ADDITIONAL INFORMATION: Testimony was given by the applicant,and the applicants agent at two public hearings as to.the nature of the existing structures on.the site, and the current uses. Town building inspectors have also reported on the current buildings and uses on the site during multiple visits. The accessory structure has a Certificate of Occupancy of record dated June 7, 1993 under Certificate of Occupancy#Z-22377 confirming that the accessory currently exists. The applicant was asked to remove the full stairs located in the garage portion of the accessory structure. The design professional redesigned the floor plan (SD-2)to show an attic hatch. The applicant also consented to replacing the windows in the second-floor dormer,facing neighbors to the west,with opaque,non-transparent material, in order to allow for neighbor's privacy. On May 26, 2021, the Office of the Board of Appeals searched the records of the Building Department and confirmed that the basement passed inspection but additional approvals for the electric,rough plumbing and insulation were still required.The Town's Building Inspector also verbally corroborated these facts. 7. This conversion shall be subject to a building permit,inspection by the Building Inspector,and annual renewal of the:Certificate of Occupancy.. The property is improved with a single- family two-story residence and a two-story accessory structure(titled"foundation location") as shown on The survey prepared by Kenneth M. Woychuk,L.S. last revised December 4, 2020. ADDITIONAL INFORMATION: Testimony was given by the applicant, and the applicants agent at two public hearings as to the nature of the existing structures on the site;and the current uses. Town building inspectors have also reported on the current buildings and uses on the site during multiple visits. The accessory structure has a Certificate of Occupancy of record dated June 7, 1993 under Certificate of Occupancy#Z-22377 confirming that the accessory currently exists. The design professional redesigned the floor plan(SD-2)to show an attic hatch. The applicant also consented to replacing the windows in the second-floor dormer, facing neighbors to the west (CORRECTED TO READ facing neighbors to the south);with opaque, non-transparent material, in order to allow for neighbor's privacy. As part of the application the applicant submitted copies of the following documents relative to the property and-their full-time residency status: 1. Southold Town Real Estate Tax Bill 2. Voter Registrations CORRECTED DETERMINATION The ZBA received correspondence from the applicant's attorney dated January 10,2022 requesting that the Board review, and correct the directional orientation on the approved plans and amend Condition No.4 of the above referenced Zoning Board of Appeals' determination which states that; "to protect the privacy of the adjacent property owner to the north,the applicant must remove the glass windows in the rear dormer of fhe second-floor storage room". At the Special Meeting of the Board of Appeals on January 20,2022-,the Board discussed the request and agreed to correct the directional information (north,south, east,west)referenced to in the determination,based on the surveyor's north arrow which, as the attorney explained, is correct and not the same as the north arrow on the architect's plans. Condition#4 will now be corrected to read, "to protect the privacy of the adjacent property owner to the south...." In the attorney's letter the Board was also asked to accept the use of opaque film applied to the glass panels on the subject windows in the dormer facing south instead of the required removal. The Board does not consider that proposal to be a permanent alternative and decided that the original condition of approval to remove the windows in the dormer still stands.The Board further requested that the attorney ask the architect to submit to the ZBA office two full sets of the originally approved architecturalplans with the corrected north arrow and corrected labels for north,south,east and west on the elevations, signed and stamped by the architect. FINDINGS OF FACT: r The Zoning Board of Appeals held a public hearing on this application on April 1, 2021 and May 6, 2021, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant. In considering this application,the Board has reviewed the code requirements set forth pursuant to Article Page 3,January 20,2022 #7565SE,Diakovasilis- CORRECTED SCTM No. 1000-106-7-6 III, Section 280-13(8)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment unit will be located on the first floor of the accessory garage with an area of 692 square feet of livable floor area in conformity as proposed,as described and shown on the floor plan prepared by Anthony Portillo,Architect,dated May 20,2021. 2. The dwelling unit complies with the definition of same in §280-4 of the code and complies with the code requirements as defined in Section 280-13(B)(13) of the Zoning Code. The owner confirms that the accessory apartment shall not contain less than 450 sq. feet nor will the accessory apartment exceed 750 square feet of livable floor area, all on one floor with only one full bathroom. 3. The applicant herein, owns and resides at the property and will continue to occupy the single-family dwelling as a principal residence in conformance with the code requirements as set forth in Article III, Section 280-13(B)(13)0, 1-4),and as documented by voter's registration card,Income tax return and utility bills. 4. The occupants of the accessory apartment will be a family member,and the occupancy shall not exceed the number of persons permitted,in conformance with the code requirements as set forth in Article III, Section 280-13(B)(13)0, 1-4).The tenant is the applicant's daughter as per NYS Driver's License provided. 5. The owners' plans comply with the on-site parking requirements and provide for a total of three (3) parking spaces, two for the principal use and one for the Accessory Apartment, utilizing the existing driveway areas, as shown on the site plan by Anthony Portillo,Architect,dated May 20,2021. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. The applicant's representative informed the ZBA Office in a letter,dated June 1, 2021, that an inspection by the Building Department of the "as built basement" in the principal dwelling was conducted, as requested by the Board of Appeals, to confirm that no other accessory apartment was present on the subject property. On May 26, 2021, the Office of the Board of Appeals searched the records of the Building Department and confirmed that the basement passed inspection but additional approvals for the electric, rough plumbing and insulation were still required. The Town's Building Inspector also verbally corroborated these facts. 7. This conversion shall be subject to a building permit,inspection by the Building Inspector,and annual renewal of the Certificate of Occupancy. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the Zoning District in which is located,adjacent use districts,and nearby adjacent residential uses.
