As a result ofsn impaction ofyour client's property located at 3715 StiLwater Avenue,Cutchogue, Now York-County of Sullblk(SCTM N 1000136-02-12),Department atafThad determined that there was an unauthorized installation of a I0'x I8'wooden deck in a rogulated arca adjacent to a tidal wetland;the storing of a 9 x I S'boat,the placement of an 8' x 8'floating dock,and the placement of a 10 x 12'pile of oonstrucdion debris in a vegetated ;idol wetland. All activities having boon conducted without the benefit of NYSDEC Tidal wetland Permit. While these activities do constitute violations cf Article 25 of the Environmental Conservation Law(ECL), it was domonstrated that the boat,the floating dock and At1 debris W been removed from the subject site by the time of the compliance wferenco. Cortscque+tty,the Dopartment will consider these violations resolved without requiting further action. Since it is the opinion of Departmsm staff that a perrttit would have been issued for installation of the 10'x 18'wooden deck,the ,Department does not require removal of this structure. Boos, As per my phone conversation with Mrs. Boos on Monday, January 25, 1999 I explained that when the Trustees went out on field inspection, they noticed that some debris, leaves, twigs, etc were dumped over the bank onto the marshland. When a high tide comes in it also carries out this debris into the creek which has a definite impact on the environment of the creek. We regret to inform you that we cannot issue a permit for the existing 10' X 18' deck with sliding glass door until this debris is cleaned up, and at which time you will notify the Trustee office and we will re-inspect the area and issue a permit.
