Edwards, Councilman Paul Stoutenburgh, Councilman James A. Schondebare, Councilwoman Jean W. Cochran, Town Clerk Judith T. Terry, Town Attorney Robert W. Tasker. 9:00 A.M. - Mr. Stuart Schilke came before the Board to discuss the recent paper "blow out" from the Landfill area which lettered the area in all directions. Mr. Schilke had spoken to the Board about this problem in December 1982 and cannot see that the situation has improved. He submitted photographs showing the debris on his street, Matthews Lane. He suggested more cover after dumping; an inner fence with a 45 degree break on the top; plantings--trees, shrubs; netting over the debris until it can be covered, The Board agreed that the problem is severe and they are working on a solution and hope to have the situation corrected in the near future. 9:25 A.M. - Robert Villa and Joe Baier, Suffolk County Department of Health services met with the Board to discuss the role of the Suffolk County Water. Authority in the Town of Southold. Mr. Villa stated there are two projects in Cutchogue and Mat.tituck area pending before their department requiring water supply systems. The Suffolk County Water Authority would come in only on a revenue producing bond basis. Councilman Townsend stated he has a proposed resolution on today's agenda asking the water authority to delay coming into Southold Town until the 'Water Advisory Committee has formulated a plan for future water supply in the Town. Mr. Villa produced a letter, dated September 24, :1982, from Dr. Harris to Supervisor Pell which states in part, "The Department..does not accept indicual water supplies for realty subdivisions when groundwater quality does not meet minimum State drinking water standards. In such cases, a public water supply is required ..... As a matter of department policy, we are requesting that any new community water supply systems be dedicated without cost to the Suffolk County Water Authority, and if that is not feasible, that it be dedicated to a town or village water district." Mr. Villa also submitted a letter, dated January 16, 1973, to Planning Board Chairman John Wickham from himself, concerning water supply problems and subdivision zoning.--In reponse to a statement concerning the water authority taking over the Greenport Village water system, Greenport Superintender~ of Utilities James Monsell, stated Greenport is going to try to maintain' its own franchise and does not see them being taken over by SCWA.--Water AdvisOry Committee Chairman Frank Bear stated it is time for the committee and the Town Board to look into its own water district and said he hopes Councilman Townsend's proposed resolution will pass to give the Town time to make studies 'and decisions. I was agreed that the Board should meet with the Suffolk County Water Authority and the Water Advisory Committee and a meeting was scheduled for 4:00 P.M., May 13th. ~i 10:30 A.M. - Thomas Gershaw and Bob Wojczak, AT&T Information Systems, made a presentation to the Board on their Horizon System and Merlin System (proposals on file in the Town Clerk's Office). The majority of the Board agreed there is a need for a new Town Hall communications System, and Mr. Gershaw was asked to conduct an office-to-office inventory for their needs. Councilman Schondebare objected to a new system if a bond is required--this expenditure should be placed in the budget. Councilman Stoutenburgh is not certain a new system is needed and would like to meet with the present contractor, Telecom Plus of L.I. to discuss the cost for updating the existing system. 11:30 A.M. - Senior Account Clerk Joan Richter and Police Lieutenant Stanley Droskoski met with the Board to explain the amount of money and time expended by Town Hall~ and Police employees to run errands, make banking transactions and deliver documents and legal notices for the Town Hall. (Resolution No. 5) to do these ng such a person as an unnecessary 11:50 A.M. -John Berryman and Bernard Dempsey, President, Greenport-Southold Chamber of Commerce appeared before the Board to discuss the chamber's request that the Board require economic impact statements before making any decisions on planning, zoning and other important issues confronting the business, community. They also discussed recently enacted Local Law No. 7 - 1985' pertaining to dwelling unit density, indicating that they feel it was "illegally adopted" and "pushed through". it was agreed the Commerce and Industry Committee would meet with the chamber to further discuss the proposed economic impact statement. Moved by Supervisor Murphy, seconded by Councilman Townsend, it was RESOLVED that the Board recess this Work Session at ~2:i0 P.M. for an Executive Session. This resolution was declared duly ADOPTED. EXECUTIVE SESSION 12:10 P.M. - The Board met with Alexander Stepnoski, Maintenance Mechanic Ill, to discuss personnel problems. 12:35 P.M. - Recess for lunch. 2:00 P.M. - Work Session reconvened and the Board audited billS and continued reviewing agenda and off-agenda items which they had previously begun between appointments during the morning Work Session. Tasker SUPERVISOR MURPHY: I'd like to welcome you all here and our first order of business is a resolution to approve the April 23rd i~udit of bills. Moved by Justice Edwards, seconded by Councilwoman Cochran, it was RESOLVED that the following audited bills be and hereby are approved for payment: General Fund Whole Town bills in the amount of $2,761.00; Fishers Island Ferry Disl~rict bills in the amount of $226,337.51; Federal Revenue Sharing Fund bills in the amount of $3,240.00; and Agricultural Land Development Rights bills in the amount of $6', 925.00. These reports are all on file' in the Town Clerk's Office for anyone who would like to see them. 1. HUD, Community Development fund report for the month of March 1985. Councilmen's Reports. I'd like to ask the Councilmen if they have anything Starting on my right with Jay. COUNCILMAN SCHONDEBARE: We had a Code Committee meeting which met again with the horse owners to discuss their problems that they have. We met almost for about an hour and fifteen, hour and twenty minutes with them and left with at least everybody understanding or,where we all stood on the given issue. The Code Committ'ee will have to meet again and come up with a final determination of what they want to do. We have another Code Committee meeting this coming Thursday. It is for purposes of discussing the grandfather clause pertaining to the density issue. We originally dis6ussed this at a prior Code Committee. We decided not to do it. We had a request by an attorney and a representative of one subdivision that would be involved--not a subdivisiOn--a density issue that would be ingolved in a grandfather. They requested the opportunity to come before the Code Committee and present their, case to us. We've agreed to let them come forward and to hear their'opinion and their position. That will be this Thursday night at 7:30, here in the Town Hall. Outside of that i spent a week-on vacation and I missed the Town of Southold, but I didn't miss the Town Board that much, but I did miss the Town of Southold. Thank you. SUPERVISOR MURPHY: Jay, ! don't understand that. COUNCILMAN SCHONDEBARE: I imagine you don't, Frank. SUPERVISOR MURPHY: Joseph. COUNCILMAN TOWNSEND: Well, it's been an active time. I was just trying to go through some of the things. We had another Water Advisory public hearin9 on the 10th, similar to the one we announced that was held in Orient--the last meeting. This one was relatively well attended and people seemed to have a real appreciation of the problems we have out here; On the 11th we conducted interviews for three or four Boards that had vacancies. Most of these vacancies were replaced from within the ranks of the Boards'-they were renewals of previous positions. However there are one or two new spots taken. We met to discuss the ongoing CSEA negotions. I think we're going to be able to proceed there without a lot of trouble, at least it appears that way now. The Town Board was all invited to attend the 9roundbreakin9 of the Lakeside Apartments that the Town is participating with the Village of Greenport in helping the Housing Alliance--Greenport Housing Alliance--to create some genuinely Iow cost housing. That project has been around, in concept anyway, since 1974, I believe, so it's only been eleven years to come into fruition. There was a Farmland Preservation meeting. The County has expressed concern. They want us to get going with our program as soon as possible. I hope there will be a meeting with ,~, the County Farmland Select Committee out here within the next month to review the lands that are available. We're talking about the possibility of sl~endincl close to '~"~ six million dollars if the, county expends all the money that they have set aside for the preservation of farmland, which would go a long way to preserving what we have here. So, needless to say we're all encouraging them to help us out on this. 1 think that's all I have, Frank. SUPERVISOR MURPHY: Thank you, Joe. Paul? COUNCILMAN STOUTENBURGH: Yes, I was at Code Committee with JaY, also. The important one which ! thought was w~rthwhile w~-~ ~-~rT~ ~/ater Advisory Committee meetin9 they had last week in Cutchogue. The Chamber of Commerce in Cutchogue was also meeting and therefore they couldn't attend that meeting and so I got maps from the County and took the presentation to them, and so they were quite happy to have that presentation seeing that they would have missed it otherwise, and ! think that it will awaken the business, community a little bit to some of the problems that we have with our' water in the T~ The thing that I did yesterday would probably be most important to 'm~n~i'~'i~t~ in'the~ TOwn, and that was taking two members of Lee Koppelman's Advisory Committee on a tour, ~long with Henry Smith, the President of the Trustees and our Bay Constable, to all our creeks. The reason being that we had quite a list of creeks ~that were denied funding this year and because of that we found that we were going to have some real problems coming up this summer without vacationing people trying to get out of the creeks and what have you and one of the criteria that they used, or many of the criteria that they use to say that a creek would be eligible for funds, was whether or not it had a boat ramp. In other words, do people have access to that creek so they could get out. And it wasn't just a--they weren't too interested in just a right-of-way, they wanted a ramp and they wanted a paved ramp, and if we had a paved ramp that was almost a sign that they would go ahead and fund money. But we don't have that in all our creeks and this is one of the things that we should be thinking about in the future. The other thing is that if the area had a marina in it. If that was a business venture, then that would be something to help support business and therefore again they would go ahead and dredge the mouth of that. creek. If there was an educational facility or a park. So all these things giving access to the public to our creeks were the factors that determined whether or not there is funds--or there is going to be funds available. So we went around and reassured them where we had our various boat ramps and our right-of-ways and our' marinas~ hopefully that the report coming back will give us back some of our dreding projects that we lost through this new policy of the County. That's about it, FranE.. SUPERVISOR MURPHY: Thank you, Paul. Jean? COUNCILWOMAN COCHRAN: Yes,-on April 17th I met with the Chamber of Commerce and Industry ~ommittee. Dave Mudd from the Grape Grower's Association did present to the combined chambers the idea of having a tourism project study done of the Southold/Riverhead/East Hampton and Southampton area. A similar study was done in the Nappa Valley region and was found to be a very important tool in supporting the tourism in that given area. What Mr. Mudd presented was that the group form a foundation with industry paying or donating the funds for this particular study. Also discussed was they feel very strongly that the Town should be aware that they do support additional tourist accomodations on the North Fork. They've just recently lost 33 units in a motel and they feel that there is not adequate housing in the summer- time for tourism. Also they expressed, in relation to traffic 'flow, they felt that there could be some measures taken immediately. They feel that if'there was a ~eview of the major highway--I would assume they were relating it to 25, that perhaps a study could be done and the traffic flow patterns could be adjusted to help flow the traffic along the North Fork a little easier. On April 10th I also attended the Committee that was presented at the Peconic Center by the Southold Town Water Advisory Committee. I felt it was an excellent program, but I feel that it was un- fortunate that we did. not reach more-of the community. I would say at that particUlar time perhaps there were 60 attending and that's drawing from our entire population. i wished we could find some incentives for people to attend these sort of things, but as normal people do not attend unless it's real controversial, and it was an excellent program, my compliments to the Committee. On April 19th the Recreation Committee held interviews for the top three, candidates on the Civil Service List for the positiOn of Southold Town Recreation Supervisor, and I am pleased to announce that the Board will be acting today on a resolution to hire Susan Steinmetz-Fossett. She's a resident of Mattituck. And I would just like to say a little something in relation to this; This is something that many people in the community have waited for for a long, long time. It's always been my feeling that Town government should radiate a philosophy that youth is important to their community and in the past year or so there's been a great deal of talk of concern for our young people with housing and jobs and I think a community has to radiaie a certain philosophy that youth is important to the community, not starting at the age of 18, but all of their lives and I'm am hoping that this is the beginning of saying to our young people: "yes you are an important part of the community no matter what age you are." Also, I'd like to extend my congratulations to the Greenport Housin9 Alliance and the Village of Greenport. I also attended the groundbreaking yesterday in Greenport and it's a good step forward. Thank you, Frank. SUPERVISOR MURPHY: Thank you, Jean. Judge? JUSTICE EDWARDS: A couple of little items. The new ferryboat being built down in the Gulf in Florida. The target date was Memorial ~eekend, and they're going to be very close to it, possibl'y the first week in June it Wilt be ready for delivery. I think we passed to sign some vouchers this morning for over two.hundred thousand dolalrs, I think, towards the boat. Also, I had a conversation with Mr. Dean this morning and he promises he's 9oing to come over to the Island sometime ir~ th~ next couple of weeks to look at some serious drainage problems we have over there, and the Island people will appreciate it ~ery much. Thank you, Frank. SUPERVISOR MURPHY: Thank you, Ray. It's been a busy two weeks. Yesterday I met with the Baymen and one of their concerns was a ramp on to the Sound. And they were happy to hear that the Town is in the process of gettin9 the Deitz property. We're just_ _waiting for a__n. appraisal and I think the efforts of Paul will be finally come 25O APRIL 23, 1985 abOUt and hopefully we'~ have that property this year. They were very supportive of that and. very, concerned about dredging. They ~iked our idea and we had a meeting yesterday workin9 out the drainage easements down at Skunk Lane to do a very unique proiect. ~t will be the first one done in the Town Hke this and is to try to c~ean up road water before it goes into our creeks. They were most Supportive of this and talking to the Trustees they like the idea very much and are anxious to start testing of the water as soon as we're ready to construct it they want to test before and after so we can monitor the results and see if we can do this in other places, if this works it wi~ 9° a ~on9 ways to he~ping to dean up our creeks. And I'm happy to say that today they're plantin9 1000 privits alon9 the two edges of the LandfH~ to start to help c~ean that p~ace up. It's in dire need. And I attended, ~ast Saturday, the STOP Program over in ~s~ip.. The Commissioner of DEC was down, Hank WH~iams and Harold Berger from the Region here. Mike LoGrande and ! were there and ~ had reservations about the program at first, and if t s a wate of money and the way they were doing it. ~ thought we could store the stuff, and they mad~. some very good points and i'd be very much in favor of us doing that. i think it was an excellent idea. lt~ certainly was done professionally and I think there is a real need here. COUNCILMAN STOUTENBURGH: Co~ld I just say one thing, Frank? Anyone interested in seeing this, it'S again this 'Saturday. It was last Saturday and this Saturday in the Town of lslip, and I will' attend that meeting this coming Saturday. i will be there. SUPERVISOR MURPHY: It's most interesting. I1. PUBLIC NOTICES. COUNCILMAN STOUTENBURGH: I pulled that one out also. And we should take some action on that. Dimension Cable Services, carriage requests on basic cable service by Channel 55, WLIG, Riverhead and Channel 18, WHCT, Hartford and Channel 2, WCBS, New York. V. RESOLUTIONS. SUPERVISOR MURPHY: Moving on to item V now is Resolutions. The first one is attendance of a two-day seminar. -Moved by Councilman Townsend, seconded by Councilman Schondebare, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes those ir~dividuals authorized by the Supervisor, to attend a 'two-day regional seminar on "Microcomputers In Local Government", to be held at Howard Johnson's, Hauppauge, New York, on May 16 and 17, 1985', and the regisiration fee of $30.00 for one day ~ or $50.00 for b~th days, as well as meals and mileage shall be a legal charge against the Town of Southold. SUPERVISOR MURPHY: Any questions? Moved by Councilman Stoutenburgh, seconded by CouncilWoman Cochran, it was RESOLVED that the application of Ange and Barbara Boursiquot for renewal of a single family house trailer permit, for trailer located at private road, off north side Main Road, Mattituck, New York, ~hich permit expires on May 4, 1985, be and hereby is granted for a six' (6) month period. SUPERVISOR MURPHY: Any questions? This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 3 is an environmental assessment on a change of zone application. Moved by Councilwoman Cochran, seconded by Justice Edwards, WHEREAS, Meadow Farms Associates, has hereto applied to the Southold Town Board for a Change of ZOne from "A" Residential and Agricultural District to "M" Light Multiple Residence District on certain property located on the westerly side of Main Road (N.Y.S, Route 2~;), south of Tu¢ker Lane, Southold, New York, NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS: 1. That pursuant to the provisions of Article 8 Of the Environmental Conservation Law, Part 617 of Title 6 of the New York State Codes, Rules and Reglations, and Chapter 44 of the Southold Town Code, the Southold Town Board, as lead agency, does hereby determine that the action proposed is a Type I action and is likely to have a significant effect on the environment. 2. That the Town Clerk shall file and circulate such determination as required by the aforementioned law, rules and code. 3. That the Town Clerk immediately notify the applicant, Meadow Farms Associates, of this determination and further request said'applicant to prepare a draft environmental impact statement, all in accordance with said laws, rules and code. SUPERVISOR MURPHY: Number 4, which is an agreement between the Town and Cross Sound Ferry, Inc., we're going to hold until we have the approved agreement between the Town and the County. Number 5 is one which I think we should hold right now. (Appoint a Driver Messenger for the Southold Town Hall.) COUNCILWOMAN COCHRAN: Well said'. COUNCILMAN STOUTENBURGH: I think it's a good idea. SUPERVISOR MURPHY: i didn't think it would win, even though 1 think we need one. COUNCILMAN SCHONDEBARE: Let's not start it again. SUPERVISOR MURPHY: Number 6 is 'to authorize'a building inspector to attend a fire inspectors course. Moved by Justice Edwards, seconded by Councilwoman Cochran, it was RESOLVED that the Town Board of the Town of Southold hereby authorizer one employee in the Southold Town Building Department to attend the Introduction to Fire Inspection course to be held at the Academy of Fire Science in Montour Fails, New York, on May 6 through 10, 1985, and the cost for mileage shall be a legal charge against the Town of Southold. (All expenses, other than mileage, will be paid by the Fire Departments.) SUPERVISOR MURPHY: I might explain that any other expenses will be paid by the fire departments for this man to attend. SUPERVISOR MURPHY: Number 7 is to authorize attendance at a water quality management seminar. SUPERVISOR MURPHY: Number 8 is to authorize' the expenditure of $300.00 towards the cost of a lobbyis[. e Moved by Supervisor Murphy, seconded by Councilman Stoutenburgh, WHEREAS, the towns within New York State' have unique collective interest which need protection; and WHEREAS, the State Legisl'ature is enacting ever increasing amounts of legislation affecting towns and such legislation often ignores home rule messages decrying ,_, increased costs to towns as a result of unreasonable regulations; and WHEREAS, such legislation unfairly limiting State per capita aid, refusing reimburse- ment to towns for the costs of property tax exemptions,a nd enactment of laws un- reasonably setting rules for the placement of landfills, are but three examples of what has happened to towns in New York State; and WHEREAS, at the Suffolk County Supervisors' Associal~ion meeting of March .21, 1985', the Supervisors agreed that each town in'Suffolk County, together~with a number of towns in Nassau County and upstate New York, pool their, collected resources to employ a lobbyis~ in Albany whose iob it would be to oversee the special and unique interests of towns within New York. State; and WHEREAS, the lobbyist employed I~y the state's towns will be held accountable to town interests, rather than enter into a potential conflic~ of interest by representing other municipal iurisdictions including small towns; and WHEREAS, the,Suffolk County Supervisors' Association requested that each town consider a fair and equitable sponsorship plan leading to a contribution of $1.50. per 10,000 citizens within each township as certified by the most recent Federal Census, which amount would collectively support the cost of a lobbyist; NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold hereby endorses the concept of a paid Iobbyis~ to represent the unique special' interests of Southold and other towns within New York State; and BE IT FURTHER RESOLVED that the Town Board of the Town of Southold hereby authorizes the expenditure of $150. per 10,000 citizens of the Town of Southold as certified by the most recent Federal Census for a total expenditure~of $300. in 1985; and BE IT FURTHER RESOLVED that the Town Clerk is hereby authorized and directed to prepare and transmit all necessary documentation of this resolution to the Super- visor of each township in Suffolk County, Nassau County, and the Township of Gree SUPERVISOR MURPHY: Any questions on it? What this is is the ten Suffolk towns are going to hire a lobbyist to represent our interests in Albany and there are several other Upstate towns around our size that are interested in joining also. It will be set up properly. Islip Town will manage it. The way the fee is coming is that for every 10,000 of population there's $150. cost, so Shelter Island would have $150. fee, Riverhead, So~thold would be at $300. The other towns probably up around ~1500. on their cost. I think it's most needed. Several points--the last one that came down was the veteran's exemption that was passed and the landfill bill that was passed without any consultation with the towns at all. Any other questions? Subject to the provisions of this resolution and of the Law and pursuant to the provisions'of Section 30.00 relative to the authorization of the issuance of bond anticipation notes and of Section 50.00 and Sections 56.00 to 60.00 of the Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes and prescribing the terms, form and con~ents and as to the sale and issuance of the bonds herein author!zed and of any bond anticipation notes issued in anticipation of said bonds, and the renewals of said notes, are hereby delegated To the Supervisor, the chief fiscal officer of the Town. Section 6. The validity of the bonds authorized by this resolution and of any noses issued in anticipation of the sale of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for which the Town is not authorized to expend money, or (b) the provisions of law which should be complied with at the date of the publication of such resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution. This bond resolution, as amended shall take effect immediately, and the Town Clerk of the Town, is hereby authorized and directed to publish the foregoing resolution, in full, as amended, ~ogether with a Notice attached in APRIL 23, 1985 substantially the form prescribed by §81.00 of the Law in "THE LONG ISLAND TRAVELER-MATTITUCK WATCHMAN," a newspaper published in Southold, New York, and in "THE SUFFOLK TIMES," a newspaper published in Greenport, New York, each having a general circulation in the Town and hereby designated the official newspapers of said Town for such publication. As you know I feel that we could provide both better service and more economically if 'we had two part-timers put on in the summertime r for a tota! of three and one in the wintertime for a total of one, than having two all year around. You yourself said' the comp time thing is 'not going to work' out any more~ so wouldn't it be better, to have three in the summer and one int he winter so that when you need all the service you can get it, Two weeks ago you agreed with me on this and as it is now we're going to be providing benefits for another full-time person and his 'salary is not going to be at the rate that you are approving now for very~ long. I think since the waters are primarily used and fished in the summertime, that's the time to have it and since it would make sense economically to do it that way, I oppose this appointment. I'd be happy to appoint Mr. McCarthy and any one of the others as a part-time man in the summer. That's all I have to say. SUPERVISOR MURPHY: Any other, comments? COUNCILMAN STOUTENBURGH: Yes, on the opposite side of the ledger I think we should take the Trustees' recommendation for the simple reason that they're very concerned about having someone they can train as a person that will represent them in the Wetlands Applications and they wouldn't want someone who would be there only avai!able during the summertime. Wintertime, year around, and someone permanent that .builds up a background of~ knowledge about our creeks and not some- one who is changing every so often and every summer that comes around and that's why I feel it's a good idea to have a full-time person. I had heard that Suffolk County Water Authority was considering coming in and servicing two areas, one of which was not yet in service and another one which is just about ready to go on line. My concern was that once they start a presence here or start the ball rolling, we would not have any ability to put our objections before them, therefore I asked Judy to put a 24. resolution opposing their, coming in to Southold Town and told her that I would provide a letter. The intent of that was not to say that we would forever oppose them, but we just wanted a chance to consider some options other than their presence. Therefore, I've written a letter which I'd like a resolution in support of by the Town Board to send the letter.
