SOUTHOLD TOWN BOARD OF APPEALS
August 25, 1960
A regular meeting of the Southold Town Board of Appeals
was held 7:30 P,M., Thursday, August 25, 1960, at the Town
Clerk Office~. Main Road~ Southold~. New York.
There were present: Messrs. Robert W. Gillispie, Jr.,
Chairman~ Robert Bergen, and Herbert Roseriberg. Mr. Grigonis
appeared after th~ public hearing.
Absent: Mr. Serge Doyen, Jr.
Also present: Mr. Howard M, Terry, Building Inspector.
PUBLIC HEARING: 7:30 P.M. , Appeal No. 3~4 - Upon appli-
cation of Marjorie S. Wickham, Bungalow Lane,: Mattituck~ New
York, for a variance in accordance with the Zoning Ordinances_
Article III~. Section 303~ for permissinn to divide property into
two single lots. Location of property: north side Center Street,
.Mattituck, New York,. bounded north by other land of Marjorie S.
Wickham~ east by Nelle P. Bender and another~ south by Center
Street, and west by Russell D. Tuthill. Fee paid $15.00.

The Chairman opened the hearing by reading notice of dis-
approval issued by the building inspector, application for a
variance~ legal notice of hearing and affidavit attesting to
its publication in the.official newspaper.
THE CHAIRMAN: Mrs. Wickham~. if you will agree to amend this
application to include Article X~ Section 1000A it will be complete.
Article X, Section 1000Apertains to a lot being sold, divided
or set off in such a manner that either the portion sold~ divided
or set off, or the portion remaining shall have an area and/or
open spaces of less than that prescribed by the Ordinance.

THE CHALRMAN: How long have you owned this property?
MRS~ WICFJ~AM: For over 20 years.
THE CHAIRMAN: I believe you said before the hearing that
you have sold one part of this property and you have a prospect
to sell the .other part as long as they can build a house on it?
MP~. WICRHAM: That is right.
THE CHAIRMAN: Is there anyone eise present who wishes to
speak for this application?

against this application?

Resolution was offered bY Mr. Bergen~ seconded by Mr.
RoSenberg~ and carried~ WHEREAS application of Marjorie Wickham
having been considered at Public Hearing No, 304 on August 25,
1960, and the Board finding that strict application of the
ordinance would produce undue hardship because the lot to be

set off is only connected by a narrow neck to the northerly
lot owned by Marjorie S. Wickham. The Situation is unique
and would not be shared by all properties alike in the immediate
Vicinity of this .prOPerty because this is the oddest shaped lot
in the area. The public convenience and welfare and justice will
be served and the legally established or permitted use of neighbor-
hood property and adjacent use districts would not be substantially
or permanently injured and the spirit of the Ordinance would be
observed because this is a residential area of both summer and
year-around residences and the use of this lot will be residential
in keeping with the area, therefore be it.
RESOLVED that permission be granted for the use of the follow-

PARCEL I:- Beginning at a point on the southeasterly corner
of property of Marjorie S. Wickham, said point being on the northerly
side of Center Street, and running westerly 68 feet along Center
Street to land of R. D. Tuthill~ thence running northerly 130 feet
along land of R. D- Tuthill to o~ther land of Marjorie S, Wickhamy
thence running easterly 100 feet along land of MarJorie S. Wickham
and T- J. Fisher to land of N, P. Bender and another~ thence running
southerly 88.23 feet along land of N. P. Bender and another to the
northerly line of Center Street and point of beginning.

Section "B", mapped by D. R~ ¥oung~ July 14 1926 and traced by
Otto W. Van Tuyl & Son on May 27, 1953.
Vote of the Board~ Ayes:-- Mr. Gillispie, Mr. Bergen, and
Mr. Rosenberg.
Mr. James Lo Turk~. Southold~ spoke to ~Board of Appeals
informally relative to converting one wing oz/nouse into .an
apartment. At present he does not use this wing and if it is not
repaired in the near future it will have to be torn down. Mr.
Turk was advised to file for a variance and it would be considered
at a public hearing,
Mr. William Smith, Southold, New ¥ork~ appeared before the
Board of Appeals to ask for a further recess until September 1st
for the Flanagan variance hearing. Mr, Smithstated that he had
again talked with the Flanagan~s and they do not want the garage

located on the west. side of 'the property. He was able to secure
letters from Mr. Roger Berkery, Dr. WilliamP. Riley and Arthur
A. O~Neill stating that they would not object to the Flanagan
garage being placed within the area applied for in the appli-
cation. The letters were made a part of the file and Mr, Smith
was asked to return on the 1st of September at which time a
decision would be made on this variance application.
Mr. Helmut Hass, Southold~ New York, proprietor of the
Southold Town Beach Motel, appeared before the Board of Appeals
requesting permissinn to replace his sign on the property of
Richard E.. Schiefer~ east side Bowery Lane and south side North
Road, Southold, New York~ with a square sign size 3 ft. by 4 ft.
The overall dimensions of his present sign is 3 ft. by 4 ft. Mr.
Hass was advised 'that since he was given permission in the action
of the Board dated September 9, 1959 for a 3 ft. by 4 ft. sign to
be located on the property of Richard E. Schiefer he may replace
it with a square sign 3 ft. by 4
Mr. Hass also stated that he would like to apply for a
sign on Route 25 directing people to his Southold Town Beach
Motel which is located on Route 27A. He felt a sign on the
southerly end of Albertson Lane would be sufficient. The Board
advised Mr. Hass to file for a special exception,
The minutes of the meeting of August 18~ 1960~ on motion
of Mr. Grigonis,i seconded by Mr. Bergen, and carried, were
approved as submitted.

Agnes Church~ Main S~reet,. Greenport~ New York, for a special
exception in accordance with the Zoning OrdinanCe,. Article IV,
Section 408~. for permission to erect and maintain a sign on the
property of John Rempe & wf~. north side Route 25, east of
Albertson Lane, Greenport, New York,
Vote of the Board~ Ayes:- Mr. Gillispie~ Mr. Bergen, Mr.
Rosenberg~ and Mr. Grigonis.

September 8~ 1960, Town Clerk Office, Main Road, Southold~ New
York, as time and place for hearing upon application of St.
Agnes Church, Main Street, Greenport,'New York~ for a special
exception in accordance with the Zoning Ordinance, Article III,
Section 300~ Subsection 2, for permission to erect and maintain
a sign on the property of Leo Sledjeski~ north side Route 27A,
opposite Queens Lane, Greenport~ New York~
Vote of the Board: Ayes:- Mr. Gillispie,~ Mr. Bergen, Mr.
Rosenberg, and Mr. Grigonis.
On motion of Mr, Bergen, seconded by Mr. Rosenberg, and
carried, the Board of Appeals set 7:45 P.M. (F~D.S~T.), Thursday,
September 8~. 1960, Town Clezk Office, Main Road~ Southold, New
york,., as time and place for hearing upon application of James
and Dorothy Turk~. North Road~ Southold,'New York, for a variance
in accordance with the Zoning Ordinance~ Article III~ Section 300
Subsection 1, for permission to use existing dwelling as a two
family residence. Location of property: south side Route 27A,
Southold~ New York, bounded north by North Road, east by Leon
Sawicki~ South by Leon Sawicki~ and west by Leon Sawicki.
Vote of the Board: Ayes:- Mr.. Gillispie, Mr. Bergen, Mr.
Rosenberg, and Mr. Grlgonls.
Resolution was offered by Mr. Rosenberg, seconded by Mr.
Grigonis, and carried~ setting 8:00 P.M, (E.D.S.T.)~ Thursday~

1000A, for permission to reduce frontage and use as a single lot
property located on the west sideWickham Avenue~ Mattituck, New
York,. bounded north by Stanley Zimnoski, west by other land of
H, R. Reeve & ors~ and east by Wickham Avenue~ south by other
land of H. R. Reeve & ors.
