TOWN OF SOUTHOLD In the Matter of the Petition of: Donald a. & Elizabeth garside For a Variance to the New York State Uniform Fire Prevention & Building Code DECISION PETITION NO. 1998-0248 Upon the application of Donald A. & Elizabeth Garside, filed pursuant to 19 NYCRR 450 on March 13,1998, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to an attic conversion of an existing dwelling of an A1 occupancy, one story in height, type 5(wood frame) construction, approximately 1,355 square feet in area, located at 165 L'Hommedieu Lane, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 7'11.1(a)(2), which requires that in habitable space under a sloping roof, the minimum height in at least 50 percent of the floor area shall be 7 feet 6 inches and the area where the height is less than five feet shall not be considered in computing required floor area. 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. 9 NYCRR 713.1(e), which requires that the minimum clear headroom over any portion of any fixed stair tread shall be not less than 6 feet 6 inches measured vertically from the surface of the tread. printed on recycled paper Petition No. 1998-0248 Page 2 9 NYCRR 713,2(b), which requires doors intended for passage to be not less than 6 feet 8 inches in height. [The petitioner requests relief to allow a bedroom built into the existing attic to have a ceiling height of 7 feet 4 inches within a sloped roof, and 6 feet 9 inches under a dropped beam, to allow a bathroom to have a ceiling height of less than 7 feet at the side walls, to allow the headroom over a portion of the upper most two risers to be 5 foot 11 inches and 5 foot 4 inches, and to allow an angled door to a bathroom to have heights of 5 foot 4 inches and 6 foot 2 inches.] FINDINGS OF FACT 1. The building that is the subject of this petition is a existing one story structure of approximately 1,060 square feet. The building is situated on a relatively small lot where expansion to the sides, front and rear are restricted by local zoning ordinances. 2. Because of the physical constraints and economic reasons the petitioner opted for converting the existing attic into a bedroom and a bathroom. This existing attic had its own physical restraints which has caused the petitioner to seek relief from the Uniform code 3. The ceiling in the bedroom area which is located within the sloped roof is 7 feet 4 inches at the peak and is 3 feet at the knee walls. The contractor installed a structural ridge which drops the ceiling height to 6 foot 9 inches under the beam. With the bed and other furniture set against the knee wall areas the ceiling height is adequate for normal usage throughout most of the bedroom. 4. The bedroom meets the requirements for light, ventilation, and emergency egress. 5. The ceiling height in the bathroom is 7 feet 2 inches at the peak and 5 feet 2 inches at the knee walls. With the placement of the fixtures the ceiling height is adequate for normal usage. 6. Because the door to the bathroom is located near the sloped area of the roof the height has been restricted to 6 foot 2 inches on one side and 5 feet 4 inches on the other. Although this height is restrictive and not desirable, it appears that there is no alternative. 7. The headroom on a portion of the two upper most treads is 5 feet 4 inches and 5 feet 11 inches. Petition No. 1998-0248 Page 3 This restricted headroom only occurs on a small portion of the treads and does not affect travel too adversely. The stairs conform to the Uniform code in all other respects. 8. The petitioner has agreed to install a fire and smoke detecting device in the in the new bedroom and interconnect it with deices on the lower floor. 9. The local Code Enforcement Official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.1(a)(2), 711.2(b), 713.1(e), and 713.2(b), to permit a bedroom built into the existing attic to have a ceiling height of 7 feet 4 inches within a sloped roof and 6 feet 9 inches under a dropped beam; to allow a bathroom to have a ceiling height of less than 7 feet at the side walls; to allow the headroom over a portion of the upper most two risers to be 5 foot 11 inches and 5 foot 4 inches; and to allow an angled door to a bathroom to have heights of 5 foot 4 inches and 6 foot 2 inches be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the petitioner installs a fire and smoke detecting alarm device in the new bedroom and interconnect it with devices on the lower floor. This DECISION is issued under 19 NYCRR 450.6. Unless obiected to bv the oetitioner in a writing received by the Department. the decision shall become FINAL after fifteen davs of receipt of the decision bv the parties. This decision is limited to the specific building and application before it, as contained within the Petition No. 1998-0248 Page 4 petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
