Van Eiff For a Variance to New York State Uniform Fire Prevention and Building Code STATE OF NEW YOrK DEPARTMENT OF STATE ALBANY, NY 12231-0001 DECISION PETITION NO. 1999-0360 Upon the application of William W. Van Eiff, filed pursuant to 19 NYCRR 450 on March 4, 1999, and upon all other papers in this matter, the Department makes the following determination: NATURE OF THE GRIEVANCE AND RELIEF SOUGHT The petition pertains to the legalization of an existing building of A1 (one-family dwelling) occupancy, one story in height, of type 5 construction, approximately 900 square feet in gross area, located at 379 Riley Avenue, Mattituck, Town of Southold, County of Suffolk, State of New York. The petitioner seeking relief from: 9 NYCRR 711.1(a)(1), which requires that habitable spaces, except kitchens shall have a minimum floor area of 80 square feet with a minimum horizontal dimension of 7 feet. 9 NYORR 711.1(a)(2), which requires that habitable space shall have a mimmum height of 7 feet 6 inches, except that for habitable space under a sloping roof the minimum height in at least 50 percent of the floor area shall be 7 feet 6 inches and the area where the height is less than 5 feet shall not be considered in computing required floor area. [The petitioner requests to legalize a bedroom addition under a sloping roof, approximately 70 square feet in area, (9 feet 7 inches X 7 feet 4 inches) with an average ceiling height of 7 feet 3 inches.] FINDINGS OF FACT 1. The space in question is a bedroom (approximately 70 square feet in area) added to the existing building by converting a screened porch to habitable/non-habitable spaces. The bedroom does not comply with all the provisions of 9 NYCRR 711.1(a). 2. The bedroom is under a sloping roof with a ceiling height of 7 feet 9 inches near the existing house and 6 feet 9 inches away from the house, which afforded an average ceiling height of 7 feet 3 inches, which is 3% printed on recycled paper Petition NO. 1999-0360 Page 2 smaller than the code required ceiling height and is negligible. 3. Even though, the variation in floor area is 12 percent from the Code required 80 square feet, it has a window which is opened to the legal open space and the ceiling height under the sloping roof which varies from 7 feet 9 inches to 6 feet 9 inches may not adversely affect the psychological well-being of the occupants. 4. The petitioner proposes to install operable windows in the bedroom for ~mergency egress, natural light and ventilation in accordance with the Uniform Fire Prevention and Building Code. 5. The petitioner proposes to install hardwired, smoke-detecting alarm devices located adjacent to the sleeping room (inside and outside), which will be interconnected to the smoke-detecting alarm devices in other sleeping rooms. This will provide early warning to the occupants of the building, in the event of fire related emergencies. 6. The Local Code Official for the Town of Southold has been consulted in this matter and does not object to the granting of a routine variance under 19 NYCRR 450.6. CONCLUSION OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would not substantially affect the codes provisions for health, safety and welfare. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.1(a)(1), to permit the bedroom with dimensions of 7 feet 9 inches X 7 feet 4 inches and 9 NYCRR 711.1 (a)(2), to permit the existing bedroom ceiling height of 7 feet 3 inches under the sloping roof, be and is here by PROPOSED TO BE GRANTED with the following conditions: 1. That the building be provided with a hardwired heat-or smoke-detecting alarm devices, installed in conformity with 9 NYCRR 1060.10. The devices shall be provided outside each separate sleeping area in the immediate vicinity of the bedrooms, in each sleeping space and on each floor level as required per 9 NYCRR 721,1. Such devices shall be so arranged that operation of any heat- or smoke-detecting device shall cause all devices to sound an alarm. 2. That the windows in the habitable space which are to be used for emergency egress shall have a minimum operable area of four square feet with minimum dimension of eighteen inches and the opening shall not be more than three feet six inches above the finished floor.
