9:30 A.M. - The Board began the audit Of outstanding bills, and reviewing off-
agenda for di~scussion items.
10:'30 A.M. - David S. Horton met with the Board to discuss his'applic~ition for
a trailer permit (Resolution No. 22). ~Mr. Horton explained to the Board that
during the past weeks he has had a vehicle stollen, vandalism to other vehicles,
trail bikes over and around the property and it has become apparent that a
watchman must be stationed on there twenty-four hours a day. The operation
consists of greenhouse and their crop at times, could have a value exceeding
$?5,0'00, and if'damage were sustained at the greenhouse the crop could be
severely damaged. Although the Board is not in' favor of~ creating mobile home
housing, they agreed they would grant Mr. Horton his permit, but reevaluate
same at the expiration of a six month period.
10:45 A.M. - The Board discussed the presentation of the proposed Master
Plan Update and was in agreement they would meet weekly to study and thoroughly
discuss same priol~ to the hamlet meetings.-~Vi. For Discussion Items: (2) proposed
Coordinator for Veteran's Affairs. It'was the concensus of the majority of't'he Board
that in accordance with the suggestion of the Commander of the Catholic 'War Veterans,
there should be a Council 'made up of a representative of each of the six veteran's
groups in the Town rather than one person designated as Coordinator. (See
Resolutions 25' and 26.)--(3) Request from the Mattituck Men's Slow Pitch Leaque
for funding for the 1985' season. Although this ~should be a function !0f the I~ecreation
Supervisor, it was felt that the Board would continue with their past practice until
the Rec Supervisor has an opportunity to study the procedure for the 1986' season.
(4) Letter from the Catholic War Veterans advising the Board they had expended
$200.00 over and above amount allocated for the 7984 Memorial Day Parade activities.
Supervisor .... Murphy will review this, although.the law sets a maximum amount to be
allocated from Town funds.--Councilwoman Cochran brought to the Board's attention
what she feels to be a need for, closer supervision in~cleanin~l the Senior/Youth
Center, as well as defects in the roof causing serious problems to the Ceiling. Mrs.
~-~-~-~an was advised that recommendations to correct the sitUation were made by
Lyle Meredith two years ago and only minor corrective action was taken. Mrs.
Cochran will review the recommendations of Mr. Mereditl~.--(5) Memorandum from
Riverhead Town Councilman John Lombardi Concern proposed ash dump was discussed.
The Town Clerk was asked to determine whether Mr. Lombardi's petitio~ was the
result of a Riverhead Town Board ~action or resolution.--(6) Receipt of draft copy
of the section on Accessory Apartments in single-family residences from the proposed
revisions to the Zoning Ordinance as submitted by RPPW.--(8) Receipt of estimate
for restretchin~ existing carpet at the. Town Hall from Penny's Flooring Centers--
total of $994.50. The Board unanimously agreed this should be .accomplished as
soon as possible.--(9) Receipt of suggested wording for "berm" to be incorporated
in the Zoning Ordinance-from Szepatowski Associates Inc..--~10) AppliCation of John
and Norma Jean Mehrman for a temporary trailer permit on Wells Road, Peconic: Mr.
Mehrman indicated in a letter accompanying the appliCation that he would like to
situate a trailer on his property to be occupied weekends while he builds his home.

MAY 7, 1985
The Board determined such a use would not be acceptable.--(11) Receipt of memorandL
from Planning Board member William F. Mullen, Jr. concernin9 Affordable Housing.--
The Board again-disCussed a town-wide dog census and decided this activity should
be conducted by the North Fork Animal Welfare League, Inc. under their contract
with the Town.--Letter from the Board of Town Trustees requesting the services
of Szepatowski Associates Inc. to review the application of Chesterfield Associates,
Inc., on behalf of John Loretto, was considered. It was the concensus of the
Board that the services of the NYS-DEC should be utilized and they should contact
Gene Gilman of that office.--Councilwoman Cochran suggested to the Board that the
coatroom area in the Senior/Youth Center would make a perfect office for the new
Recreation Supervisor. All that is 'needed is paint, replace the bi-fold window with
glass, purchase of necessary office equipment. The Board was in agreement with
the proposal. The work..should be completed by June 1st when the Rec. Superviso~-~
begins work. [~ i

for a no-parkin'9 sign at the foot of Duck Pond.,Road. Mr. Nicholas Aliano, owner! :I
of the Duck Pond Motel has repeatedly made this request, as well as the Cut~u~ ~
Fire Department who feel a "fire Zone" is necessary for emergencies. A revi f ....
Vehicle & Traffic Ordinance revealed that there ,s presently a No Parking on- both
sides of Duck Pond Road between the hours of 10 PM and 7 AM from the guardrail
at the northerly terminus southerly for a disiance of 400 feet. The Board felt this
restriction' is :sufficient.--While' on this subject, CouncilWoman Cochran requested the
Board to consider, a "stop" sign rather than a "yield" sign at the corner of Traveler
Street and Horton Lane, Southold; the opening of the Post Office on Traveler Street
has increased traffic'considerably.
3:35 P.M. - Work Session adjourned.

it's quite an honor for Pete and the entire Town Board of Southold. I'd like to
make this proclamation to Pete for your club; for the Mattituck Club, our. congratulatio~

i. REPORTS.
SUPERVISOR MURPHY: Moving on to the first item on our agenda is Reports.
1. East End Counseling Project monthly report - April 1985.
2. Szepatowski Associaies, Inc., monthly progress report - April 1985.
3. New York State Department of Agriculture and Markets, Dog I.D.
Municipal Compliance Report - North Fork Animal Welfare League, Inc. - Dog
Pound. We've done pretty well on our Dog Pound.
4. Town Clerk's monthly report - April 1985:.
S. Building Inspector's monthly report - April 1985.
6. Town Trustees' monthly report - April 1985.
I'd like. to say that these are ali on file in the Town Clerk's Office for anyone
who is interested in reading them.
7. Councilmen's reports. I'll start on my left, Judge Edwards?
JUSTICE EDWARDS: Nothing at this time. Thank you.
SUPERVISOR MURPHY: Jean?
COUNCILWOMAN COCHRAN: Yes, as a point of information the Recreation
Director's Office will be located in the Senior/Youth Center, so that it's on
record where her office will be starting June 1st. Also, on Thursday, May.
2nd I attending the Housing Advisory Committee and the are finally getting
down to the final draft of consolidating--actdally the final phase of consolidating
three draft questionnaires that they've been working on and it 'was the concensus
o~f Mr. Mullen, who is a Planning Board member and iiai'son to the Committee, that
it'S. very important that we do do the questionnaire because the information that
we've had to work with up to this point is five years old and we would like updated
information because housing has changed a great deal in the last five years in
Southold Town. The next meeting is 'scheduled for May 16th at 5:00 P.M. here at
Town Hall. Also, earlier talking with Mr. Neville out in front of the Town Hall
he informed me that .Sunday, May 19th, and he Would like me to extend this
invitation to all Board members, that on Sunday, ~May 19th, on Fishers Island,
they will' be going over to do Installation of Officers at the Veteran's~,Post on
Fishers Island. They are trying to arrange transportation at this point, but
Bob, I'm sure you'll be letting us know more about this, okay? Thank you.
That's it, Frank.
SUPERVISOR MURPHY: Thank you, Jean. Paul?
COUNCILMAN STOUTENBURGH: Yes. Starting with last night, I attended the
Water Advisory Committee meeting and it looks like we're coming down the home
stretch. A lot of things are starting to be. brought together. We'll know about
a grant in a few weeks. We're going to have to make a decision one way or
another which way we should go as far as a Water Authority, whether we want
MAY 7, 1985
2-71
to do it 'ourself or an outside firm.~ As a,matter of fact we're meeting on May
13th, 4:00 o'clock in the afternoon with the Suffolk County Water Au~horit
get their views on how they function and what they might do or might not do
for us here in the Town. I also attended a Landfill Meeting of Joe's, who's
chairman of it and was quite impressed to have the haulers--these are the people
that collect the garbage, meet with us and sit down and try to resolve some of
the problems we're coming up with in our Town Landfill, and Joe will probably
tell more of this later on, but_ it was good to see the cooperation of these rugged
individuals. I also attended, on Sunday afternoon, the open house of Cedar
Beach Marine Center and for those of you who don't know this area, I think it's
something you should all get acquainted with. It's a really worthwhile organization
down there., doing a terrific job and needing as much publicity as they want and
should you know any young people looking for a two-year degree in Marine Science,
this 'is the place to get it and we have the facilities here. They spend three days
~ ~he ~" "" ~ a,~,d two days at ~ ,A, ~_
. ~=, ~,,,~ thalr academic mat
attended the Master Plan m~ting here which we all did, the Town Board and
mu:st say I was quite gratified to s~ what came from this plan. There are some
rough spots in it,' which we all agreed would be there, because we're pushing to
get this thing done and I think that was one of the reasons it wasn't completely
ironed out, but we're setting our goals to start working on this in the next week
or so, so hopefully our Mast Plan will'be in'the works in the near future. I also,
on a Saturday afternoon, drove down to Islip to see their ~TOP Pro, ram, Stop
Throwing Out Pollutants, and ! saw first-hand how they functioned and how
meticulously they were concerned about pesticides being spill]ed. They had the
whole area cover~ with plastic, they used a firehouse in that particQlar situation.
We hope to use our own Landfill area up there. The idea being that in:the fall
we will have a day when you have that old bottle of Chloridane or pesticides or
paint thinner or something you don't know what to do with, we'll rather than
throw it into the Landfill, which eventually goes into our groundwater, we're
going to try to pick all that material' up, at a cost to the Town Board, a fair
amount, to have it shipped out of Town to Ohio; where it will be disPosed of
and that's the only way we can do it. Also, probably the most important meeting
we had was the Parks and Recreation Committee, of which i'm Chairman. Ray
Dean, myself and Jay Schondebare, met as a three-team to try to set up goals
for us. We met--we then met again:after we'd set our goals with our person
who does the lifesaving. I think probably he is the key man that were looking
for, Bob Muir from MattitUck. We then layed out exactly what we wanted. We
had some trouble spots last year in Gull Pond and Town Beach. We have a
fairly 'good tight schedule lined up. We had Chief Winters sitting, so we'll have
an adequate patrol at these areas, police patrol, and I think the way your Park
and Recreation Committee ~s::functioning, we should cut down on the problems we
had last year. That's it, I think, Frank.
SUPERVISOR MURPHY: Thank you, Paul. Joe?
COUNCILMAN TOWNSEND: Last week was a pretty busy week for my committees.
We had a joint meeting of the Suffolk County Farmland Select Committee and the
Southold Town Farmland Committee and i think a rather significant outcome, they'.,.
have passed a resolution to dedicate up to 2.1 million dollars for our Farmland
Program and based upon the appraisals we have in, that's about what it's going
to cost. It's going to cost us almost 4' million dollars to obtain the development
rights on the thousand acres that have been offered to us. If the County backs
us up with at least that much, it will be. very helPful. We also found that there
is a whole number of people who have offered their 'development rights that didn't
get in by the deadline so if :there's any money left over on the County's part, maybe
we can spend it on that too. That will go a long way towards preserving Southold
as we know it now. There was a meeting of the Landmarks Commission on the same
day, Friday. They are attempting' to get a grant from New York-Council on the
Arts to catalogue' most of the other landmarks that they haven't been able to get
to, those houses dating from 1825 to say '1900. There are hundreds and hundreds
in the Town and it's a job that has been done in most of the other towns by SPLEA,
that's Society for the Preservation of Long Island Antiquities. This committee has
been particularly effective and it 'looks pretty good for this grant. It looks like
we're going to get at least' $6~,000 to do this: As Paul touched on, I'd like to see
if we can institute mandatory paper recycling ordinance. The advantage of this is
it would keep a fair amount of volume out of our Landfill which is a precious
commodity now,. volume of space in the Landfill, because we've only got until '1990
before we have to line the rest of the Landfill and we want to save that space while
we still have it. We tl~ought we'd start with this particular commodity, because it's
a commodity that's easily set aside and saved and I think it's an operation that our
local carters can work on. They can provide racks which can be bought by the
Town through State moneys. We had a fellow from the State who said that he
would provide us with money for any operation that would net some money via
recycling, so we're pretty enthuastic about this: We're meeting with them tomorrow
to look at some of the plans' they have to do this; That will be a meeting tomorrow
with the carters. Also, on Wednesday the Animal Shelter had a dedication for ten
new dog houses that the Boy Scouts made. They're all A-frames and probably would
command about $300 a month if they were put on the open market. Pretty nice look-
ing. That's about all I have, Frank.

MAY 7~ 1985
SUPERVISOR MURPHY: Thank you, Joe. Jay?
COUNCILMAN SCHONDEBARE: Yes, thank yQu. Along with Joe and Paul, I
attended the Landfill' meeting. We listened to the comments, though, of the DEC
and I'm not altogether that optimistic bn the recycling part of it. The amount of
paper, e~c., that we would recycle and that would be taken out of the Landfill;
I think you got to weight that with the. cost of doing so and 1 need more information,
basically, on that. It was a good presentation, a good slide and it's something we
have pursue and take a look at. Paul also mentioned the Beaches and Parks Committee
which i attended. We're going to hire some additional personnel this summer for the
purposes of trying to keep two particular beaches up to par. We've had a lot of
problems last year, irate citize'ns in or about those beaches came in and complained~
~:o us after the 'summer months~ so hopefully we'll be able to do something about I ii
meeting, which most of the members of the Town Board attended. At that one was
the presentation by the people from Tidemarks for a grandfather clause from our new
multiple density zoning that we put into place. They made their presentation, we
asked them questions, and now it's up to the Committee to make a determination and
submit it to the Town Board.
committees everybody attends,
another committee' meeting, but
We haven't done that and in listening to how many
it's getting very difficult to establish a .schedule for
that's what we'll attempt to do. That's it.
SUPERVISOR MURPHY: Thank you, Jay. As you could see your Town Officials
have been very busy. Ray Dean and I were down to Waste Management Conference
in Philadelphia last week and for the first time I think Ray and I have seen some-
thing that really holds promise for the Town. It's a little too early. We've been
invited to go down to Texas this-June to see the machinery actually work. About
the most simplest program that we've ever. come across and the thing that scares
you it's almost too simple, but we are again going down to Washington tomorrow,
Ray and I and Rodney Douglass, to look at equipment that could be used in resource
recovery. ,hile we were down there we stopped in the State of Delaware and went
to see a state-wide program that they have for resource recovery: They're very
active in it, and they have tremendous success with it and it's something that if
the whole state could it, naturally they're quite small, but if'a whole state could
do it we certainly could do it 'and we've got to start. We've also had a Handicapped
meetin~ this :week and where we identified--we did a research and a survey of ail
town beaches, also of all park dis~ricl~s, to come up with recommendations and set
a priority on how we are going to handle the handicapped swimming program and
to have the access to the beaches for handicapped people. I'm also very pleased
that we did finally get the Master Plan. We will have a meeting set up next week
to start revieWir~g the necessary Code changes. The Town Board has dedicated
itself to doing this 'in'the fastest manner possible. We realize' it's a long time
coming and we want it in place. We want to have a planned growth. We want
to know what's happening in the Town. And last,' but not least, a very happy
moment in my life. Tonight as I was having supper I had a call from Senator
Ken LaValle and I was approved by the Senate. I had been nominated previously
by the Governor as a member of the Lon~] Island State Park and Recreation CommisSion
and the ~enate had their meeting today and I was approved so I am now an official
member of the Long Island State Park Commission and it's quite an honor, really I
feel.
I!. PUBLIC NOTICES.
SUPERVISOR MURPHY: Moving on to the second item on the agenda is Public
Notices.
1. Army Corps of Engineers, notice of an application/~of the Port of Egypt
Enterprises, Inc. to dredge 10 year maintenance with upland disposal and place
riprap. Written comments by May 24th.
2. New York State DEC, notice of complete application by Steve Malinowski
to reduce the radius of sub-assignment area No. 1. This is on his clam program
on Fishers Island. Written comments by May 17th.
3. DEC notice of complete application of Richard Kearns to remove existing
docks and install two similar docks consisting of ramp, main floats, and install
float along existing bulkhead in'Greenport.. Written comments by May 24th.
4. New York State DEC notice of complete application by Bayview Develop-
ment Corp. to remove 12 existing cottages, with the remaining 19 cottages to
reamin on 19 new lots in Southold. Written comments by May 24th.
These are all posted on the Town Clerk's Bulletin Board for anyone who
would like to read them further.
Iil. COMMUNICATIONS,
SUPERVISOR MURPHY: Moving on to the third item, Communications.
1. From Dimension Cable Services on a schedule of rebuild conversions on
the way they've been going about doing it. One thing ! would like to say is I
think they're doing a very good job. They're not without problems. We've had
quite a few calls in on various aspects of it.' They are doing a complete rebuild.
MAY 7, 273
The company is. very cooperative and anyone who has called in complained to
either my office or to their care of and I really think they
are trying to do a good job
2. This is one that's very important. It is from the Lon9 Island Lighting
Company notifying us of it appears to be about a third increase in their pole rental
and equipment rental in'the Town of Southold. This is something that we are
consider!ng. We are going to reevaluate some of the old lights that are still around.
We will' probably have to remove some so that we will be able to put lights on what
we have a priority set up, which is dangerous intersections--any intersections, so
people know where they are, they could read the stop signs, read the direction
signs and any bad curves or any bad problems on the roads, that this:area will'
be lit up. This'is 'our first priority and the way the rates are going, these are
probably the only priority that the Town is going to be able to afford.
PUBLIC' HEARINGS.
SUPERVISOR MURPHY: There are no public 'hearings to night, so we'll move on
to Item Number V, which is Resolutions.
V. RESOLUTIONS.
SUPERVISOR MURPHY: The first resolution is to encourage a national solution
to prevent, contaminated shellfish.
Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh,
WHEREAS, the New York. State Commissioner of Health has suggested a ban on
the sale of raw shellfish in New York restaurants; and
WHEREAS, the state in'which the contaminated shellfish are sold may not be the
state of origin; and
WHEREAS, the suggested ban will'only apply to New York restaurants, but will
cause a great amount of unnecessary harm to the local shellfish industry; and
WHEREAS, the consumption of contaminated shellfish is a national problem requiri'ng
a national solution;
NOW, THEREFORE, BE IT RESOLVED that it is the position of the Town Board of
the Town of Southol.d that the suggested ban unfairly discriminates against local
_baymen and should not therefore be implemented; and be it
FURTHER RESOLVED that the State of New York should encourage a national
solution to prevent contaminated shellfish from entering the market.
SUPERVISOR MURPHY: Any questions? (No response.)
1.-Vote of the Town Board: Ayes: CouncilWoman Cochran, Councilman Schondebare,

trailer on his property, at Kirkup Lane, Mattituck, for a period of six (6) months,
to expire on November 7, 1985. This permit 'is only issued on a temporary basis
and will be reevaluated prior to the expiration date. it is not the intention of
the Town Board to create permanent "mobile' home" housing in the Town of Southold.
COUNCILMAN TOWNSEND: Question, or a statement, rather. This was discussed
at some length this morning. Trailer permits seem to be becoming more and more
in demand in the last few meetings that we've had. Even though we only have 16
in toto in the Town, I think we've had three in the last two meetings. I think
it's time that we put in some definitions, probably along with the Master Plan,
wherein we will'consider a trailer as a part of a business or a district as a
special exception, so once the Master Plan is in force i'm not going to be in
favor of continuing on a hit or miss basis allowing trailers in the Town, because
we have to set up parameters in which they'll be allowed and we have to be able
to refer to those parameters. That's my feelings.
SUPERVISOR MURPHY: Any other comments?
COUNCILMAN SCHONDEBARE: As we've discussed in the Work Session, we went
into it, so there's no sense doing it 'all over again, but I disagree. I want to keep
it as broad and as flexible as possible and allow discretion on behalf of the Town
Board. So we're going to have a problem with that one.
SUPERVISOR MURPHY: Thank you. Anyone else?
COUNCILMAN STOUTENBURGH: ! like Joe's idea.
COUNCILWOMAN COCHRAN: I support Jay. I think each application should be
taken on its merit as an individual situation and then judged.
