The memo was from Mr. Allan R. Dose, SRA; Chief Appraiser of HUD and was a compilation of the past 20 years worth of Field Office Memos. The memo is 9 pages long and deals with everything from electrical to basements & foundations. The section dealing with foundations is as follows: . "Foundations are a source of trouble, especially those made of concrete block and clay the that have weak resistance to lateral pressure. Unless the backfill has been compacted and the grade carefully maintained to keep moisture away, displacement and cracking is common. Foundation walls usually move first at the weakest point which is midpoint of the wall. Walls that have "bowed" significantly will show "stairstep" cracking usually at the outside corners. This will require corrective action. The condition will not stabilize. It's a question of how much time remains. There are three common ways to save bowing foundation walls. Contractors install wall anchors on approximate 6' centers. These stop further movement and with proper tension will eliminate some, if not all, of the bowing over time. Another acceptable, but more expensive method, is to replace the affected walls. The third is to use passive resistance such as grout filled channel steel or pilasters which may stop further movement. This is the least effective. None of these actions will provide a permanent cure unless care is taken to keep moisture away from the foundation by proper grading and guttering. No. 4590 — WALTER KRUPSKI PARCEL 1000-114-10-6 STREET & LOCALITY: 315 Pat Lane, Mattituck, NY DATE OF PUBLIC HEARING: August 13, 1998 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The above-referenced property is known as Lot 14 on the Map of Deerpark and is situated along Pat Lane and Deer Drive, Mattituck. The survey map submitted under this application shows that the subject premises contains a total area of approximately 19,994 sq. ft. and is improved with a one-story frame dwelling with attached garage and decks. The existing dwelling is shown to be 35 feet from the front property line along Pat Lane (from the foundation). BASIS OF APPEAL: Building Inspector's June 26, 1998 Action of Disapproval which reads as follows: "...The proposed addition being located on a non- conforming lot in an R-80 Zone of approximately 24,440 sq. ft. is required to have a minimum front yard setback of 40 ft. or existing, Article XXIV, Section 100-244B." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is to construct an addition for a new foyer-entrance at the front of the dwelling, 5 ft. by 11 feet wide, leaving a setback of approximately 30 feet from the front property line along Pat Lane. REASONS FOR BOARD ACTION DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because applicant is requesting a 5 ft. alteration to existing front porch area which will enhance the overall physical condition, and in no way detract from the surrounding properties Page 2 - August 24, 1998 Appl. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because existing house as constructed in 1976 has been unaltered as it exists at a non- conforming setback (front of house only). (3) The requested area variance is not substantial representing a percentage of less than 15% (or 14.2%). (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because a majority of the homes in the subdivision have existed for more than 20 years and have improvements with similar setbacks. (5) The situation has not been self-created. In considering this application, the Board deems this action to be the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community.
