This application must be filled in by typewriter OR ink and submitted to the building

DECISION
· PETITION NO. 2000-0372
Upon the application of John and Gall Meyer, filed pursuant to 19 NYCRR 450 on April 10, 2000 and upon all
other papers in this matter, the Department makes the fo,owing determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to a new building of Al (one family ) occupancy, two story in height, of type 5 (wood
frame) construction, approximately 3,800 square feet in total gross area, located at 44632 Main Road, Southold,
County of Suffolk,, State of New York. The petitioner is seeking relief from:
9 NYCRR 7t1.'1(a)(2), which requires that habitable space shall have a minimum height of 7 feet 6 inches,
except that for habitable space under a sloping roof the minimum height in at least 50 percent of the floor
area shall be 7 feet 6 inches and the area where the height is less than five feet shatl not be considered ia
computing required floor area. [The petitioner requests that a portion of the second floor with a maximum
ceiling height of 7 feet 4% inches be permitted.]
FINDINGS OF FACT
1. A framing inspection of the subject building revealed that the ceiling joists in two proposed second floor
bedrooms of the subiect dwelting were located at 7 feet 6 inches above the sub-floor.
2. Once the finished floor and the gypsum board ceili~g are installed the ceiling height will be approximately 7 '
feet 4% inches.
3. The location of the ceiling joists has caused the ceiling height to be nonconforming. Redoing this work has
been cited as a hardship.
4. The area of the second floor for which the ceiling height is lower than required is approximately 400 square
feet. this area represents only about 10 percent of the existing total floor area of the building.

5. There are bedrooms and other habitable spaces within the dwelling which are code compliant with respect to
the ceiling height. As a result of this, persons who are uncomfortable in the rooms with the slightly lower
. . heights could utilize the more ample rooms.
6, The petitioner proposes to install smoke detecting alarm devices within the bedrooms and throughout the
house in accordance with current code requirements. These should provide ample advance warning to alert
occupants of the building in the event of a smoke related emen3ency.
7, The difference between the height of 7 feet 4% inches and the code compliant ceiling height of 7 feet 6
inches is less than 2 percent and is considered to be diminimus in this case.
8. The local code enforcement official has been consulted and does not object to a routine variance in this
matter.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a
negligible additional health, sgfety and security benefit to the occupants of the building.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 7'[ 1.1(a)(2), to permit
two second floor bedrooms with ceiling heights of 7 feet 4% inches in lieu of 7 feet 6 inches; be and is hereby
PROPOSED TO BE GRANTED.
This DECISION is issued under '19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received
.by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
This decision is limited to the specific building and application before it, as contained within the petition, and
should not be interpreted to give implied approval of any general plans or specifications presented in support of
this application..

(4) An air.pressure test, at five pounds per square !nch gage pre~sure, may be applied
instead of the water pressure test when special permission is granted by the enfgrceinent
offider.'
(c) Completed sanitary drainage and vent systems. (1) Sanitary drainage and vent sys-
tems, upon completion, shall be tested and proven gastight.
(2) After ail plumbing fixtures have been installed and ail haps have been filled with water,
every pm of new sanitary drainage and vent systems within building walls shall be subjected to
a final test as prescribed herein. For the duration of testing, flow of water in the system shall be
halted and the building drain shall be sealed adjacent to its point of entry inside the building.
The enforcement officer may require the removal of any cleanout plugs to ascertain that the
testing is effective in ail parts of the system. Whenever there is reason to believe that the
sanitary drainage or vent system of an existing building has become defective, a final test as
proscribed herein shall be applied when deemed necessary by the enforcement officer.
(3) A smoke pressure test shall be applied to the system by introduaing into its lowest part
a pungent, thick smoke produced by one or more approved smoke machines. As smoke belches
from ail roof vent terminals, they shall be sealed. Then the system shall be subjected to smoke
pressure, equivalent to a one-inch column of water, for the duratioa of testing.
(4) A peppermiut vapor test may be applied instead of a smoke pressure test when special
permission is granted by the enforcement officer. The peppermint vapor shall be applied to the
system by introducing, into the roof vent terminal of every line or stank under test, at least two
ounces of oil of peppermint, followed immediately by the introduction of 10 quarts boiling
water. Then, the roof vent terminals shall be promptly sealed for ~he duration of testing. The
presence of oil of peppermint or persons in contact with such vapor shall be excluded from the
test area inside the building.

§ 907.1 General requirements.
(a) New, altered, extended, repaired or defective plumbing systems. New plumbing work,
and portions of existing plumbing systems affected by new work or plumbing changes, except
ordinary repairs, shall be subject to tests as prescribed herein to disclose leaks and defects. Where
there is reason to believe that the plumbing system of any building has become defective, the
anforcement officer may direct that such system shall be subjected to tests as prescribed herein to
disclose leaks and defects. In the event that tests disclose leaks or defects, such plumbing work
shall be subjected to rctesting after necessary corrections have been completed.
(b) Testing not required, Ordinary repairs to a plumbing system wi'rich do not include an
addition to, alteration of, rcplacemant of or relocation of, any water supply, drainage or vent
piping shall not be required to be tested.
(c) E~..£~sure of work for reining. No plumbing system or part thereof which is installed,
altered, extended or replaced shall be covered or concealed until after it has been tested and
approved. If such work has been covered or concealed before being tested and approved, il shall
be exposed for testing.
(d) Equipment, materia,[ and tabor for tests. Equipment, material and labor necessary for
tests shall be furnished by, and at the expense of, the person to whom the permit is issued.
(e) Duration of tests. Tests shall be conducted for a sufficient period of time to disclose
leaks and defects.

§ 907.2 Test methods.
(a) Water supply. (I) Water supply systems shall be proved watertight by applying a
water pressure test, using potable water in piping of thc potable water supply system. Test
pressure shall be equal to at least the maximum pressure at which the piping is to serve. Such
tests shall be applied to v, ater service pipes and rough piping installations prior to covering or
(2) Where the water supply system or portions thereof are installed in a manufactured
building, such system or portions thereof may be proved watertight in the manufacturing
facility by applying an air pressure test in lieu of the water pressure test requirements of
paragraph (1) of tiais subdivision. Test pressure shall be at least 100 psi. or the maximum
~ pressure at which the piping is intended to serve, whichever is greater, and shall be held without
introduction of additional air for a period of at least 30 minutes.
(b) Rough drainage and vent piping installations. (1) Building drains, drainage and vent
piping, except outside leaders, open-jointed or perforated subsoil drainage pipes, and exposed
short fixture connection drain pipes, shall Be tested and proven watertight upon completion of
the rough piping installation, prior to covering or concealment.
(2) Where the developed length of continuous drainage and vent pipe installation is less
than 10 feet, a water flow test shall be applied to the drainage piping. Water flow through the
drainage piping shall be provided at rates similar to the service conditiong under which the

drawings in connection with the above-captioned matter to include the following:
1. I will file for a routine variance from the New York State Department of State to
approve the two bedroom ceilings to remain at 7' 4-3/4" high. This variance will
satisfy Sections 7I I. l(a-2) of the New York State Code Rules and Regulations.
2. I have inspected the 1-3/4" x 9-1/2" LVL ceiling joists and their connectiot~s to the
roof rafters. In my opinion the framing is satisfactory. I will prepare a m'oss-section
through the upstairs storage area at the rear of the master suite.

7-5.2 Combustion air ducts shall extend as directly as
practical from the outdoors (inlet) to a termination outside
the fire chamber (outlet). Combustion air ducts shall be
constructed of, masonry, galvanized steel with a thickness
not less than 26 gage [0.019 in. (0.483 mm)], or other
approved noncombustible material and shall be equipped
with a damper that is capable of being fully closed.
7-5.3 Combustion air ducts that terminate outside the fire
chamber but within 6 in. of the fire chamber shall be
designed and installed to prevent the direct entry of flame,
embers, or ashes from the fire chamber into ihe duct.
7-5.4 Unlisted combustion air ducts shall be installed with
a minimum 1 in. (25 mm) clearance to combustibles for all
parts of the duct construction within 5 ft (1.5 m) of the duct
outlet.
7-5.5 The exterior inlet of the co~nbustion air duct shall

Chapter 8 Solid Fuel-Burning Appliances
8-1 Appliances. Solid fuel-burnlng appliances shall be
listed and installed in accordance with the terms al'their
listing.
Exception: Unlisted appliances approved by the authority having
jurisdiction shall be installed as specified in this chapter. Such instal-
lotion,s shall also be in accordance with the manufacturer~ i~t~talla-
tim insl~tctions i£snch n~shuctions specify the use of increased pro-
tectioa or greater cleara~ces than specified in this chapter. T/tis
exception shall not apply to mobde home installations.
8-2 Location of Appliances.
8-2.1 Every appliance shall be located with respect to
buikling construction aud other eqnipment so as to permit
access to the appliance. Sufficient clearance shall be main-
rained to permit cleaning nf surfaces; the replacement of
air filters, blowers, motors, controls, and chimney connec-
tors; the lubrication and servicing ol touring parts; and the
adjustment and se~ vicing of stokers, if provided.
8-2.2 Solid fuel-burning appliances shall not be installed
in conlined spaces. The space or room shall be of ample
size to permit adequate circulation of heated air. App)i-
antes shall be so located as nnt to intcrfkre with proper or-
culation of air witblu the heated space.
Exception: Solid fuel-burning app~ances listed for n~stallation
