The fence at issue is 2-sided. It is attached to the bulkhead located on the southerly side of the property. The dimensions are drawn in pencil on the enclosed survey and are as follows: exbting: 90' x 18' 6" and new: I05'x 22'. In order to properly position the fence on the property line ,we contracted Young & Young surveyors of Riverhead to locate and mark the monuments on the property, including the right of way area. The stakes are still in place. The fence was built immediately after we took possession of the property and prior to obtaining a permit in order to protect our two small children from falling. No. 4606-THOMAS AND MOIRA MASTRO 1000-126-11-3.1 STREET & LOCALITY: 6760 Great Peconic Bay Boulevard, Laurel DATE OF PUBLIC HEARING: October 15~ 1998 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is located along the south side of Peconic Bay Boulevard and along the easterly side of a private right-of-way, Laurel. The subject premises also fronts along the Great Peconic Bay and has a timber bulkhead north of the ordinary highwater mark and timber jetties. The total size of the property is 36,000+- sq ft., with 108.86 ft. along Gl. Peconic Bay Boulevard and 331+- ft. along the westerly property line. BASIS OF APPLICATION= Building Inspector's July 29, 1998 Notice of Disapproval under Article XXIII, Section 100-239.4B for the proposed location of a fence at bulkhead. AREA VARIANCE RELIEF REQUESTED: Applicant is requesting a variance to locate a fence at bulkhead for safety reasons. REASONS FOR BOARD ACTIONf DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because fence along bulkhead is temporary for protection of applicants' young children. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because fencing is adjacent to and along applicants' bulkhead, which lies with the ultimate jurisdiction of this board and this zoning ordinance. No. 4606 Re: 1000-126-11-3.1 (Masl~o) ZBA October 27, 1998 Decision (3) There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because applicant will remove fence within a ten-year period of time. (4) The alleged difficulty has been selFcreated. In considering this application, the Board deems this action to be the minimum necessary and adequate to preserve and protect the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion Horning, it was RESOLVED, to GRANT the variance, CONDITIONS: 1. by Chairman Goehringer, seconded by Member as applied for SUBJECT TO THE FOLLOWING The fence may remain for a period of time ending on the earlier of 10/28/2008 or the date of transfer of title; 2.
