Box 582 Bohemia, NY 11716 RE: CHARLES & SHERRY SOLON 4553 WICKHAM AVENUE, MATTITUCK SCTM#: 1000-107-4-13 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 16, 2023 regarding the above matter: WHEREAS, Michael Kimack on behalf of CHARLES & SHERRY SOLON applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 20, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed application be found Inconsistent with the LWRP and specifically Inconsistent with the following coastal policies: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed dock does not meet Chapter 275. Wetlands and Shoreline Article ll. Permits § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: Prohibited locations and activities. fal No new docks will be permitted over vegetated wetlands or such that it causes habitat fragmentation of vegetated wetlands in the fo/lowin_g areas: Downs Creek, Hallocks Bay, Hashamomuck Creek and Pond, Long Creek (branch of Mattituck Creek, East of Grand Avenue bridge), Pipe's Cove Creek and West Creek. [Amended 12-18-2007 by L.L. No. 23-20071 (7) Critical environmental areas. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this.section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of nondisturbance buffer, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 16, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure(s) as applied for are expressly prohibited by Town Code Chapter 275-11(C)(2)(b)(3)(a) No new docks will be permitted over vegetated wetlands or such that it causes habitat fragmentation of vegetated wetlands in the following areas: Downs Creek, Hallocks Bay, Hashamomuck Creek and Pond, Long Creek (branch of Mattituck Creek, east of Grand Avenue bridge), Pipe's Cove Creek and West Creek, and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, WHEREAS, the Board has determined that the dock is proposed to be constructed new, and is in a prohibited area under Town Code; and BE IT FURTHER RESOLVED that the Board of Trustees DENIES the application of CHARLES & SHERRY SOLON to construct a 4'x54' fixed catwalk with steps down to a 4' wide by 16' long fixed dock situated in a "T" configuration with the use of Thru-Flow decking for the entire structure; and as depicted on the site plan prepared by Jeffrey Patanjo, dated April 4, 2023.
