APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of .property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
?pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

RECENT CONVERSATIONS WITH RICHARD SMITH @ STATE CODES DIVISION
STATED THAT THE ABOVE REFERENCED CONSTRUCTION COULD BE APPROVED
IF THE DESIGN PROFESSIONAL CERTIFIES THE STRUCTURAL SYSTEM. THE
CERTIFICATION SHOULD ALSO INCLUDE COMPLIANCE WITH THE STATE
BUILDING & ENERGY CONSERVATION CODE.
THE ENGINEER SHOULD SPECIFICALLY ADDRESS THE "AS-BUILT" FOUNDATION
SYSTEM. HE SHOULD ALSO CERTIFY THAT THIS TYPE OF CONSTRUCTION
WOULD PROVIDE ADEQUATE STRUCTURAL STABILITY TO SUPPORT THE

Dear Mr. Wells,
Please be advised that the structure applied for cannot receive a permit because
it does not meet the minimum standards set by the New York State Fire
Prevention and Building Code. Specifically, the foundation is required to have a
footing that is below the frost line ( min 36 inches ) and must meet the standards
to support the structure.
We cannot issue a permit for any structure that does not meet State Code. Your
options at this point are;
1. Construct a proper foundation.
2. Apply for a variance from the State.
3. Remove the structure.

Fondation adequacy of sunporch
Pine Neck Road
A review of the foundation of the sun porch at the northeast
corner of the residence of Herbert W. Wells at 3445 Pine
Neck Road, Southold, New York indicates the following:
The porch is built on an existing corcrete patio extending
five feet or more beyond the limits of the sun porch exterior
walls. The poured concrete foundati'on walls of the sun room
are more that twelve inches high above the existing patio.
The light construction of this one story structure will be
easily supported by this foundation. The extension of the
existing patio beyond the exterior walls of th e porch allows
rain water to be dispersed far enough from the building so
moisture will not be a factor due the porosity of the adjacent
soils. This structure is thus built to withstand the effects
freezing.
