This application must be filled in by typewriter OR ink and
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property li~es,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildip
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board ~proval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings an
'!pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant

For a Variance to the New York State PETITION NO. 2000-0770
Uniform Fire Prevention & Building Code
Upon the application of Stephen O'Connor, filed pursuant to 19 NYCRR 450 on July 15, 1999, and upon all
other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to the construction of a new building of A1 (one family) occupancy, one story in height, of
type 5 (wood frame) construction, approximately 2,100 square feet in area, located at 1195 Ships Drive, Southold,
Town of Southold, County of Suffolk, State of New York.
The petitioner is seeking relief from:
9 NYCRR 717.3(e)(4), which requires that floor-mounted fuel-burning heat-producing equipment within a
garage located below grade, or within a below-grade space opening directly into a garage, shall be installed on
a noncombustible platform not less than 18 inches above the floor. [The petitioner requests relief to allow
floor-mounted fuel-burning heat-producing equipment located within a below-grade space opening directly into
a garage, be installed on a noncombustible platform 12 inches above the floor.]
FINDINGS OF FACT
1. A concrete block platform was constructed in the cellar for the installation of ( 32 gallon water heater ) fuel-
burning heat-producing equipment for the new dwelling that is the subject of this petition.
2. The cellar opens directly to a garage that is located below grade.
3. The concrete block platform was only constructed to a height of 12 inches. This error was not realized until the
equipment was installed and the building was ready for final inspection.
4. At this time the Petitioner states that the cost to extend the height of the block platform and raise the heater
would be excessive at this point.

5. The housing for the fuel-burning heat-producing equipment that is located on the poured concrete platform is
made of non-combustible material and is constructed in a manner that raises the actual burner and fuel
connection to more than 18 inches above the floor which would satisfy the intent of the Code.
6. An interconnected fire and smoke detecting device has been installed on the ceiling in close proximity to the
fuel-burning heat-producing equipment in question.
7. The local Code Enforcement Official has been consulted in this matter and does not object to the granting of a
routine variance under the provisions of 19 NYCRR 450.6.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a
negligible additional health, safety and security benefit to the occupants of the building.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 717.3(e)(4), to permit
floor-mounted fuel-burning heat-producing equipment located within a below-grade space opening directly into a
garage to be installed on a noncombustible platform 12 inches above the floor; be and is hereby PROPOSED TO
BE GRANTED.
This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received by
the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
This decision is limited to the specific building and application before it, as contained within the petition, and
should not be interpreted to give implied approval of any general plans or specifications presented in support of this
application.
