In the application for Certificate of Occupancy for the above referenced project we have
been asked to provide pre-existing and new ceiling height. According to the records of
the contractor who performed the work the pre-existing ceiling height was 83" or 6' 1 l"
and the new, finished ceiling height is 93" or 7'9".
Thank you for your time and attention to this matter.
'Furnace
on on an outside wall with a clear space of 28" (711 mm) high
by 49" (124cm) wide in the room.
C/earances
I. In selecting a location for installation, it is necessary to provide
adequate accessibility clearances for servicing and proper installation.
2, Unit is supported by a wall bracket secured to the wall.
3. The minlmum clearances from casing to combustible construction is
8 (121cra) on top, 6 (152mm) on each side and 4" (102mm) from
the floor or from the top surface of carpeting, tile or other floor
covering and 0" (0mm) to rear wall.
4. The minimum distance from the center of the vent cap
outside corner or obstruction is 24" (610mm).
5. The D V-25 and D V-35 minimum wall depth is 41/2" ( l14mm
(and the maximum is 13" (330mm). The use of tubes
supplied by the manufacturer results in unsatisfactory, tjX_,
performance.
The vent terminal of a du ect vent apphance with an Input of 50,000

(14.6 KW) BTU per hour or less shall belocated atleast9 (229~nm)from ................
any opening through which flue gases could enter a building. The
bottom of the vent terminal and the air intake shall be located at least 12" 4 (lO2) M~N.
(305mm) above grade.
WARNING: The nearest point of the vent cap should be
minimum horizontal distant of six (6) (1.83m) feet
pressure regulator. In case of regulator malfunction,
(L83m) feet distance will reduce the chance of gas enterin
vent cap.
Locating Wall Opening
The furnace is to be located on an outside wall. Locate wall studs so ti
wall opening will be located between wall studs. The wall studs can I e
used for attachment of wall mounting bracket. The wall opening required
as shown in Figure I is a diameter of 7 1/2 inches (191mm).
A template is provided in furnace carton for positioning furnace on the
wall· Also, refer to Figure I for positioning the furnace on wall and for
locating gas line connection.
Figure I will position the furnace four inches (102mm) off the floor. If
it is desired to position the furnace higher on the wall add the difference
to the "A," "B" and "C" dimensions· Note: the vent opening is not in
the center of the furnace.

Locating Gas Supply
The gas line can enter the uni t either through the floor or outside wall, The
gas line opening should be made at this time. Location of the opening will
be determined by the position of floor joists and the valve and union used
for servicing.

Locate and cut wall opening. If there is insulation above the wall opening
(air inlet tube) a barrier should be installed above the wall opening (air
inlet tube) to prevent insulation from coming in contact with the air inlet
tube. The barrier must not penetrate into the 7 1/2" (19lmm) diameter
wall opening. Place the flat sm'face of the wall mounting bracket toward
the wail. Insert half round flange of wall mounting bracket into and at the
top of the wall opening. The half round flange of the wall mounting
bracket must be in contact wi th the sheetrock or wood at the top of the wall
opening. Level the wall mounting bracket in the wall opening.
On solid wall, when using wall studs for attachment of wall mounting
bracket, fasten wall mounting bracket to wall studs w~th (2) #10 x 1 1/2"
(38mm) screws provided and fasten (2) additionaI #10 x I I/2" (38mm)
screws provided through the wall mounting bracket and into the solid
wall.
On sheet rock, whe~ using wall studs for attachment of wall mounting
Nacket, fasten wall mounting bracket Io wall studs with (2) #10 x 1 1/2"
(38mm) screws provided and by using wall opening for access, fasten 2
additional #10 x 1 1/2" (38mm) screws and (2) Tinnerman nuts provided
through the wall mounting bracket and into the sheet rock.
Attaching Furnace To Wall Mounting Bracket
Hang furnace on wall mounting bracket by aligning (2) tabs on wall
mounting bracket with (2) slots located on inner casing top.
The inner casing bottom is to be fastened to the wall. On solid wall,
fasten inner casing bottom with (2) #10 x 1 1/2" (38mm) screws
provided. On sheet rock wall, fasten inner casing bottom with (2)
toggle bolts provided.
Cutting Vent Tubes
Th~s is the most important part of the installation. With the furnace
installed on wall the 6" (152mm) diameter air inlet tube and the 4"
(102mln) diameter flue outlet tube are to be marked and cut using the
following procedure.

I. Attach 6" (152mm) diameter air inlet tube onto the collar of air drop
assembly. Be sure 6" (I 52mm) diameter air inlet tube is placed as far
as possible onto the collar of the air drop assembly. Mark the 6"
(152mm) diameter air inlet tube I/2" (I 3mm) beyond the outside wall.
Remove 6" (152mm) diameter air inlet tube from collar of air drop
assembly.
2. Attach 4" (102mm) diameter flue outlet tube onto flue outlet collar on
combustion chamber. Be sure 4" (102mm) diameter flue outlet tube
is placed as far as possible onto the collar of flue outlet. Mark the 4"
(I 02mm) diameter flue outlet tube 2 I/2" (64mm) beyond the outside
wall. Remove 4" (102mm) diameter flue outlet tube from collar of
fluc~ outlet on combustion chamber.
3. Mark or wrap tape completely around the tubes at the marked points
to help in making a true cut. Do not crimp or enlarge tubes.
Installing Vent Assembly
1. Place provided caulking beneath the edge of the outside mounting
plate. Use additional caulking to correct uneven wall surface, such as
clapboard.
2. Attach 6" (I 52mm) diameter air inlet tube onto the collar of air
drop assembly. Attach caulked, outside mounting plate into the
6" (152mm) diameter air inlet tube. Position the outside mounting
plate so that 6" (152mm) diameter air inlet tube has a slight
do w n ward slope to the outside. The downward slope is necessary
to prevent the entry of rainwater. Attach outside mounting
plate to exterior wall with (4) #10 x I 1/2" (38mm)screws
provided.
3. Apply furnace cement to 4" (102mm) diameter flue outlet collar
on combustion chamber and to 4" (102mm) diameter collar on
vent cap. Attach 4" (102mm) diameter flue outlet tube onto flue
outlet collar on combustion chamber. Attach vent cap into the
4"(102mm) diameter flue outlet tube. Attach vent cap to outside
mounting plate with (3) #10 x 1/2" (13mm) screws provided.
4. Installation is completed.
Reassembly And Resealing Vent-Air Intake System
When vent-air intake system is removed for servicing the furnace,
the following steps will assure proper reassembly and resealing of
the vent-air intake assembly.
1... Remove old furnace cement from flue outlet collar on combustion
chamber and collar of vent cap. Remove old furnace cement tYom
both ends of 4" (102mm) diameter flue outlet tube.
2. Remove old caulking beneath the edge of the outside mounting
plate. Apply new caulking beneath the edge of the outside
mounting plate. Use additional caulking to correct uneven wall
surface, such as clapboard.
3. Attach 6" (152mm) diameter air inlet tube onto the collar of air
drop assembly. Attach caulked, outside mounting plate into the
6" (152mm) diameter air inlet tube. Positlon the outside mounting
plate so that 6" (152mm) diameter air inlet tube has a slight
downward slope to the outside. The downward slope is necessary
to prevent the entry of rainwater. Attach outside mounting
plate to exterior wall with (4) #10 x 1 I/2" (38mm) screws
provided.
4. Apply furnace cement to 4" (102mm) diameter flue outlet collar
on combustion chamber and to 4" (102mm) diameter collar on
vent cap. Attach 4" (102mm) diameter flue outlet tube onto flue
outlet collar on combustion chamber. Attach vent cap into the 4"
(102mm) diameter flue outlet tube. Attach vent cap to outside
mounting plate with (3) #10 x 1/2" (13mm) screws provided.
5. Reassembly and resealing rent-air intake system is completed.
Installing a Vent Near a Window Ledge,
Other Type of Projection or on Vinyl Siding
Direct vent furnaces are designed to be installed on a uniform outside
wall. When the wind comes from any angle (up, down or from either
side), it must hit the vent cap equally over both the air inlet and the flue
outlet portions of the vent. Any wall projection, such as a door or
window casing, which disturbs the wind on one side of the air inlet
section will result in back pressure on the flue section smothering the
flame and eventual pilot outage.
When the vent cap is to be installed on vinyl siding or it appears that
a projection within 6" (152mm) of any side of the air inlet section
could shield the att inlet section, the entire vent should be supported
away from the wall at least the distance of the projection. 2" x 4" (51 mm
x 102mm) framing whose outside dimensions match the overall
dimensions of the mounting plate is recommended. The 2" x 4"
(51 mm x 102mm) framing protects vinyl siding from possible warpage
or discoloration. All joints can then be sealed and painted. The wall
depth plus the additional depth of the 2" x 4" (51mm x 102mm)
framing should not exceed a total depth of 13" (330mm) for DV-25 and
DV-35. (See Figure 3)
Vinyl siding vent kit, DV-822, is available from Empire Comfort
Systems, Inc. The depth is 3" (76mm), which enables the vent cap
to be extended away from vinyl siding or projections. The wall depth
dus the additional 3" (76mm) depth of the vinyl siding vent cap
xtension should not exceed a total depth of 13" (330mm) for DV-25
ad DV-35. (See Figure 3a)
Warning: When vinyl siding vent kit, DV-822 or 2" x 4" (SImm
x t02mm) framing is added to an existing installation (furnace
is installed) do not attempt to add sections of pipe to the flue
outlet tube or air inlet tube. An air tight seal is required for both
tubes. Refer to Parts List, page 9 to order tubes.

Check ali local codes for requirements, espeuially for the size and type
of sas supply line required. On Natural gas lines less than 15' (4.58m)
long, use I/2" (13mm) pipe; on longer runs, use 3/4" (19mm) iron pipe
or equal On LP gas lines please consult LP gas supplier.
Ins~lling a New Main Gas Cock
Each appliance should have its own manual gas cock.
A manual main gas cock should be located in the vicinity of the unit.
Where none exists, or where its size or location is not adequate, contact
your local authorized installer for installation or relocation.
Compounds used on threaded joints of gas piping shall be resistant to the
action of liquefied petroleum gases. The gas lines must be checked for
leaks by the installer. This should be done with a soap solution watching
for bubbles on all exposed connections, and if unexposed, a pressure test
should be made.
Never use an exposed flame to check for leaks. Appliance must be
dis,cOnnected from piping at inlet of control valve and pipe capped or
plugged for pressure test. Never pressure test with appliance
connected; control valve will sustain damage!
A gas valve and ground joint union should be installed in the gas line
upstream of the gas control to aid in servicing. It is required by the
National Fuel Gas Code that a drip line be installed near the gas ~nlet. This
should consist of a vertical length of pipe tee connected into the gas line
that is capped on the bottom in which condensation and foreign particles
may collect.

The above connectors may be used if acceptable by the authority having
jurisdiction.
Pressure Testing of the Gas Supply System
1. To check the inlet pressure to the gas valve, a 1/8" (3mm) N.P.T.
plugged tapping, accessible for test gauge connection, must be placed
immediately upstream of the gas supply connection to the appliance.
2. The appliance and its individual shutoff valve must be disconnected
from the gas supply piping system during any pressure testing of that
system at test pressures in excess of 1/2 psig (3.5 kPa).
3. The appliance must be isolated from the gas supply piping system by
closing its individual manual shutoff valve during any pressure
testing of the gas supply piping system at test pressures equal to or less
than 1/2 psig (3.5 kPa).
Attention! If one of the procedures results in pressures in excess of 1/2
psig (14" w.c.) (3.5 kPa) on the appliance gas valve, it will result in a
hazardous condition.
Checking Manifold Pressure
Both Propane and Natural gas valves have a built-in pressure regulator in
the gas valve. Natural gas models will have a manifold pressure of
approximately 4.0" w,c, (.996kPa) at the valve outlet with the inlet
pressure to the valve from a minimum of 6.0" w.c. (1.494kPa) for the
purpose of input adjustment to a maximum of 7.0" w.c. (I.743kPa)
Propane gas models will have a manifold pressme approximately 10.0"
w.c. (2.49kPa) at the valve outlet with the inlet pressure to the vaIve fi'om

High Altitudes
For altitudes/elevations above 2,000 feet (610m), input ratings should
be reduced at the rate of 4 percent for each 1,000 (305m) feet above sea
level. Canadian High Altitudes for locations having an elevation
above mean sea level between 2,000 feet (61 Om) and 4,500 feet (1370m),
the manifold pressure is to be decreased from 4.0" w.c. (.996kPa) to 3.2"
w.c. (.796kPa) for Natural Gas and from 10.0" w.c. (2.49kPa) to 8.0"
w.c. (I.992kPa) for Propane Gas.
Piezo Pilot Ignitor Instructions
Depress ing the red button completely c au scs a spark to occur at the pilot.
This is a substitute for a match which requires opening the pilot hole
cover.
To light the pilot, it is important that the electrode be i/8" (3mm) from
the thermopile. The spark must occur at the point the burner flame hits
the thermopile. The end of the electrode will be md hot with the pilot on.
On a new installation with air in the gas line, it is suggested that a match
be used. The match will light the pilot faster than the piezo under this
condition.
Primary Air Adjustment (Figure 5)
An air adjustment bolt is located on the chamber support bottom. The
four inch (102mm) clearance between the furnace attd the floor allows
access to the air adjustment bolt. The air adjustment bolt is above the
rectangular opening on the inner casing bottom.
On Propane gas, if a whistling noise (resonation) occurs, screw air
adjustment bolt into the chamber support in order to reduce the amount
of primary air. If the whistling noise (resonation) is not eliminated
when the air adjustment bolt is screwed into the chamber support this
may indicate the air adjustment bolt is misaligned. Grasp air adjustment
bolt and pivot (push) air adjustment bolt away from yourself. Observe
the maln burner flame as you push air adjustment bolt and when the main
burner flame begins to develop a yellow flame, you should stop pushing
on the air adjustment bolt. Screw air adjustment bolt out of the chamber
support until the yellow flame on the main burner is eliminated. The air
adjustment bolt should now be properly aligned. The reduction in
primary air will soften the main burner flame and will eliminate the
whistling noise (resonation).
On Propane or Natural gas, if a yellow flame occurs, screw air
adjustment bolt out of the chamber support but do not completely
remove air adjustment bolt fi'om chamber support. The repositioning of
the air adjustment bolt will increase the amount of primary air. The
increase in primary air will sharpen the main burner flame and will
eliminate the yellow flame.

§ 100-240. Purpose.
The purpose of this Article is to reduce or minimize impacts of uses and buildings which do not
conform to the use or bulk requirements set forth~in this chapter, all uses and buildings that
become nonconforming by reason of any subsequent amendment to this chapter and all buildings
containing nonconforming uses.
§ 100-241. Nonconforming uses.
Except as provided hereinafter, nonconforming use of buildings or open land existing on the
effective date of this chapter or authorized by a building permit issued prior thereto, regardless of
change of title, possession or occupancy or right thereof, may be continued indefinitely, except
that such building or use:
A. Shall not be enlarged, altered, extended, reconstructed or restored or placed on a different
portion of the lot or parcel of land occupied by such use on the effective date of this chapter,
nor shall any external evidence of such use be increased by any means whatsoever.
B. Shall not be moved to another location where such use would be nonconforming.
C. Shall not be changed to another nonconforming use without approval by the Board of Appeals
and then only to a use which, in the opinion of the said Board, is of the same or of a
more-restrictive nature.
D. Shall not be changed back to a less-restrictive use if changed to a more-restrictive
nonconforming use.
E. Shall not be reestablished if such use has been changed to or replaced bY a c°nf°rming use'
F. Shall not be repaired or rebuilt unless the use is changed to a conforming use if the
nonconforming use is damaged by fire or other causes to the extent of fifty percent (50%) of
its fair value.
G. Whenever a nonconforming use of a building or premises has been discontinued for a period
of more than two (2) years or has been changed to a higher classification or to a conforming
use, anything in this Article to the contrary notwithstanding, the nonconforming use of such
building or premises shall no longer be permitted unless a variance therefor shall have been

A. Nothing in this Article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a nonconforming building containing a conforming use, provided that such
action does not create any new nonconformance or increase the degree of nonconformance
with regard to the regulations pertaining to such buildings.
B. Reconstruction of a damaged building.
(l) A nonconforming building containing a conforming use which has been damaged by fire
or other causes to the extent of more than fifty percent (50%) of its fair value shall not be
repaired or rebuilt unless such building is made substantially to conform to the height and
yard requirements of the Bulk Schedule.ENo)
(2) Application for a permit to build or restore the damaged portion of any building damaged
or destroyed as set forth in Subsection B(1) above shall be filed within one (1) year of the
date of such damage and shall be accompanied by plans for reconstruction which, as to
such portion, shall comply with the requirements set forth above. If such permit is issued,
it shall lapse one (1) year thereafter unless reconstruction in accordance with the
approved plans has been initiated.
§ 100-243. Nonconforming buildings with nonconforming uses. [Amended 10-19-1999 by
LL. No. 16-1999]
A. A nonconforming building containing a nonconforming use shall not be enlarged,
reconstructed or structurally altered or moved, except as set forth below, unless the use of
such building is changed to a conforming use.
(1) Nonresidential uses:
(a) Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a nonconforming or conforming nonresidential building with a
nonconforming nonresidential use or construction of an addition to existing buildings
or additional building on the premises, so long as said increase in size of the buildings
created by enlargement of the existing buildings or structures or by the construction
of a new and separate building or structure does not result in an increase in the
overall building footprint(s) of more than 15%, except that said increase shall not
exceed the applicable maximum lot coverage. In addition, all other setback and area
requirements shall apply.
(b) Nothing in this article shall be deemed to prevent the remodeling, reconstruction or

The owners of the above premises, Mr. and Mrs. Bloom,
are in the process of repairing the foundation of an
existing cottage due to termite damage. The building
inspectors stopped the repairs and directed the owners to
file for a building permit. Enclosed please find a
building permit, check for the fee, and a set of plans for
the repairs.
The inspector had questioned the repairs to the
cottage. He may not have been aware that the cottage had
a pre-certificate of occupancy, and the cottage had been
occupied by the previous family. The repairs are being
undertaken for the present owners to continue to use the
cottage. Enclosed please find the pre-certificate of
occupancy and an affidavit by the prior owner, Judge
Thomas P. Farley as to the use of the cottage.
We would respectfully request that this building
permit application be processed as soon as possible, the

BASIS OF APPEAL: Building Inspector's December 17, 1999 Notice of Disapproval, denying~.
applicant's request to amend Building Permit No. 26151Z to cover work in addition to the
foundation repair that was authorized under the Permit. The reason for denial is that the additional
work is a "substantial renovation" of the cottage in violation of Code section 100-243A, which
states that a nonconforming building with a nonconforming use shall not be "enlarged,
reconstructed, structurally altered or moved" unless the use becomes conforming.
RELIEF REQUESTED: Applicant requests authorization to carry out planned interior repairs to
the cottage, in order to eliminate termite and other insect infestation and to improve windows,
doors, heating and other features. Repair of the cottage foundation is permitted by Building Permit.
No. 26151Z and is not an issue here.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
(1) The cottage constitutes a second dwelling unit on the subject property and is therefore a
nonconforming use.
(2) After applicants purchased the property early in 1999, they undertook to replace the
cottage foundation. Building Permit No. 26151 was issued for this work. When termite and other
insect infestation was found in the cottage, interior paneling was tom out in order to clear the
infestation. Improvements to the windows, door, heating, and other features of the cottage were
planned as part of the work that resulted from the need to clear the infestation.
(3) Applicants sought to amend Building Permit No. 26151Z to cover the additional work, but
were denied. At a hearing on January 19, 2000, the head of the Building Department testified: (1)
that the term "substantial renovation" in the Notice of Disapproval means 'reconstruction,' which is
prohibited by Code Section 100-243A; (2) that the proposed work amounts to a "reconstruction"
because so much is being done at one time, whereas the separate elements of the project would
be permitted as normal maintenance under Section 100-245 if done separately over a pedod of
time.
(4) Testimony was given that applicant is not enlarging the cottage or changing the room
layout. The Board concludes that the work for which a building permit has been denied -- that is,

safe and usable and permitted under section 100-245, and that the concentration of this work into
