Richter, Registered Architect DATE: January 14, 2000 RE: Chadwick Application In reference to your memo regarding the above application, it is important that you understand the history of this project. The application, when originally reviewed, indicated that the project was within the flood zone AE (El 8). The application also indicated that the proposed construction was less than a 50%renovation. At that time, a Permit was written and a Flood Development Permit was issued. Subsequent inspections by Mr. Boufis determined that the project went well beyond the scope of the original plans and the project had exceeded the 50% criteria. This fact requires that the project meet total compliance with FEMA regulations. Upon notification of the above, the project Architect had the surveyor plot the flood zone line on the original survey. This line indicated that the building was within 6" of the line but out of the zone. This survey also indicated that the eight (8') foot contour ran right through the dwelling. This was the main reason that the original Flood Development Permit was issued. As you know, if any portion of the dwelling is in the zone the entire building must comply with regulations. Since their seemed to be a discrepance in the information provided on the map, the surveyor was asked to re-evaluate the eight (8') foot contour. The latest map provided by the surveyor did not show the Flood Zone Line but did show spot elevations that appear to indicate an eight (8') foot contour surrounding the dwelling. The shape and nature of this contour line suggests that fill was placed around the house during the original construction of the dwelling. Using this data, the Project Architect Certified the location of the dwelling to be out of the Flood Zone. After discussions with other department staff, it was recommended that the surveyor should be the individual who needs to certify the location of the dwelling since it was his data that was referenced in the certification. Due to the fact that a Flood Permit was taken out at the beginning of this project, this office felt that it was necessary to ensure an exacting certification so that the Town would not be in jeopardy of violating FEMA requirements. Chadwick 6565 Indian Neck Lane Peconic,New York 11958 Re: Building Permit 4 25779 Construction of Additions & Alterations to an Existing Single Family Dwelling in Compliance with Flood Plain Regulations Dear Sirs: as Applied For. At this time, this office has not received adequate certification that the single family dwelling, referenced in permit# 25779, is located out of the Flood Zone (AE(el.s)). A Flood Development Permit was filed with the original application for building permit and your Architect, the applicant for the Permit, was informed of all FEMA Regulations at that time. The Architects office also represented that the proposed additions and alterations would not exceed 50% of the construction value of the existing dwelling. It has been determined by initial field inspection that actual renovations have exceeded the 50% threshold. It is therefore required that all construction, both new and existing,conform with all FEMA Regulations. Several attempts have been made by your Architect and the Surveyor to certify that the existing dwelling is out of the Flood Zone and not required to meet FEMA Requirements. This office will require a survey that accurately plots the Flood Zone line(not a superimposed photocopy) and a completed FEMA Elevation Certificate. This is the only documentation that can confirm that this dwelling is out of the Flood Zone. Mr. Eric Star is the local FEMA representative and he has informed our office that the vertical elevation 8' contour is what matters when determining Flood Zone locations. If you wish to discuss this matter with him directly he can be reached at 444-0423. If the appropriate documentation cannot be filed with this office to certify that the dwelling is out of the Zone, it will become necessary for all construction, both new and existing, to be redesigned and upgraded to comply with Flood Zone Regulations. If the requested certifications as noted above are not provided to this office in a timely fashion, it may become necessary to stop the project. This is not an avenue that I wish to pursue. Edward Forrester Department Head cc: SAMUELS & STEELMAN ARCHITECTS a FM 24 = 'L Tuesday, February 22, 2000 - 8:35 a.m. eLCU DePT TOWN 0-r SOUTHOLD Received call from Walter Chadwick 212-371-0703 (work 4 from 10:45am to 8:00pm) Mr. Chadwick has just gotten off the phone with a building dept. secretary and wanted to immediately speak with the supervisor. "Their behavior (the Building Department) is completely out of control". He feels that he will have to go to his lawyer to commence a lawsuit against the Town, the Building Dept, and individuals. I explained that the Supervisor was not in the office and he wanted to know when she could be reached as he wanted to speak with her today. I explained that she was out of town and would not be back in the office until Thursday. He asked if she was at the same convention that Jamie Richter was at as he would also not be back until Thursday. Ed had told him that Jamie Richter would be handling his file from now on and he would need to speak with Jamie on all matters relating to his project and no Jamie, nor Ed, nor the Supervisor can be reached. He was upset but calming down, (My impression - exasperated) and he is now two months behind on his project. He said he received notice that John Boufis would not inspect the house as he needed more information. A survey and flood certificate were hand-delivered to bldg dept on Friday @ 3:00pm and he asked the secretary if it had been reviewed. She told him there was nothing in his file. I explained that Jamie leaves at 3:00 and probably did not get a chance to review it before leaving for the weekend. He claims that the secretary was "extremely rude" especially when he asked to speak directly to John Boufis. The secretary told him"no". He asked if John Boufis was also away from the office and she replied "no, he's standing right by my desk but you're not going to talk to him". After that, he claims he was basically hung-up on. I told him I would explain his problem to the Supervisor if she called in but that there was really nothing much she could do to help him until she was back in the office. He had vented his fiustration, and was never rude or loud when speaking with me. I then called the 3ldg Dept and spoke with Connie. She said that yes, he had called there (would not offer to tell me who had been speaking w/him) and that he is an extremely rude and irate man that is doing something wrong, knows he is doing something wrong, and still wants them to work around it. That they have been told that he is to speak with Ed or Jamie(as Jamie is the contact on this project) and no one else. As they are out of the office, they would not let him speak to John Boufis as he is not aware of project and would not be able to answer his questions. A Flood Development Permit was filed with the original application for building permit and your Architect, the applicant for the Permit, was informed of all FEMA Regulations at that time. The Architects office also represented that the proposed additions and alterations would not exceed 50% of the construction value of the existing dwelling. It has been determined by initial field inspection that actual renovations have exceeded the 50% threshold. It is therefore required that all construction, both new and existing, conform with all FEMA Regulations. Several attempts have been made by your Architect and the Surveyor to certify that the existing dwelling is out of the Flood Zone and not required to meet FEMA Requirements. This office will require a survey that accurately plots the Flood Zone line(not a superimposed photocopy) and a completed FEMA Elevation Certificate. This is the only documentation that can confirm that this dwelling is out of the Flood Zone. Mr. Eric Star is the local FEMA representative and he has informed our office that the vertical elevation 8' contour is what matters when determining Flood Zone locations. If you wish to discuss this matter with him directly he can be reached at 444-0423. If the appropriate documentation cannot be filed with this office to certify that the dwelling is out of the Zone, it will become necessary for all construction, both new and existing, to be redesigned and upgraded to comply with Flood Zone Regulations. If the requested certifications as noted above are not provided to this office in a timely fashion, it may become necessary to stop the project. This is not an avenue that I wish to pursue.
