(631) 765-1809 old Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MAY 18, 2023 ZBA FILE: 7765 NAME OF APPLICANT: David & Sondra Russell PROPERTY LOCATION: 1375 Smith Drive South, Southold SCTM Nos. 1000-76-2-34.2 & 1000-76-2-35 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 28, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 16,750 sq. ft. parcel located in an R-40 Zoning District. According to the Building Inspector's Notice of Disapproval dated November 15, 2022, the parcel consisted of SCTM Nos. 1000-76-2-34.2, 1000-75-2-34.3 and 1000-76-2-35, which all merged by operation of law. The Board granted a Waiver of Merger, File No. 7766, to acknowledge lots SCTM Nos. 1000-76-2-34.2, and 1000-76-2-35 containing 16,750 sq. ft. in area as merged, and to allow 1000-76-2-34.3 to become a single and separate lot. The parcel containing the merged lots has a road frontage of 167.5 feet along Smith Drive South, then turns 100.00 feet to the north,then turns 167.5 feet east as the rear property line,then returns south 100.00 feet back to Smith Drive South. The parcel property is improved with an existing one-story residence and an accessory garage as shown on survey prepared by Nathan Taft Corwin,III, L.S., dated December 21, 2022. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and Building Inspector's November 15, 2022 Notice of Disapproval based on an application to demolish (as per Town code definition) and reconstruct a single family dwelling and to construct an accessory garage upon two(2)merged lots, at; 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required minimum rear yard setback of 35 feet; located at 1325 & 1375 Smith Drive So., Southold,NY. SCTM No. 1000-76-2-34.2 and 1000-76-2-35. RELIEF REQUESTED: The applicant requests variances to demolish (as per town code) and reconstruct a single- family house on the newly merged lot with a front yard setback of 33.7 feet where a minimum of 35 is required, and a rear yard setback of 28.9 feet where a minimum of 35 feet is required. Page 2, May 20,2023 #7765, Russell SCTM No. 1000-76-2-34.2, 1000-76-2-35 ADDITIONAL INFORMATION: As per testimony of applicant's agent,this application will make use of the newly created parcel by merging two lots; SCTM # 1000-76-2-34.2 and 1000-76-2-35. The newly created lot will still require variances to maintain the existing non-conforming setbacks of the existing house. The improvements to the existing residence located at 1375 Smith Drive South are as follows: 1. Certificate of Occupancy dated October 22, 1962—addition to the house. 2. Certificate of Occupancy dated July 17,2000—accessory garage. 3. Pre-Existing Certificate of Occupancy dated April 12, 2011. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4,2023, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed addition to the existing dwelling is to add a 2- car garage, along with living space in a proposed one-story addition. The proposed addition will not extend closer to the front and rear yard lot lines than the pre-existing dwelling. The house will result in a three (3) bedroom dwelling as is common in this area and is keeping with the size of the dwellings in the area. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. Due to the non-conformance of the existing house, any additions would require variance relief. 3. Town Law§267-b(3)(b)(3). The variances granted herein are mathematically substantial. The front yard setback variance represents a 4%relief from the code.The rear yard setback variance represents an 18%relief from the code. However,the proposed additions have a more conforming rear yard setback and will not extend further into the front yard than the existing house. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and Conditions of this board. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a reconstructed dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The subject lots are not in an environmentally sensitive area and the proposed improvements will not affect any natural features. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert, seconded by Member Weisman(Chairperson),and duly carried,to GRANT the variances as applied for, and shown on the survey by Nathan Taft Corwin, III, Land Surveyor, last revised February 6, 2023, and the Architectural Plans (Sheets A-001 and A-002) prepared by Charles Thomas, Architect, dated December 10, 2022. Submission of a revised survey depicting the existing shed in the northwest corner of the subject property. This approval shall not be deemed effective until the required conditions have been met. At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,siteplan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. Regarding the 35-foot front yard setback requirement for the proposed dwelling addition including garage, per Town Code Section 280-1241, a front yard setback variance of 1.3 feet is needed, as the proposed addition is setback 33.7 feet from the front yard lot line. The existing house is also located 33.7 feet from the front yard property line. The proposed front yard setback is the same as the existing setback of the pre-existing dwelling. 2. Regarding the 35-foot rear yard setback requirement for the proposed dwelling addition and garage, per Town Code Section 280-124, a rear yard setback variance of 6.1 feet is needed, as the proposed addition is setback 28.9 feet from the rear yard lot line. The existing house is located 28.9 feet from the rear yard property line. The requested rear yard setback is the same as the existing setback of the pre-existing dwelling. STANDARDS FOR THE GRANT OF AREA VARIANCES Pursuant to Town Law Section 267-b,the Zoning Board of Appeals is required to take into consideration the following factors when weighing the benefits to the applicants if the variance is granted against the detriment to the health, safety, and welfare of the neighborhood and community: a. Whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; b. Whether the benefits sought by the applicants cannot be achieved by some method feasible for the applicants to pursue, other than an area variance; C. Whether the requested area variance is substantial; d. Whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; 1 Town Code Section 280-124 provides the setback requirements for principal dwellings located on non- conforming lots less than 20,000 square feet in size. 2 RECEIVING APR 13 2023 � e. Whether the difficulty causing the applicants to request an area v riance was -7-7(a S self-created which consideration shall be relevant to the determin t�onio�tfEard of Appeals Board but shall not necessarily preclude the grant of the variance. The criteria for consideration of the required variances as discussed above as they apply to this application are addressed as follows: a) There is no undesirable change in the Character of the Neighborhood or detriment to nearby properties (Town Law Section 267-b(3)(b)(1)). The proposed addition to the existing dwelling is to add a 2-car garage, bathroom, bedroom, mechanical room, storage and laundry room. The proposed addition will not extend closer to the front and rear yard lot lines than the pre-existing dwelling. The house will result in a 3-bedroom dwelling as is common in this area. The proposed addition will result in a house with attached garage in keeping with the size of other dwellings in the neighborhood and will not adversely affect the overall character of the neighborhood. The proposed project complies with lot coverage and GFA. b) The benefit cannot be achieved by some other method feasible for the applicant to pursue other than area variances (Town Law Section 267-b(3)(b)(2)). As noted,the property is nonconforming to current R-40 zoning and any improvements to the existing dwelling would require variance relief due to the lot's constrained size. c) - The area variances requested are not substantial (Town Law Section 267-b(3)(b)(3)). The variances requested for the dwelling addition and attached garage are not substantial. The proposed dwelling addition is to be setback 33.7 from the front property line and 28.9 from the rear property line. The applicant is seeking front yard setback relief of 1.3 feet and rear yard setback relief of 6.1 feet. The proposed addition will not extend further into rear and front yards than the existing house. The requested variances are deminimus. d) There is no adverse impact on the physical and environmental conditions to the neighborhood/town (Town Law Section 267-b(3)(b)(4)). The subject lots are not in an environmentally sensitive area and the proposed improvements will not affect any natural features. There will be no adverse impacts on the physical and environmental conditions of the neighborhood or district, as the proposed improvements are in keeping with the character of the residential neighborhood. The proposed dwelling addition will allow for better usage and functionality of the space. 3 e) This a self-created difficulty(Town Law Section 267-b(3)(b)(5)). Although the difficulty is self-,created,this factor should not be determinative and preclude the granting of the requested area variances. In sum, under Town Law Section 267-b, the grant of the requested relief is the minimum necessary and adequate to enable the applicants to enjoy the benefit of the use of their home while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. APR 133 20 CONCLUSION _7& Zoning Board of Appeals As demonstrated, the benefit to the applicants outweighs any potentia the general health, safety, and welfare of the neighborhood.and the Town as a whole.
