Regulated activities include, but are not limited to the erection of any structure (s) ; excavation; dredging grading and filling; clearing of vegetation; and application of chemicals. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. B. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any" failure to comply precisely with all of the terms and -conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 444-0365 . C. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. D. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photographs of the completed work and, if required, a survey. E. For projects involving activities to be undertaken in phases over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to recommencing work in subsequent years. Should some emergency or need to locate the owner of a certain structure or mooring (i£ structure brakes loosb) , the permit number clearly visible will enable the Bay Constable or others to locate the area. B. Each visible permit number displayed shows that you have followed the procedure necessary for the particular structure or mooring. Those who do not have a number will warrant investigation and possibly a fine. Numbers should be at least 3" high and printed in contrasting black and white. The numbers should be placed on bulkheads, on the fixed portion of_ the dock as well as the floating portion of the dock. Floats tend to get loose in storms and this way the owners can be found. The simplest way is to use a piece of Board painted black with the required 3" white letters painted on it. This then could be nailed to the seaward side of the structure so it can be seen from the land or the water. The floating docks can have the numbers carved in them. This way it won' t fall off. Moorings and stakes can have the numbers painted on as well as . the sticker that is handed out every year. Any" failure to comply precisely with all of the terms and -conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (Si6) 444-0365 . C. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Should some emergency or need to locate the owner of a certain structure or mooring ( if structure brakes loose , the permit number clearly visible will enable the Bay Constable or others to locate the area. B. Each visible permit number displayed shows that you have followed the procedure necessary for the particular structure or mooring. Those who do not have a number will warrant investigation and possibly a fine. Numbers should be at least 3" high and printed in contrasting black and white. The numbers should be placed on bulkheads, on the fixed portion of the dock as well as the floating portion of the dock. Floats tend to get loose in storms and this way the owners can be found. The simplest way is to use a piece of Board painted black with the required 3" white letters painted on it. This then could be nailed to the seaward side of the structure so it can be seen from the land or the water. The floating docks can have the numbers carved in them. This way it won' t fall off. Moorings and stakes can have the numbers painted on as well as . the sticker that is handed out every year. (3) the requested area variance is substantial in relation to the code requirements because of the size of the property. (4) the proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the building envelope is restricted to a specified area distant from the ordinary highwater mark, and precautions will be taken such as retention of water from gutters, drainage basins, buffers, etc. (ref: Town Trustees permit). (5) the situation has not been self-created because there have been multiple agency approvals which restrict the building envelope.
