 to Stop Work under Building Permit No. 22881Z ". . .for failing to comply with Section 100-242A of the Zoning Code. . ." is found to be deficient in form and content, and based upon this Board's authority for a formal interpretation, the Stop Work Work shall be removed (or lifted) . No. 4557 - Dorothy Thoet Parcel ID: 1000-145-2-3 Street and Locality: 380 Great Peconic Bay Boulevard, Laurel Date of Public Hearing: April 16, 1998 The Applicant, Dorothy Thoet, has requested an Interpretation of Section 100-242 of the Code of the Town of Southold, sub-section (A) , to authorize the reconstruction of an existing accessory building in the same footprint with a nonconforming setback and conforming use. WHEREAS, after due notice, a public hearing was held by the Board of Appeals on April 16, 1998 to consider this application; and WHEREAS, at said public hearing, all those that desired to be heard were heard and their testimony recorded, and WHEREAS, Board Members have considered all testimony and information submitted concerning this application, and WHEREAS, the following section of the Code is pertinent to the applicant's request: Section 100-242A of the Zoning Code reads as follows: . . .A. The subject accessory building is proposed to be maintained as a reconstructed building in the identical footprint of the existing accessory "bath-house" building. The subject footprint is shown on the June 22, 1984 survey prepared by Young & Young, L.S. at the most southwesterly corner of the premises with a nonconforming setback at approximately 10.5 feet from the southerly bulkhead and at approximately three feet from the westerly bulkhead and/or property line; 3. The dimensions of this building are provided on the June 22, 1984 survey to be of a size 7.5+- ft. x 19.5+- ft. , and when reconstructed the footprint will be identical. 4. The accessory building as presently used is incidental to the main dwelling, and after reconstruction, the same accessory use will continue. 5. The accessory building was constructed in about 1939. 6. The building is unheated, seasonally used as an accessory building, and will contain electric and water when reconstructed.
