Pursuant to the rovisions of Chapter 275 of the Town Code of the Town of Southold and in r-
accordance with the Resolution of the Board of Trustees adopted at the meeting held on June 14, 2023, and in
consideration of application fee in the sum of$1250.00 paid by Credit Shelter Trust. and subject to the Terms
and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
_g Wetland Permit to remove portions of and substantially reconstruct existing deteriorated bulkhead;
reconstruct 9316" linear feet of bulkheading in-place using Shore-Guard SG vinyl sheathing,6'x6"
treated wood whalers/stringers at two levels,8" diameter by 6' long laid log dead-men reinforced with(2
each)811x6l backing piles, new 1/411 galvanized steel tie rods with connecting hardware,and the 20 existing
8"diameter by 20' treated wood pilings at±61 on-center to remain; replace 518 sq.ft.of decking with new ti
2"x6"x5' long and 6' long Douglas fir decking using galvanized steel connectors; the existing 5'1"x26'3"
section of fixed dock and decking off of bulkhead to remain; dredge approximately 720 sq.ft. of basin
area to a depth of 3' below mean low water and add dredged spoil as backfill for reconstructed
bulkhead; filling limited to replacement of eroded backfill behind existing bulkhead, using dredged

TERMS AND CONDITIONS
The Permittee, Credit Shelter Trust, 155 Fisherman's Beach Road, Cutchogue, New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Samuels:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 14, 2023 regarding the above matter:
WHEREAS, Samuels & Steelman Architects on behalf of CREDIT SHELTER TRUST
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated April 21, 2023, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 14, 2023, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposedwill not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of CREDIT SHELTER
TRUST to remove portions of and substantially reconstruct existing deteriorated
bulkhead; reconstruct 93'6" linear feet of bulkheading in-place using Shore-Guard SG
vinyl sheathing, 6'x6" treated wood whalers/stringers at two levels, 8" diameter by 6'
long laid log dead-men reinforced with (2 each) 8"x6' backing piles, new 3/" galvanized
steel tie rods with connecting hardware, and the 20 existing 8" diameter by 20' treated
wood pilings at ±6' on-center to remain; replace 518 sq.ft. of decking with new 2'x6"x5'
long and 6' long Douglas fir decking using galvanized steel connectors; the existing
5'1"x26'3" section of fixed dock and decking off of bulkhead to remain; dredge
approximately 720 sq.ft. of basin area to a depth of 3' below mean low water and add
dredged spoil as backfill for reconstructed bulkhead; filling limited to replacement of
eroded backfill behind existing bulkhead, using dredged material and/or clean sand;
establish and perpetually maintain an approximately 265 sq.ft. non-turf buffer area
topped with 3/"-1" beach stones between the west property line and decking, and a 10'
wide, approximately 200sq.ft. non-turf buffer area topped with 3/"-1" beach stones
landward of decking; and as depicted on the site plan prepared by Samuels & Steelman
Architects dated April 4, 2023, and stamped approved on June 14, 2023.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Tom Samuels on behalf of CREDIT SHELTER TRUST requests a Wetland Permit to remove portions of and
substantially reconstruct existing deteriorated bulkhead; reconstruct 93'6" linear feet of bulkheading in-place
using Shore-Guard SG vinyl sheathing, 6'x6" treated wood whalers/stringers at two levels, 8" diameter by 6'
long laid log dead-men reinforced with (2 each) 8"x6' backing piles, new Y4" galvanized steel tie rods with
connecting hardware, and the 20 existing 8" diameter by 20' treated wood pilings at±6' on-center to remain;
replace 518 sq.ft. of decking with new 2"x6"x5' long and 6' long Douglas fir decking using galvanized steel
connectors; the existing 5'1"x26'3" section of fixed dock and decking off of bulkhead to remain; dredge
approximately 720 sq.ft. of basin area to a depth of 3' below mean low water and add dredged spoil as backfill
for reconstructed bulkhead; filling limited to replacement of eroded backfill behind existing bulkhead, using
dredged material and/or clean sand; establish and perpetually maintain an approximately 265 sq.ft. non-turf
buffer area topped with 3/"-1" beach stones between the west property line and decking, and a 10'wide,
approximately 200sq.ft. non-turf buffer area topped with 3/"-1" beach stones landward of decking. Located:

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Robert M. Scalza and Patricia Scalza (hereinafter the "Scalza's") are the
owners of the premises, located at 60 Fisherman's Beach Rd., Cutchogue,
NY, Town of Southold, (SCTM # 1000 111-1-8.2) (hereinafter the "Scalza
Property"). Anita Samuels, resides at 120 Fisherman's Beach Rd.,
Cutchogue, NY, Town of Southold, owner of the boat slip of Lot 32 on
Fisherman's Beach Road Cutchogue N.Y. Town of Southold, (1000-111-01-
8.1) (hereinafter the "Samuels Property").
The Samuels Property is immediately adjacent to the Scalza Property. The
properties are divided by a section of bulkhead belonging to Anita Samuels
boat slip.
Due to the state of disrepair of the bulkhead and dock on the Samuels
property, Anita Samuels and/or her son, Thomas Samuels, has retained a
licensed contractor to remove the existing bulkhead and dock and replace
all sheathing, backfill and decking.
The Scalza's hereby grant permission to the unnamed licensed contractor
retained by the Samuels to enter the Scalza Property, if necessary, in order
to perform the aforementioned work, on the condition that said licensed
contractor repair any and all conditions created on the Scalza Property by
virtue of the aforementioned work, at no cost to the Scalza's, and to their
full and complete satisfaction.

Remove portions and substantially reconstruct existing deteriorated bulkhead, at boat basin
for two watercraft, first constructed in early 1960's. Existing construction includes treated
wood pilings, whalers/stringers and T&G sheathing, connected to dead men, with treated
wood decking surrounding. tither than the pilings, structural elements have deteriorated with
age, and sheathing is leaking back fill into the basin.
Per earlier Southold Trustees permit#9760, and NYSDEC permit, #1-4738-02261, adjoining
dock and steps have been repaired. Permitted decking was not replaced.
Reconstruct 96 linear feet bulkhead with the following:
to remain (20) 8" diameter x 20' treated wood piling at 6' +/- on center
new 6x6" treated wood whalers/stringers, at two levels
new 18" wide x 12' long ShoreGuard SG vinyl sheathing
new 8" diameter x 6' long laid log dead men reinforced with (2 each) 8"x6' backing piles
new 314" galvanized steel be rods, with connecting hardware
Replace 518 sf decking w/new 2"Wx5' long douglas fir decking
all connectors shall be galvanized steel.
Dredge basin to recover backfill lost in reconstruction, maximum 26 yards.

reconstruct existing deteriorated bulkhead; reconstruct 93'6" linear feet of bulkheading in-place using
Shore-Guard SG vinyl sheathing, 6'x6" treated wood whalers/stringers at two levels, 8" diameter by 6' long
laid log dead-men reinforced with (2 each) 8"x6' backing piles, new %" galvanized steel tie rods with
connecting hardware, and the 20 existing 8" diameter by 20' treated wood pilings at ±6' on-center to
remain; replace 518 sq.ft. of decking with new 2"x6"x5' long and 6' long Douglas fir decking using galvanized
steel connectors; the existing 5'1"x26'3" section of fixed dock and decking off of bulkhead to remain;
dredge approximately 720 sq.ft. of basin area to a depth of 3' below mean low water and add dredged spoil
as backfill for reconstructed bulkhead; filling limited to replacement of eroded backfill behind existing
bulkhead, using dredged material and/or clean sand; establish and perpetually maintain an approximately
265 sq.ft. non-turf buffer area topped with %" — 1" beach stones between the west property line and
decking, and a 10' wide, approximately 200sq.ft. non-turf buffer area topped with %" — 1" beach stones
