In the matter of the Petition of: DECISION Liso Construction Corporation For a Variance to New York State Uniform Fire Prevention and Building Code PETITION NO. 1999-0327 -------------------------------------------------------- Upon the application of Liso Construction Corporation, filed pursuant to 19 NYCRR 450 on March 17, 1999, and upon all other papers in this matter, the Department makes the following determination: NATURE OF THE GRIEVANCE AND RELIEF SOUGHT The petition pertains to an existing building of Al(one-family dwelling) occupancy, two stories in height, of type 5 construction, approximately 2800 square feet gross area, located at 4080 Peconic Bay Blvd., Laurel, Town of Southold, County of Suffolk, State of New York. The petitioner is requested from: 9 NYCRR 713.1(c)(2), which requires there shall be no variation exceeding one-eighth inch in the height of risers in any one run of stairs. [The petitioner requests to maintain a recently renovated stairway which provide access between the first and the second floor with the bottom stair riser height of 7'/�inches in a run of stair with a riser height of 8 inches.] FINDING OF FACTS 1. The subject building is an existing two story single family dwelling of type 5 construction. The building has an internal stairway, which provide travel between the first floor and the second floor. The stairway does not comply with all the provisions of 9 NYCRR 713.1. 2. The stairway in question is a two tier stair with 11 risers in the top section and 4 risers in the bottom section of the stairway. The bottom stair riser, the one adjacent to the first floor, has only a height 7Y: inches, while all other riser heights are 8 inches in height. 3. The petitioner installed a carpet on the stairway, except the bottom floor, which provided a uniform height of 8 inches in all the stair risers. Even though, with the installation of the carpet, the stairway seems to be in compliance with the code, it is not acceptable, since the carpet is not a permanent fixture. 0 printed on recycled paper • f j Petition No. 1999-0327 Page 2 4. The headroom of the stair, which is measured vertically from the surface of the tread, is in compliance with the Code 9 NYCRR 713.1(e), even though the vertical distance above a plane parallel to and tangent with the most forward projection of the stair(NFPA 101-5-1-5) is only 6 feet 3 inches. The existing headroom does not seems to interfere with the use of the stair. Furthermore, the occupants did not raise any complaints about the headroom. CONCLUSION OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 713.1, to permit the use of the non-conforming internal stair to travel between floors, each of which contains habitable spaces, be and is hereby PROPOSED TO BE GRANTED, This PROPOSED DECISION is issued under 19 NYCRR 450.6. Unless objected to by the oetitioner in a writing timely received by the department the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application. / y Georgeg.
