SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 28, 2023, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: Relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 6,232 sq. ft. non-conforming parcel located in an R-40 Zoning District. The parcel is an"L" shaped lot with a road frontage along Sound View Avenue of 50.00 feet before turning south for 100.00 feet along Goldin Avenue,then turns 97.95 feet west before turning 20.00 feet north, and then 45 feet east, then it runs for 88.1 feet north back to Sound View Avenue. The parcel is improved with a two-story residence, and an accessory garage as shown on a survey prepared by John T. Metzger, L.S., last revised December 19, 2022. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and Building Inspector's December 28,2022 Notice of Disapproval based on an application for a permit to legalize an as-built raised masonry patio attached to an existing single-family dwelling; 1)located less than the code required minimum rear yard setback of 35 feet;2)more than the code permitted maximum lot coverage of 20%; located at 415 Goldin Avenue, Southold, NY. SCTM No. 1000-135-2-12. RELIEF REQUESTED: The applicant requests a variance to legalize an as-built masonry patio where the setback to the rear property line is 10 feet and 35 feet minimum is required. Patio addition will create a lot coverage of 24.8% where a maximum of 20% is allowed by code. ADDITIONAL INFORMATION: As per testimony from the applicant's agent, the original structures on the property existed before zoning codes were established in the Town. The existing property lines were redrawn in 1967by ZBA 4 667. The existing accessory garage was granted Certificate of Occupancy # 5543, dated 1973. In J Page 2, May 18,2023 97779,Bauer SCTM No. 1000-135-2-12 June of 1997, a Certificate of Occupancy # 25058, was granted for alterations to the first floor, and a second-floor addition ti the subject dwelling. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4,2023, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The patio built about two years ago, as per public hearing testimony, is partially at grade, and only a small portion requires variance relief. The patio is open to the sky, and is not a detriment to the neighborhood,and will not produce an undesirable change to the character of the neighborhood. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. The subject property is non-conforming is size and shape, and any addition to the residence would need variance relief. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial. 1. The rear yard setback variance represents a 72%relief from the code. 2. The lot coverage variance represents a 24%relief from the code. However,the existing patio conforms to the existing setback lines of the house,and since it is basically at grade, and will remain open to above,will not create a visual obstruction that would be a detriment to the neighborhood. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a as-built raised patio while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above(factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried, to GRANT the variances as applied for,and shown on the survey by John T.Metzger, L.S.,of Peconic Surveyors, PC, last revised December 19, 2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The raised masonry patio shall remain unenclosed and open to the sky. 2. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Page 3,May 18,2023 #7779,Bauer SCTM No. 1000-135-2-12 Board of Appeals,or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 3. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays andlor a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Aveta REASONS FOR APPEAL There are no Covenants and Restrictions concerning this land.'• The requested area variance is the minimum that is necessary and adequate;- and at the same time preserve and protect the character of the neighborhood and the health, safety 'and welfare of the community. This application for an area variance involves an "as built" 12 . 8 ' x ,22 . 4 ' masonry patio containing 286.72 sq. ft. , which is attached to the dwelling in the front yard area of your applicant' s property. The Building Inspector denied the Building Permit Application for this "as built" masonry patio because it exceeds the maximum lot coverage by ,4 . 8% and he patio is located 10 feet from the rear -property line vi KqECEIVFn a required setback of 35 feet. (Notice of Disapproval last revised December 28, 2022 is attached hereto as Exhibit 1) . FEB Y4.2023 Specifically your applicant was informed after the PA fi 1 Board o� Appeals was completed that the contractor did not obtain a Buil in Permit and it was not in conformity with the lot coverage requirements of the Zoning Code. The contractor informed your applicant he was _unaware a patio required .a Building Permit as he had built many patios before without having to obtain a permit. Your applicant learned because there were installed side steps to the patio, it was required to have a Building Permit. The contractor claimed he only placed the steps on both sides of the patio to accommodate easier access . Your applicant is upset because the patio as cons.tructed _is not legal pursuant to the Southold Town Zoning Code and the applicant and his father before him have in the past applied to the Building Department for permits when any work was done on the- property. This is particularly important to the applicant and his family so they can enjoy the patio knowing it is legal. This patio was specifically designed so the applicant ' s family could enjoy the view overlooking Long Island Sound. . The re-landscaped front yard provided easy access for applicant' s niece who is wheelchair -bound when she visits for periods of time during the summer months. To understand your applicant ' s difficulty a review of the history of this property will be helpful. Your applicant' s property as it presently exists is shown on survey of Peconic Surveyors, P.C. revised December 19, 2022 (this survey -is attached hereto as Exhibit 2) , is now, a part of Lots 6 and 7 on the "Map of Property Owned by Nathan Goldin", which map is filed in the Suffolk County Clerk' s Office on November 22, 1932 as Map No. 1106 (this filed map .is attached hereto as Exhibit 3) . It is your applicant ' s understanding that residences were built on the lots as shown on the 1932 filed map prior to the adoption of the Zoning Code by the Town of Southold. In 1964, Lots 6; 7 and 21 on this . filed map were owned by a Joseph J. .Aveta and there were existing houses built on these three lots . However, apparently they were summer residences built without regard to -the property lines on the filed- map. Joseph J. Aveta who owned these three lots applied to the Zoning Board of Appeals to have the individual lot line boundaries changed so the buildings and lots conformed to the Zoning requirements . (Appeal No. 667 is -2- FEB 1.4 2023 .4 attached hereto as Exhibit 4) . The, Zoning Board of "A p��s �t that time granted Mr. Aveta' s application allowing hi Tec�ra�aof"'�PPeals the property lines, in particular .the side yard boundary lines , between Lots 6 and 7 . - As a result, Lot 7 had frontage on Sound View Avenue of 50 ' ; the redrawn westerly .property line provided a 10 ' side yard from the house on Lot 7; and a redrawn southerly line so the garage on Lot 21 would not have the property line going through it.. This southerly property line was redrawn so that it would be 14 . 9 ' southerly from the existing house on Lot 7 . As part of -the history of this property 'is- that on October 17, 1973,-,the Building Department granted Certificate of Occupancy No. 25543 for anaccessory garage (this Certificate of Occupancy is. attached" hereto as Exhibit 5) . Further, .the Building Department in "1997 issued. Certificate of Occupancy No. Z-25058' for an addition adding a- second story deck over the concrete area of the concrete patio (this Certificate of Occupancy is attached hereto as Exhibit 6) . Admittedly, to legalize the patio, an area variance is needed because it exceeds the maximum lot coverage of 20% by 4 . 8% . However, the Building Inspector has also determined in the Notice of Disapproval (Exhibit 1) , the patio which is located 10 ' from the boundary of Lot 6 is a rear yard which also needs a setback variance. As can be seen from the survey last revised December 19., _2022 (Exhibit 2) , your applicant ' s property is not. only nonconforming but is also irregular in shape. The result-,being almost any" exteri"or improvements would have tobe approved by the Zoning Board ,of Appeals . Your applicant submits the "as built" patio created a "lot coverage deviation of 4 . 8%, but not a rear yard setback deviation," because the patio was built in the front yard area which is an extension of the house and the 10 ' side yard remains between Lot 6 and the patio. However, to avoid any future difficulties if the Board of Appeals decides this is a rear yard then permission is sought to allow the patio to remain in its present position as your . applicant is requesting a rear -yard setback variance. Your applicant understands in order to grant an area variance and to . allow the patio to remain in its .present "position, the Zoning Board of Appeals must consider the following criteria in order 'to make a determination that this. "as built" patio does not cause any detriment to the health, safety and welfare of the neighborhood and the community. -3- CRITERIA #1. Whether- an undesirable change will be produced in the character of the neighborhood.or a detriment to nearby properties will be created by the granting of an area variance? In evaluating this criteria, the patio must be considered in the context of the surrounding properties and will it adversely impact the residential character of this neighborhood. In viewing this "as built" patio in the front yard area of your applicant ' s property with respect to adjacent properties as well as the neighborhood, it is submitted this 286. 72 square foot patio is not substantial because from a mathematical point of view it exceeds the lot coverage requirement by only 4 . 8% . As a result of the 1964 Board of Appeals decision No. 667 (Exhibit 4) which reconfigured. Lot 7, the westerly side of Lot 7 has a side yard of 10 ' from the existing residence to the boundary of Lot 6. This recently constructed patio in the front yard area did not change this side yard setback as it remains .10 feet from Lot 6. If it remains designated as .a side yard there is no violation of the Zoning Code. However, if the Board of Appeals agrees with the Building Inspector deciding this yard should be designated as a rear yard, it follows that the patio deviates 25 feet or 71% from the zoning requirement ofa 35 foot setback. Although this percentage of deviation is mathematically substantial, the patio will not have any impact on the community considering it is basically at ground level and blends in with the front yard and, is barely noticeable from the neighboring properties . -4- CRITERIA #4 .' Whether the proposed variance "would. have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district? Yes, itis admitted that the applicant' s present difficulty of not being able to obtain a Building Permit to legalize the patio is self-created because the contractor should have obtained a. Building Permit before constructing this raised patio in its present .location. Not as an excuse for this self-created difficulty, but in and of itself this should not be . a reason to deny this application. It is reasonable to assume that the Southold, Town Building Department would not have* an issued a building permit if the application was made before the construction of the patio for the same reason the Building Inspector has denied the "as' built" application and thus the Zoning Board of Appeals would have the same issue before them. It is submitted to the Zoning Board of Appeals that the basic question in deciding a variance is whether a strict. application of the Zoning Ordinance will serve a valid purpose which will outweigh any difficulty for the applicant.
