The following action was taken at the Southold Town Board of
Trustees meeting on March 25, 1998:
RESOLVED, that the Southold Town Board of Trustees approve the
request for an Amendment to Permit #4798 to relocate the
proposed second story towards the center of house, remove
existing chimney and build a set of 6' X 10' steps towards the
east elevation of house. Located: 192 Willow Terrace, Orient.
However, this does not constitute approval from any other
agencies.

Dear Mr. Fish,
Enclosed herewith please find an appraisal prepared by Vincent Cannuscio, NYS certified
resident real estate appraiser (Lie.# 45000015843), a contracting estimate prepared by Robert
Bohn, Robert Bohn Contracting, Inc. (Lic.# 7541-HI) dated June 6, 1998, and a resolution by
the Southold Board of Town Trustees dated March 26, 1998 concerning the premises
referenced above.
As you know, an application for a building permit was submitted to your office some time ago.
You had remarked that the property lies within a flood plain and that any addition considered
substantial would require elevation of the lowest structural member to the required B.F.E. We
had previously submitted to you a National Flood Insurance Program flood renewal invoice
which established the value of the building at only $153,100.
At this point in time, we now have the building established at a value of $156,450 pursuant to
the enclosed appraisal and a building estimate in the amount of $74,257. Because the
construction estimate falls below 50% of the value of the building pursuant to both the
appraisal and the FEMA renewal notice, the proposed improvement to the subject dwelling
cannot be considered a substantial addition. Accordingly, you are authorized to issue the
requested building permit.
There remains two outstanding issues conceniing the subject parcel. Those issues include the
existence of a low profile landscape wall with~ a right of way on the subject parcel, and the
existence of a shed in a non-conforming location with respect to the Town Zoning law. We had
agreed to remedy the condition by filing an application with the Southold Town Zoning Board
of Appeals. However, in order to perfect any application with the Southold Zoning Board of
Appeals, I require a Notice of Disapproval fxom your office.
I suggest that our application for a building permit concerning the second floor addition is
complete and that you can issue a building permit for that activity at this time. I agree to submit
the required application to the Southold Zoning Board upon receipt of your Notice of
Disapproval. I request that the building permit be issued at this time while our application to
the Zoning Board is pending because the construction of the second floor addition has nothing
to do with the wall or the shed.
Please advise this office with either your concurrence or objection to the handling of these
issues as set forth in this correspondence.

QUANTITY SURVEY METHOD
(to estimate and verify replacement cost)
In order to test the accuracy of the square foot method, I
have asked Mr. Brian Hornung of Judan Homes to prepare a "PRESENT
COST ANALYSIS," using the QUANTITY SURVEY METHOD which is defined
by Ventolo and Williams in "The Fundamentals of Real Estate
Appraisal as:
"The itemized costs of erecting or installing all of the
component parts, of a new building are added. Indirect costs
(building permit, land survey, overhead expenses such as insurance
and payroll taxes, and builders profit) are totaled, as well as
direct costs (site preparation and all phases of building
construction including fixtures."
I have reviewed Mr. Hornungs estimate and made changes,
deletions or additions where appropriate. For example, Mr. Hornung
omitted from his estimate the cost of constructing new a FIREPLACE
which exists in the present structure. I have DELETED from Mr.
Hornung's estimate the cost of installing air conditioning which
does NOT exist in the present structure.

SALES COMPARISON ANALYSIS
The Sales Comparison Method is not appropriate for this
appraisal assignment as the question to be answered is, "what is
the cost to replace the existing improvements, viz., structure?"
Note however, that I did search and locate records of recent
sales for vacant land and improved properties in close proximity to
subject. They are contained in my office file for this property
and are available for inspection at my office by other agreed to
arrangement.
INCOME APPROACH
The Income Approach to Value is not appropriate for this
appraisal assign/nent for the reason explained above.
RECONCILIATION
I have estimated the "cost to replace the improvements"
existing on the subject property by two appraisal methods outlined
in the Fundamentals of Real Estate Appraisal by Ventolo and
williams and widely accepted by the appraisal profession.
The Square Foot Method indicates a Cost to Replace the
existing improvements of $144,520.
The Quantity Survey Method indicates a cost to Replace the
existing improvements of $156,450.
The two methods establish a reasonable range of replacement
cost for the subject property.
It is my conclusion that the estimated cost to replace the
subject improvements, exclusive of bulkheading is $156,450., the
value indicated by the more exacting Quantity Survey Method.

during its Regular MeetSng held on September 24, 1997, regarding
the above matter:
WHEREAS, BARBARA DERINA, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated August
1997, and,

Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on September 24, 1997, at which time
all interested persons were given an opportunity to be heard,

WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WUEREAS~ the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

12 All necessary precautions shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate ot any

other environmentally deleterious materials associated with the
project.
13 Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse pmles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway,
14 There shall be no unreasonable interference with navigation by th~ work
herein authorized.
15 If upon the expiration or revocation of th~s permit, the project hereby
authorized has not been completed, the applicant shall, without expense
to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may reqmre, remove all or
any portion of the uncompleted structure or fill and restore the site
to Its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration.
16 If granted under 6 NYCRR Part 608, the NYS Department of Environ-
mental Conservation hereby certifies that the sublect prolect will not
contravene effluent hmitations or other limitations or standards under
Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977
(PL 95-217) provided that all of the conditions listed hereto are met.

SPECIAL CONDITIONS
The storage of construction equipment and materials shall be confined to within the
project work site and or upland areas greater than 40 linear feet from the tidal wetland
boundary.
During construction, concrete or leachate shall not escape or be discharged, nor shall
washings from transit mix trucks, mixers, or other devices enter tidal wetlands and or
protected buffer areas.
Any debris or excess material from construction of this project shall be completely
removed from the adjacent area (upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or protected buffer areas.
Necessary erosion control measures i.e., haybales, silt fencing, etc. are to be placed on the
downslope edge of any disturbed area. This sediment barrier is to be put in place before
any disturbance of the ground occurs and is to be maintained in good condition until thick
vegetative cover is established.
Roof runoff must be directed to drywells a minimum of 75 linear feet landward of the
most landward edge of the tidal wetland boundary, and must be installed a minimum of 2
feet above seasonal high groundwater.

The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers ~ermits:

A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure tocomply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.,
If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachmen= upon State-owned lands
underwater.

APPRAISER'S CERTIFICATION: The Appraiser certifies and agrees that:
1. I have researched the subject market area and have gelected a minimum of three recent sales of properties most
similar and proximate to the subject property for consideration in the sales comparison analysis and have made a
dollar adjustment when appropriate to reflect the market reaction to those items of significant variation. If a
significant item in a comparable property is superior to, or more favorable than, the subject property, 1 have made
a negative adjustment to reduce the adjusted sales price of the comparable and, if a significant item in a comparable
property is inferior to, or less favorable than the subject property, I have made a positive adjustment to increase the
adjusted sales price of the comparable.
2. I have taken into consideration the factors that have an impact on value in my development of the estimate of
market value in the appraisal report. I have not knowingly withheld any significant information from the appraisal
report and I believe, to the best of my knowledge, that all statements and information in the appraisal report are
true and correct.
3. I stated in the appraisal report only my own personal, unbiased, and professional analysis, opinions, and
conclusions, which am subject only to the contingent and limiting conditions specified in this form.
4. I have no present or prospective interest in the property that is the subject to this report, and I have no present
or prospective personal interest or bias with respect to the participants in the transaction. I did not base, either
partially or completely, my analysis and/or the estimate of market value in the appraisal report on the race, color,
religion, sex, handicap, familial status, or national origin of either the prospective owners or occupants of the subject

any related party, the amount of the value estimate, the attainment of a specific result, or the occurrence of a
subsequent event in order to receive my compensation and/or employment for performing the appraisal. I did not

mortgage loan.
7. I performed this appraisal in conformity with the Uniform Standards of Professional Appraisal Practice that were
adopted and promulgated by the Appraisal Standards Board of The Appraisal Foundation and that were in place as
of the effective date of this appraisal, with the exception of the departure provision of those Standards, which does
not apply. I acknowledge that an estimate of a reasonable time for exposure in the open market is a condition in
the definition of market value and the estimate I developed is consistent with the marketing time noted in the
neighborhood section of this report, unless' I have otherwise stated in the reconciliation section.
8. I have personally inspected the interior and exterior areas of the subject property and the exterior of all properties
listed as comparables in the appraisal report. I further certify that I have noted any apparent or known adverse
conditions in the subject improvements, on the subject site, or on any site within the immediate vicinity of the
subject property of which I am aware and have made adjustments for these adverse conditions in my analysis of
the property value to the extent that I had market evidence to support them. I have also commented about the
effect of the adverse conditions on the marketability of the subject property.
