Box 2003 Bridgehampton, NY 11932-2003 RE: ADRIENNE LANDAU 855 SOUNDVIEW AVENUE, MATTITUCK SCTM#: 1000-94-1-7 Dear Mr. Ivans: The Southold Town Board of Trustees reviewed the survey prepared by Barrett, Bonacci & Van Weele, PC, last dated September 29, 2017 and determined that the proposed construction of a detached Workshop is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area 2 between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. The definition continues but for brevity,all are other"dwelling"types. 3) The Definition of Dwelling(Unit) DWELLING UNIT.A single unit providing complete independent living facilities for one or more persons,including permanent provisions for living,sleeping,eating,cooking and sanitation I have searched in multiple thread types,and come to the conclusion I hope you might agree with. A.pool house,not habitable as a dwelling could be exempt from the Energy Code.Generally speaking,Anything that gets a Certificate of Occupancy would be required to meet the NYS ECCC,but structures obtaining a Certificate of Completion should be exempt. Additionally,Buildings with very small volume's have an extremely difficult time meeting the required 3ACH50. This building has a volume of approximately 8400 cu ft.The required blower door measurement is 8400*3/60=420CFM50_(al-3 ACH) Arguably and for consideration, How much would be saved if we compared to the old 7 ACH50. 8400*7/60=980CFM50. If we subtract the difference 980cfm50-420cfm50=560CFM50 over. Now,to actually see the difference of new code Vs old code and put in terms that are more intuitive,we need to CONVERT cfm50 to cfin Natural. For a single story home,in NYS the Lawrence Berkley Lab,"N"Factor is 19.We divide the 560/ 19=29CFM Natural. If this pool house was built to the old 2010 ECCC,at 7 ACH50 there would only be a savings of 29CFM with the new 2020NYS code. A bathroom exhaust fan normally can produce 120CFM,far exceeding the overage and nullifying any savings. Its my professional opinion as a HERS rater,Prior RESNET QA Designee and a NYS code official that infiltration testing should not be required for a non habitable pool house.
