ADDITIONAL INFORMATION: The applicant's representative indicated during the public hearing that the accessory garage is shown on a survey dated 10/25/1971 and was rebuilt in the same footprint approximately 15 to 20 years ago. The Zoning Board of Appeals held a public hearing on this application on April 1,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other-evidence;the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1: Town Law §267-bQ)(b)(1). Grant of the variances for the accessory garage will not produce an:undesirable . change in the character of the neighborhood or a detriment to nearby properties. The neighborhood.is an older neighborhood that consists of single-family homes;a town park, and agricultural properties. The garage is set back. behind the dwelling and is approximately 160 feetfrom the street. The garage is more thancode required 20.feet from the North Property line..-The neighbor to the South is a&acre agricultural property consisting ofnursery stock. The Southernly neighbor's home is set back from'the property line and screened by plantings so that it is not affected by the.garage. The accessory shed is 8.3 x:12.3 feet, is not high and is setback 11.6 feet from a side yard property- line ropertyline that is adjacent to a public park. It is screened from view by a solid stockade fence along the side property--line which prevents it from being seenby those using the park,Moreover, it has no visible impact on-the street since it is setback behind the house at approximately 230 feet from Peconic Lane. 2. Town Law4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. .The.applicant could demolish the garage and shed and build new'ones in.a code conforming location. However,that would require a financial.investment that.would appeai'to be unnecessary, given:the lack of adverse impact by either of these two as:built structures. Additionally; since the. . subject parcel is aaong narrow lot,. order to locate both structures with conforming side yard setbacks;they would have to be centered.on.the.property where they would be inconvenient to use in relation to the existing.driveway,and where they would visually and physically,interrupt the applicant's use of their rear yard recreational space. 3. Town Law' .§267 b(3)(b)(3). The variance granted herein for the garage is, mathematically substantial, representing 78%.relief from the code. A variance for the shed is substantial representing.58%relief from the code. However,there are survey's showing that the.garage was constructed prior to 1971 and the shed has been in place for about 10 years. At,the time both accessory structures were built,the zoning code required different setbacks than are required today,and.neither accessory structure.has had any adverse impact on adjacent properties. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential. community will have an-adverse.impact on the. physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been.self-created. The applicant purchased.the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law§267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage and shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried,to GRANT the variances as applied for and shown on the survey prepared by John T. A final inspection was completed by the building inspector on March 3, 2022. The inspector requested that the architect certify that the foundation and strapping meets NYS code and requested an electrical certificate. These actions have not been completed as of August 3, 2022, when the second extension expired. On May 11, 2022, I submitted a letter to the building department certifying that the foundation and strapping meets NYS Code. This letter was likely misplaced, as I received an email from Donna Westermann on December 28, 2022 requesting the letter. I emailed her a copy of the certification letter that was dropped off on May 11, 2022 in which she indicated would be put in her records. I have also reached out to the client, Kevin Meyers, who will be acquiring the electrical certificate that is required, notifying him that this needs to be done promptly. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Lase§-267-1i(30l(t1. Grant of the variances for the accessory garage will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood that consists of single-family homes,a town park,and agricultural properties. The garage is set back behind the dwelling and is approximately 160 feet from the street. The garage is more than code required 20 feet from the North Property line. The neighbor to the South is a 6-acre agricultural property consisting of nursery stock. The Southernly neighbor's home is set back from the property line and screened by plantings so that it is not affected by the garage. The accessory shed is 8.3 x.12.3 feet, is not high and is setback 11.6 feet from a side yard property line that is adjacent to a public park.It is screened from view by a solid stockade fence along the side property line which prevents it from being seen by those using the park.Moreover,it has no visible impact on the street since it is setback behind the house at approximately 230 feet from Peconic Lane. 2, Toivn_Law" 267-b(31(b)(2)._ The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue, other than an area variance. The applicant could demolish the garage and shed and build new ones in a code conforming location. However,that would require a financial investment that would appear to be unnecessary, given the lack of adverse impact by either of these two as built structures. Additionally,since the subject parcel is a long narrow lot,in order to locate both structures with conforming side yard setbacks,they would have to be centered on the property where they would be inconvenient to use in relation to the existing driveway,and where they would visually and physically interrupt the applicant's use of their rear yard recreational space. 3. Tbwn.law::&26Z-6(3kb)(3). The variance granted herein for the garage is mathematically substantial, representing 78%relief from the code. A variance for the shed is substantial representing 58%relief from the code.. However,there are survey's showing that the garage was constructed prior to 1971 and the shed has been in place for about 10 years. At the time both accessory structures were built,the zoning code required different setbacks than are required today,and neither accessory structure has had any adverse impact on adjacent properties. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
