Upon comparing the newest survey done by Ralph O. Heil, LLS last revised September 20, 2022 with the 1995 survey done by Anthony W. Lewandowski, LLS, we have found that there is a significant change in the location of all contour lines. Please see the attached transposed contour lines from 1995 survey to the 2022 survey. It appears that there has been grading which nullifies this area as a natural, gradual slope. Hence, we are maintaining our original jurisdictional determination of 1995. The portion of the property which is located landward of the 10 foot (MSL) elevation contour as shown on the survey prepared by Anthony W. Lewandowski, LLS, last revised July 19, 1995 is beyond the jurisdiction of Article 25 Please note, although part of the pool and patio pavers are seaward of the 1995 10' contour line, they adhere to our tidal wetland adjacent area development restrictions, 851.6(a)(1)and (4) (greater than 75' from the tidal wetland boundary and the lot coverage of irrwpervious structures is less than 20%) and would not have required a permit. No-Jurisdiction letters remain valid indefinitely unless substantial changes in site conditions have occurred. In addition, these determinations are issued for the property and therefore it is to new owners. The original permit and site plan/survey with er them not necessary to transfer 9 ry the jurisdictional determination of 1995 for this site should be saved for your client's future reference.
