(631) 765-1809 L ✓ ®w CM FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MAY 18, 2023 ZBA FILE: #7786 NAME OF APPLICANT: Liane Scaduto PROPERTY LOCATION: 7845 Skunk Lane, Cutchogue,NY SCTM#1000-104-4-25 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type Il category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to thru A 14-25 and the Suffolk County Department of Planning issued its reply dated March 3, 2023 stating that this application is considered a matter for local detennination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 26, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 21,344 square foot parcel located in the Residential R-40 Zoning District. The combined northerly property line measures 90.00 feet, the easterly property line measures 200.00 feet, the southerly property line measures 100.00 feet and is adjacent to Bay Avenue, and the westerly property line measures 257.09 feet. The parcel is improved with and one-and one-half story frame dwelling with a detached frame garage on the west side of the dwelling as shown on the survey map prepared by Roderick Van Tuyl, LS and dated August 15, 1975. BASIS OF APPLICATION: Request for Variance from Article XXIII, Section 280-124 and the Building Inspector's January 31,2023 Notice of Disapproval based on an application for a permit to construct a wood deck attached to an existing single-family dwelling; 1) located less than the code required minimum side yard setback of 15 feet; located at 7845 Skunk Lane, Cutchogue,NY. SCTM#1000-104-4-25. RELIEF REQUESTED: The applicant requests a variance to construct a deck addition to an existing single-family dwelling The proposed deck on this nonconforming 21,344 square foot parcel is not permitted pursuant to Article XXIII, Section 280-124 which stated: lots measuring between 20,000-39,999 square feet in total size require a minimum side yard setback of 15 feet. The site plan shows the proposed deck to be setback+/- 9 feet from the side yard property line. i Page 2, May 18,2023 47786,Scaduto SCTM No. 1000-104-4-25 ADDITIONAL INFORMATION: Two letters from neighbors were received by the Zoning Board,one in favor and the other expressing concern. The application for the deck was revised March 20, 2023 from January 31, 2023, as noted on the Notice of Disapproval,to increase the proposed non-conforming side yard setback from 7 feet to 9 feet in more conformance with the code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed deck will replace an old masonry stoop. The existing bedroom window will be replaced with a sliding door for access to the proposed deck which will match the existing deck on the other side of the dwelling. The area community has many small older homes that have been added onto and made larger and more modern as many of the homes were built originally as summer cottages. 2. Town Law &267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant wished to replace an old masonry stoop with a new modern deck to enjoy a private an outdoor area off of the bedroom. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 66.6%relief from the code. However, the proposed new deck will be set back farther from the side property line at 9 feet than the existing dwelling which has a side yard setback of 7 feet. 4. Town Law X267-b(30)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Acampora,seconded by Member Lehnert, and duly carried, to GRANT the variance as applied for, and shown on the Site Plan prepared by Zackery E. Nicholson, Architect and dated February 27, 2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The new deck shall remain open to the sky. 2. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the reliefgranted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. In my estimation, it's not possible to comprehend what this project will look like based on the meager and incorrect information on the site plan. It's not my aim to make my neighbor's life difficult. I am just hoping that your office might be able to fill in some of the blanks. I don't want to go to the meeting without having a sense of what this project will entail. Liana's house is already pretty close to mine, in fact she has a shed that goes over the property line.
