SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 40,514.32 square foot parcel located in an R-80 Zoning District. The parcel is located on a right of way off of Young's Road (AKA Young's Avenue; and Young's Street). The parcel runs 301.20 feet on the South side bordering the Young's Road right of way, runs 134.14 feet on the West side, runs 285.00 feet on the North side, and 144.23 feet on the East side. The parcel is improved with a two-story frame residence, and a frame shed. All is shown on a survey prepared by Jason D. Leadingham L.L.S. dated May 31, 2022. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and Building Inspector's November 28, 2022 Notice of Disapproval based on an application for a permit to demolish (as per Town Code definition)and construct a single-family dwelling; 1) located less than the code required minimum side yard setback of 20 feet; located at 966 Youngs Road, Orient,NY. SCTM No. 1000-18-2-15. RELIEF REQUESTED: The applicant requests a variance to demolish the house as per town code and construct a single-family house with a side yard setback of 14.4 feet where town code requires a minimum side yard setback of 20 feet. ADDITIONAL INFORMATION: The applicant's agent testified that the dwelling was built in 1910 and the applicant does not intend to demolish the entire house, but that the proposed additions and alterations meet the demolition definition per Town Code. e Page 2,May 18,2023 #7772 Caufield SCTM No. 1000-18-2-15 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is in a residential neighborhood consisting of homes and agricutltural properties. The house is the last house at the end of the private Right of Way; to the north of the parcel is wooded land; to the East of the parcel is farmland. Granting of the variance will not have any change on the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing side yard setback is non-conforming. The proposed demolition is a technical demolition. The applicant does not intend on demolishing the entire structure. Therefore, any additions and alterations, or new structure in this location would need the benefit of an area variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 28% relief from the code. However,the applicant is making an addition to a structure with a non-conforming side yard setback. The applicant is encroaching an additional 1.2 feet to the side yard lot line at the closest point. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a additions to an old structure while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes, seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the Architectural plans prepared by Anthony Portillo, Architect, labeled SD-1 thru SD-4, dated August 31, 2022. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms.
