Dam Pond)East Marion,NY SCTM: 1000-23-1-2.8 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 28, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 26, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject, 98,380.39 square feet, 2.26 acre irregular-shaped, waterfront property located in the R80 Zoning District is accessed via a 430+/- feet right of way from Main Road, Route 25. The parcel is developed with a 2-story frame dwelling with front and rear wood decks, concrete and stone steps, gravel walks, an inground swimming pool (subject of this application), pool enclosure fencing, and pool equipment as shown on the survey prepared by Kenneth M. Woychuk, last updated October 15, 2020. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and Building Inspector's January 19, 2023 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; 1) located in other than the code permitted rear yard; located at 14909 Main Road, (Adj. to Dam Pond)East Marion,NY. SCTM No. 1000-23-1-2.8. RELIEF REQUESTED: The applicant requests a variance to demolish and install a new gunite, inground swimming pool,measuring 12 feet by 82 feet, in a side yard location where such improvements are limited to rear yard locations, except in the case of a waterfront parcel, in which case the accessory is permitted in the front yard provided minimum front yard setbacks are met. Page 2, May 18,2023 #7778, Domeluca SCTM No. 1000-23-1-2.3 ADDITIONAL INFORMATION: The existing swimming pool (to be demolished), measuring 12 feet by 70 feet, located in a side yard,was built under Zoning Board of Appeals relief granted in decision#6766 dated July 24,2014 and is also the beneficiary of a de minimus request dated February 27,2017 allowing for the modest relocation of the pool in the same side yard. The applicant made a second request for a de minimus approval on October 20,2022 for resizing the swimming pool to 14 feet by 82.1 feet, a larger size. This request was denied on November 7, 2022 since the proposed change was not de minimus in nature. The applicant was instructed to apply for additional variance relief with a new application and a public hearing. The applicant provided a site plan depicting a pool size of 12 feet by 82 feet with drywell details, pool schematics, equipment vault plan and elevations labeled PL-101.00 to PL107.00 prepared by Steven B. Affelt, Registered Architect and July I,2022. The applicant stated that the property owner is a competitive swimmer and desires a longer lap pool, 25 meters to meet competitive standards. The pool cannot easily be extended; therefore, it needs to be removed; the new pool will be in the same location as the original one, however, 12 feet longer(landward of Dam Pond). During the public hearing the applicant was asked to amend the site plan to correctly illustrate the pools dimensions. On May 11, 2023 the Board received a corrected site plan labeled P1,101.00 — PL102.00 prepared by Steven B. Affelt, Registered Architect and dated July 1, 2022. In,addition to installing a code compliant fence around the pool the applicant proposes to relocate the pool mechanicals in an underground vault, located seaward of the expanded pool. The applicant has Town of Southold Trustees approval for this action. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.In-ground swimming pools are characteristic of this neighborhood. The proposed in-ground swimming pool will be incorporated within a raised patio structure adjacent to the dwelling and will not be easily visible from the adjoining property, also owned by the applicant. The pool is not visible from the public roadway nor from Dam Pond and the Long Island Sound. 2. Town Law 12267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance.The rear yard consists of a relatively steep slope which would require significant ground disturbance in order to install an in-ground swimming pool in a conforming rear yard location as compared to the subject side yard where the topography is relatively flat, making the subject side yard the most feasible location for an in-ground swimming pool. Furthermore, a pool already exists in this location, installed under Board relief,file#6766, and the applicant merely desires to extend its length, landward of Dam Pond. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However, the proposed location is at a conforming side yard setback and is visually screened by mature trees and vegetation from the adjoining property directly affected. Furthermore, the proposed side yard Page 3,May 18,2023 #7778,Domeluca SCTM No. 1000-23-1-2.3 location places the in-ground.swimming pool further from the tidal wetland boundaries and at higher existing topographical elevations than what could be achieved in a rear yard location. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit'of constructing an in-ground swimming pool, measuring 12 feet by 82 feet, in a side yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Lehnert,and duly carried, to GRANT the variance as applied for, and an in-ground swimming pool measuring 12 feet by 82 feet shown on the site plan, drywell details, pool schematics, equipment vault plan and elevations labeled PL-101.00 to P1,107.00 prepared by Steven B. Affelt, Registered Architect and last revised May 11, 2022 (corrected to illustrate pool dimensions and resubmitted on May 15, 2023). The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities'under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. RELIEF REQUESTED: The applicant requests a variance to locate an in-ground swimming pool in a side yard, where the code requires accessory structures to be located in a rear yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 10, 2014, at which time written and oral evidence were presented. In-ground swimming pools are characteristic of this neighborhood. The proposed in-ground swimming pool will be incorporated within a raised patio structure adjacent to the dwelling and will not be easily visible from the adjoining property directly to the west due to mature trees and thick vegetation at the adjoining property line. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The rear yard consists of a relatively steep slope which would require significant ground disturbance in order to install an in-ground swimming pool in a conforming rear yard location as compared to the subject side yard where the topography is relatively flat, making the subject side yard the most feasible location for an in-ground swimming pool. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the proposed location is at a conforming side yard setback and is visually screened by mature trees and vegetation from the adjoining property directly affected. Furthermore, the proposed side yard location places the in-ground swimming pool further from the tidal wetland boundaries and at higher existing topographical elevations than what could be achieved in a rear yard location. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an in-ground swimming pool in a side yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson),and duly carried,to GRANT, the variance as applied for, and shown on the Survey/Site Plan prepared by Kenneth M.
