That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Sbuthold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work. shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein statedwithout expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a"notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. Box 1047 Southold, NY 11971 RE: NEIL STRONSKI & PATRICIA PEREZ 7025 NASSAU POINT ROAD, CUTCHOGUE SCTM# 1000-111-15-10 Dear Mr. Kimack: The Board of Town Trustees took the following action during its Regular meeting held on Wednesday, June 14, 2023 regarding the above matter: WHEREAS, Michael A. Kimack on behalf of NEIL STRONSKI & PATRICIA PEREZ applied to the Southold Town Trustees for a Wetland permit under the provisions of Chapter 275, of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 12, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 14, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed in part will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of NEIL STRONSKI & PATRICIA PEREZ to construct.a 93 linear foot long lower retaining wall with a 12' return along northerly property line at 45 degree angle (105 I.f. total); backfill with approximately 200 cubic yards of fill (±110 cu.yds from off-site); excavate 12" below top of bulkhead to retaining wall (±90 cubic yards) and deposit landward of retaining wall; cover area with one layer of jute mating O/E and plant American beach grass at Von-center O/E (±3,600sq.ft.); place heavy stone 6"-8" as scour pad (2.2 tons) between proposed lower retaining wall and existing bulkhead with filter fabric underlayment (±1,065sq.ft.); remove existing bluff stairs for construction and replace with a 4'x8' top landing to a 4'x18' staircase to a 4'x8' upper middle landing to a 4'x14' staircase to a lower middle 4'x4.5' landing to a 4'x2.6' staircase to a 4'x11.5' bottom landing to a 4'x8.5' stairs to beach; with the condition of a one to one native hardwood tree replacement and to establish and perpetually maintain a 15' native vegetated non turf buffer at top of slope with a 4' wide access path and that the temporary irrigation is to be removed within two (2) years; and as depicted on the revised site plan prepared by M.A. Kimack, received on June 30, 2023, and stamped approved on July 3, 2023. WHEREAS, the Board has determined that the remainder of the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275; and WHEREAS, the Board has determined that the remainder of the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and pursuant to Chapter 275-12 (A) of the Southold Town Code, Adversely affect the wetlands of the Town". and (B) "Weaken or undermine the lateral support of other lands in the vicinity'; NOW THEREFORE BE IT RESOLVED,that for the foregoing reasons, the Board of Trustees DENIES that portion of the Wetland application of NEIL STRONSKI & PATRICIA PEREZ for the removal of a 14" diameter, 6 diameter, and two (2) 12 diameter trees at top of bluff; construct a 100 linear foot long upper retaining wall with a 6' return along northerly property line; backfill with approximately 30 cubic yards of fill from off-site; and as depicted on the site plan prepared by M.A. Kimack, last dated June 8, 2023. This determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project.
