Thursday~. September 8, 1960 at the Town Clerk Office, Main Road, Southolds New York. There were present~ Messrs. Robert W. Gillispie, Jr.~ Chairman~ Robert Bergen~ Herbert Rosenberg, and Charles Grigonis, Jr. Also present: Mr, Howard M. Terry, Building Inspector. Absent: Mr. Serge Doyen, Jr. PUBLIC ~%RING~ Appeal No. 308~ 7~30 P.M. upon application of St. Agnes Church, Main Street, Greenport, New York, for a special exception in accordance with the Zon- ing Ordinance, Article IV~ Section 408a. for permission to erect and maintain a sign on the property of John Rempe & wf. north side Route 25,'east of Albertson Lane~ Greenport, New York. No fee - church application. The. Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit Southold Town Board of Appeals -2- September 8~ 1960 attesting to its publication in the official newspaper. .Chair- man also read letter of permissiun from the property owner, THECHAIRMAN~ Is there anyone present.who wishes to speak for this application: FATRER JOHN MURPHY, Greenport, New York: I am appearing on behalf of Father Tennant~ St. Agnes Church, Greenport. The statement that Father Tennant made on the applicationis quite accurate. During the summer at least 1000 additional people attend Mass on Sunday, The church holds 300 people and it makes it necessary for us to hold additional Masses in the Hall. T~ CHAIRMAn% area ? What are the other Catholic churches in this FATHER MURPHY: There is Greenport~ Southold and Cutchogue~ and of course Mattituck further west. THE CHAIRMAN: As a result of the summer conditions to have to hold Mass in the auditorium of the school? FATHER MURPHY: That is correct. The Chairman asked several questions relative to the capacity of the other Catholic churches in the area~ time of%he Masses~ etc. TRE CHAIRMAN: Will the address of the church be put on the sign ? FATHER MURPHY: I am sure it will. MR. BERGEN: Have these signs been made up yet? FATHER MURPHY: I do not bel~ve so. MR. ROSENBERG: How large is the sign to be? FATHER MURPHY: 5 ft. by 11 ft. If you are going to read numbers you will need a large sign, THE CHAIRMAN$ The fewer words on a sign the more likely it is to register with the traveling public. The directional signs that we have authorized in the pastthat are in the interest of the public is 50 sq. ft. Although we have a provision which enables Southold Town Board of Appeals -3- September 8~ 1960 the sign owner to have 6 ft. 6 in. by 12 ft. 6 in., but to stay within 50 sq. ft. The 6 ft. 6 in. by 1.2 ft..6 in. would be the extreme exterior dimensions of an ir~egular shaped sign. With your sign we would appreciate it if you would cut it down to 5 ft. by 10 ft. and it would be within the 50 sq. ft. provision. What will the wording on the sign be? FATHER MURPHY: The name of the church, name of the street~ time of Masses and time of confessions. THE CHAIRMAN: Is there anyone else present who would like to ask any questions? MR. ROSENBERG: I would like to remind you that the size 5 .ft. by 10 ft. for the size of the sign means the entire exterior dimension, The extreme outside. FATHER MURPHY: Yes, I understand. Resolution was offered by Mr. Grigonis, seconded by Mr. Bergen, and carried~ WHEREAS application of St. Agnes Church~ having been considered at Public Hearing No. 308 on September 8, 1960, and tm Board finding that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjacent use districts will not be substantially or permanently injured and the spirit of the Ordinance would be observed~ therefore be it RESOLVED that St. Agnes Church~ Greenport~ New York~ be granted permission to erect and maintain a sign only for the purpose of listing religious services, on the property of John Rempe & wf., north side Route 25, east of Albertson Lane, Arshamomaque, Greenport, New York. The area of this sign shall be no greater than 50 sq. ft. and the exterior dimensions no greater than 6 ft, 6 in. by 12 ft. 6 in., upper edge of the sign Southold Town Board of Appeals -4- September 86 1960 shall be no higher than 15 ft. 6 in., lower edge no closer than 3 ft. from the ground level and sign to be no closer than 5 ft. to any property line. Applicant may erect a double faced sign if desired. This sign is subject to the same regulations and controls which affect non-conforming signs. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,. Mr. RoseDzberg~ and Mr. Grigonis. PUBLIC HEARING: Appeal No. 309- 7:40 upon application of St. Ag~nes Church~ Main Street, Greenport~ New York,. for a special exception in accordance with the Zoning Ordinances. Article III, Section 300, Subsection 11~ for permission to erect and maintain a sign on the property of Leo Sledjeski, north side Route 27A, opposite Queens Lane, Greenport, New York. No fee - church application. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the official newspaper, The letter of permission from the property owner was also read. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? FATHER JOHN bUJI~P~ Greenport~ New Yo~: This sign is identical to the one we lust discussed. I would also like to speak in favor of this sign and say that it is needed for the same reason I gave before. The reason we are using the North Road is because it is very heavily traveled. THE CHAIRMAN: this sign? Are there any questions with relation to (There was no response.) THE CHAIRMAN: Is there anyone present who would like to speak against this application? PUBLIC ~M~%RING: Appeal No. 310, 7:45 P.M- (E.D.S.T.)~. upon application of James and Dorothy Turk~ North Road, Southold,~ New York~ for a variance in accordance with the Zoning Ordinance~ Article ILI~ Section 300, Subsection 1, for permissinn to use existing dwelling as a two family residence. Location of property: south side Route 27A~ Southold, New York~ bounded north by North Road, east by Leon Sawicki, south by Leon Sawicki, and west by Leon Sawicki. Fee .paid $15.00. The Chairman opened the hearing by reading notice of dis- approval issued by the building inspector, application for a variance, legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: Is there anyone presen-t who wishes to speak for this application? Southold Town Board of Appeals -6- September 8, 1960 (There was no response.)' THE CHAIRMAN: I believe when Mr, Turk appeared several weeks ago we stated that it would not be necessary for him to appearon this date. It seems the beams in the addition to thise house were rotting and need repairing, and instead of having to demolish it he wished to repair it and rent it as apartments rather than having several roomers. MR. TERRY, Building Inspectorz The work he intends to do is all inside the building and would cause no exterior work. There would be repair of the floor beams. THE CHAIRMAN: What is the setback of the house? MP~ TERRY; It is 25 ft from the property line. 25.6 to be exact, THE CHAIRMAN~ Is there anyone else present who wishes to say anything in favor of this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? ~. (There was no response.) Resolution was offered by Mro Bergen~ seconded by Mr. Rosenberg, and carried~ WHEREAS application of James and Dorothy Turk, having been considered at Public Hearing No. 310 on September 8, 1960~ and the Board finding that strict appli- cation of the Ordinance would produce undue hardship because this wing, whichwas constructed with a separate entrance and · which would be utilized, badly needs repair and if it is not utilized it would be necessary to demolish it. The-hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the. same use district because this house was constructed to be utilized by more than one family. The variance does observe the spirit of the Ordinance and would not change the character of the district because within a quarter of a mile ther~re rooming houses, duplexes andsummer re~tal bungalows and the nearest residence is over 100 fto~ therefore be it Southold Town Board of Appeals -7- September 8, 1960 RESOLVED that James and Dorothy Turk be granted permission to use, as a two family dwelling, their residence located on the south side North Road (Route 27A), Southold~ New York. Reeve, Sr., and L. P. Reeve, Main Road~ Mattituck~ New York~ for a variance in accordance with the Zoning Ordinance~. Article III~. Section 303,. and Article X, Section 1000A~ for permission to reduce frontage and use as a sin~e lot, property located on the west side Wickham Avenue~ Mattituck, New York, bounded north by Stanley Zimnoski~ east by Wickham Avenue, south by other land of H. R. Reeve & ors.~ and west by other land of H. R. Reeve & ors.~. Fee paid $15.00. The Chairman opened the hearing by reading notice of dis- approval issued by the Building Inspector~ application for a variance~ legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak fOr this application? bIR. HAROLD R. REEVE, JR., Mattituck~ New York: for this application. I speak T~ECHAIRMAN: This application should be amended to Article IV,. Section 400, Subsection 1 rather than Article III, Section 303, since this is a business district. The Article X, Section 1000A will still remain~ will you agree to that amendment? REEVE: That is perfectly agreeable to me. On motion of Mr. Bergen, seconded by Mr. Grigonis, and carried~ the applicati~n of Harold R. Reeve, Jr., Harold R. Reeve, Sr.~ and L. P. Reeve was amended to Article IV, Section 400~ Subsection 1 and Article X~ Section 1000A. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Grigonis~ and Mr. Rose,berg. Southold ToWn Board of Appeals -8- September 8, 1960 THE CHAIRMAN: station ~ What was the time of the lease to the gas MR- REEVE: 1955, TRE CHAIRMAN: That predated zoning. MR. REEVE: The only other use of the property in question would be business and I do not know what business would want to go there and who would want to have it there. THE C~: I feel it would tend to up-grade the property to have a house there rather than a business. Are there any questions anyone would like to ask Mr~ Reeve? MR. BERGEN: What is the setback for the house to be built? MR. REEVE: 35 ft., and Zimnoski is a little less than 33 ft. By going back 35 ft. the vision near the corner won't be obstructed. THE CHAIRMAN: Are there any other questions? (There was no response.) THE CHAIRMAN: Is there anyone present who would like to speak against this application? (There was no response.) Resolution was offered by Mr. Gillispie~ seconded by Mr. Bergen,. and carried~ WHEREAS application of Harold R. Reeve.. ~ Jr., Harold R. Reeve, Sr., and L. P. Reeve~ having been considered at Public Hearing No. 307 on September 8, 1960, and the Board finds that strict application of the Ordinance would produce undue hard- ship because, applicant is unable to secure additional land on either side to increase the frontage. The hardship created is unique and is not shared by all properties alike in the immediate vicinity of this property and in this use district because most of the other lots in the area are less than 100 ft, frontage~ some being 50 ft. or 60 ft. lots. The variance would observe the spirit of the Ordinance and would not change the character of the district because applicant intends to erect a residence in keeping with the neighborhood~ therefore be it Southold Town Board of ApPeals -9- September 8, 1960 RESOLVED that Harold R. New York, a/c Booth House, Sterling Avenue, Greenport, New York~ for a special ex- ception in accordance with the Zoning Ordinance, Article .I~V~ SectiOn 408, for permission to erect and maintain a directional sign on the property of Mrs. Edna M. Turner~ north side Route 25, Greenport, New York, bounded north by F. K. Stepnoski Estate, east by Sam Ciacia Estate, south by Main Road, and west by Rempe & ors. Fee paid $15o 00. This hearing was originally scheduled for 8:00 P.M., Thursday, September l, 1960~. but postponed to this date. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the official newspaper. Letter from the property owner was also read. THE CHAIRMAN: Is there anyone present 'who wishes to speak for this application? M~ ROBERT KETCHAM, JR., Bay Lake Park~.East Marion, New York: The sign will be rectangular with an arrow pointing from Route 25 to the church to the Booth House.. It will be erected vertically rather than horizontal. MR- BERGEN: What is the size of the sign? MR. KETCHAM: 7 ft'. by 10 ft. THE CHAIRMAN: I am afraid you will have to cut that down to 50 sq. fto Would you please make a sketch of the sign for us? (Mr. Ketcham made a sketch of the Sign for the Board.) THE CHAIRMAN: You could probably cut off the part of the Southold Town Board of Appeals ~10-- September 8, 1960 sign that is not used and thereby meet the 50 sq. ft.. require- ment. Resolution was offered by Mr. Rosenberg, seconded by Mr. Grigonis~ and carried~ WHEREAS application of Robert Ketcham, having been considered at Public Hearing No. 311 on September8, 1960~ and the Board finding that the public convenience and welfare and justice will be served and the!egally established or permitted use of neighborhood property and adjacent use districts will not be substantially or permanently injured and the spirit of the Ordinance would be observed~ therefore be it RESOLVED that permission be granted Robert Ketcham, Jr., a/c .Booth House, Greenport~ to erect and maintain a directional sign on the property of Edna M. Turner~ north side Route 254 Greenporto The area of the sign to be no greater than 50 sq. ft., and exterior dimensions to be no greater than 6 ft. 6 in, by 12 ft. 6 in. Upper edge of the sign shall be no higher than 15 ft, 6 in., lower edge no less than 3 ft. above the ground level and sign to be no closer than 5 ft. to any property line, This sign is subject to the same regulations and controls which affect non-conforming signs. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg~ and Mr. Grigonis. Mr. Ketcham informally discussed with the Board of Appeals the matter of erecting a fence on the line between two properties. Mr. Terry informed M~. Ketcham that if the fence hits on the property line it mus~by written agreement between the property owners. Southold Town Board ofAppeals -11- Septmber 8, 1960 Mr. William J.. Finn, 1901 N- Jersualem Road, East Meadow,. New York, appeared before the Board of Appeals for an informal discussion relative to property he is 'interested in on Peconic Bay Boulevard, Laurel, which is 63 ft. by .400 ft. Mr. Finn stated that the wished to use the dwelling and convert the exist- Lng two car garage into a second res idence~ for his aunt. After considerable discussion relative to the situation~ Mr. Finn was advised that his best solution would be to divide the property into two separate lots, each would contain 12,600 sq. ft., and either move the garage back or build a new dwelling on ~the second lot. Mr.. Finn stated that he would apply for a var lance to dividie the property into two single lots and reduce the frontage. The minutes of the meeting of September 1~ 1960, on motion of Mr. Bergen, seconded by Mr. Rosenberg, and carried, were approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. (~)~ for permission to expand a non-conforming use. Location-of. Property: north side Route 25, East Marion, New York~ bounded north by other land of Costas Stars~ east by George Schroeder, south by Route 25, and west by Eldredge and Dsenkowski.
