York 11944, as Executor of the Last will and Testament of Alice
Kontokosta, and as successor Trustee of the Alice Kontokosta 2009
Revocable Trust, Alice Kontokosta having died a resident of the
County of Suffolk and State of New York, on January 29, 2017, and
as Executor of the Last will and Testament of Caliope Kontokosta, and
as successor Trustee of the Caliope Kontokosta 2009 Revocable Trust,
Caliope Kontokosta having died a resident of the County of Suffolk
and State of New York on December 3, 2019,
party of the first part, and,
BOOST CONSTRUCTION CORP. , a New York corporation with an address of
7206 Juniper Valley Road, Middle Village, New York 11379
party of the second part,
WITNESSETH, that whereas letters testamentary were issued to the Executor of the
Estate of Alice Kontokosta by the Surrogate's Court, Suffolk County, New York, on March
16, 2017, File No. 2017-923, and that letters testamentary were issued to the Executor
of the Estate of Caliope Kontokosta by the Surrogate's Court, Suffolk County, New York,
on January 10, 2020, File No. 2019-4988, and by virtue of the power and authority given
in and by said last wills and testaments, and/or by Article 11 of the Estates, Powers
and Trusts Law, and in Consideration of FOUR HUNDRED FIFTY and 00/100 ($450,000.00)
DOLLARS, paid by the party of the second part, does hereby grant and release unto the
party of the second part, the distributees or successors and assigns of the party of the
second part forever, in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being in the Town of Southampton, County of Suffolk,
State of New York, being more particularly bounded and described on Schedule "A" annexed
hereto and made a part hereof.
Being and intended to be part of the same premises described in deed recorded in Liber
8779 Page 68.
Premises known as 2060 Shipyard Lane, East Marion, New York 11939 (District 1000,
Section 038.00, Block 07.00, Lot 009.004) .
TOGETHER with all right, title and interest, if any, of the party of the first part in
and to any streets and roads abutting the above described premises to the center lines
thereof; TOGETHER with the appurtenances and also all the estate which the said decedent
had at the time of decedent's death in said premises, and also the estate therein, which
the party of the first part has or has power to convey or dispose of, whether
individually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the distributees or successors and
assigns of the party of the second part forever.
This conveyance is made in the ordinary course of business of the grantor,
AND the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
Subject to the trust fund provisions of Section 13 of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
