SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 15, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 26, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 33,089 square foot waterfront parcel located in an R-40 Zoning District. The parcel runs 100 feet of bulkhead frontage along Little Peconic Bay, I runs 103.80 feet of frontage along Nassau Point Road,runs 348 feet on the North side and runs 372.52 feet of frontage on the South side. The parcel is improved with a one-story frame house, a frame building with garage, a concrete foundation, and a bulkhead with steps. All is shown on a survey by John C. Ehlers L.L.S. last revised July 7,2008. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and Building Inspector's January 13, 2023 Notice of Disapproval based on an application for a permit to demolish an existing deck and patio to an existing single-family dwelling and construct a new raised masonry patio and decking at; 1) located less than the code required minimum side yard setback of 15 feet; located at 2855 Nassau Point Road,(Adj.to Hog Neck Bay) Cutchogue,NY. SCTM No. 1000-104-13-9. RELIEF REQUESTED: The applicant requests a variance to demolish an existing deck and patio, and to construct a new raised masonry patio with a non-conforming side yard setback of 10 feet where town code requires a minimum side yard setback of 15 feet. r Page 2, May 18,2023 #7771, Hochstrasser SCTM No. 1000-104-13-9 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code by bringing the proposed setback in line with the existing 12.8 feet setback from the side yard which was previously granted as variance relief by the Board of Appeals in ZBA#7176 dated July 19, 2018 for a side yard setback of 12.8 feet. The applicant on May 8, 2023 submitted a plan prepared by Mark Schwartz, Architect dated May 4, 2023, increasing the setback to 12.8 feet. ADDITIONAL INFORMATION: The Board received one letter of support and one letter of opposition from neighbors. - FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance(s) relief as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood consisting of single-family waterfront homes. The relief as amended allows the applicant to replace an existing at grade patio with a raised patio. The proposed side yard setback matches the existing side yard setback for the house. There will not be any change to the character of the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has an at grade patio in the side yard location where the applicant is proposing to construct a raised patio across the entire length of the rear of the house. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 17% relief from the code. However, the relief as amened allows the proposed raised patio to match the existing house's side yard setback. 4. Town Law 4267-b(30)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a raised patio while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Dantes, seconded by Member Lehnert,and duly carried,to DENY as applied for and GRANT THE RELIEF AS AMENDED and shown on the architectural plans by Mark K. Schwartz, Architect(labeled S-1 and A-1 thru A-5, dated May 4, 2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1) The raised patio shall remain unenclosed and open to the sky. Page 3,May 18,2023 #7771, Hochstrasser SCTM No. 1000-104-13-9 2) The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and shall implement and maintain controls to prevent discharge into the waterway; i.e., Little Peconic Bay. 3) Approval from the Southold Town Board of Trustees must be obtained. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays andlor a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan andlor survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board'finds the following facts to be true and relevant and makes the following findings: 1. The Nassau Point neighborhood was developed in the early 200' Century, prior to Zoning, and the majority of lots in the area are non-conforming developed with a variety of housing styles and sizes taking advantage of the unique coastal terrain. The subject property is shielded from the roadway and neighboring residences by mature and substantial landscaping. We respectfully ask you and your fellow Board Members to deny the subject Request for Variances from Article XXIII, Section 280-124 and to confirm the Building Inspector's January 13, 2023 Notice of Disapproval. The entire Southerly side of the Hochstrasser house already intrudes into the minimum side yard setback of 15 feet and was subject of an additional intrusion into the setback area for a substantial addition in July, 2018 pursuant to Variance Hearing # 7176, which we did not contest . In addition, there is a large outdoor shower improvement, attached to the dwelling structure, which is wholly located within the setback area and not fully set forth on the proposed site plan and did not appear on the 2018 Variance Site Plan. The huge masonry patio presently being proposed would be a substantial additional intrusion into the minimum 15 foot side yard setback area, which could easily be avoided by extending the new proposed patio to the east. We feel that the continuing erosion of the subject minimum side yard 15 foot setback area will intrude on the privacy and tranquility of both homeowners and in doing so subvert one of the primary reasons for zoning set backs.
