No. 4520 - STANLEY PAWLOWSKI PARCEL 1000-102-7-4 STREET & LOCALITY: . 1785 Crown Land Lane, Cutchogue DATE OF PUBLIC HEARING: October 23, 1997 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: This property is located in an R-40 Low-Density Residential Zone District, being a corner lot situate along Crown Land Lane and Spur Road, Cutchogue, NY. This lot contains a total area of 41,580 sq. ft. and is improved with a single-family, two-story frame dwelling with attached garage, and accessory tennis court "as built" without fence all as more particularly shown on a map dated March 17, 1988 and updated by applicant to show the tennis court. BASIS OF APPEAL: Building Inspector's Actions of Disapproval: a) dated August 28, 1997 which reads as follows: "...under Article IIIA, Section 100-30A-3 of the Bulk and Parking Schedule in the R-40 Zone, the tennis court 58' by 115' or 6,670 sq. ft. of lot coverage combined with the existing 1,982 square feet for a total of 8,652 sq. ft. will exceed the allowable coverage of 8,326 sq=. ft. or 20% (lot size 257' x 162' = 41,634+- x 20% = 8,326) by 326 sq. ft. relating to less than 21% lot coverage. Fence c-nnot exceed 6-112 ft. in the required rear yard. Action required by Zoning Board of Appeals... ," and b) dated June 26, 1997 which states "...under Article IIIA, Section 100-30A.4 of the R-40 Zone, accessory structures on lots containing 40,000 sq. ft. and less than 79,999 sq. ft. shall have said accessories set back no less than 10 feet from any lot line. Existing lot contains 41,47-+ sq. ft. Survey drawn on back of application shows setbacks of 4 ft. and 5 ft. Action required by Zoning Board of Appeals .... " AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate portion of tennis court partly in side yard with reduced setbacks at 4 ft. and 5 ft. from the side and rear property lines and at approximately one percent over the maximum 20% allowable lot coverage for total of all buildings and structures. However, applicant has a corner lot which causes two front yard areas and a restricted area fo~ a rear yard. (2) The benefit ~ought by the applicant csnnot be achieved by some method, feasi, ble fo.r applicant to pursue, other than an area variance because applicant I has a restricted rear yard area caused by a corner lot and two front yard designations. (3) The requested area variance is not substantial because applicant exceeds lot coverage by approximately 326 square feet or less than 17 percent of tothl lot coverage ff permitted to maintain said tennis court. ~ (4) The propose~ variance will not have an adverse effect or impact on the physical ~r environmental conditions in the neighborhood or district because ]fence height is practical and fencing, if placed, will be at a height allowed by the Zoning Code to keep balls within the court area. i Applicant's property and existing tennlg court are contiguous to a 22.5+- acrs parcel. (5) The situatioa has not been self-created. (6) This action ks the minimum that the Board deems necessary and adequate and at ~he same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community.
