Dear Ivlr. Kerbs,
In response to your request for a freshwater wetlands determination for the property identified
below, the New York State Department of Environmental Conservation has determined that
the parcel is more than 100 feet from regulated freshwater wetlands. Therefore, no permit is
required under the Freshwater Wetlands Act (Article 24 of the New York State Environmental
Conservation Law).

This determination may be considered permanent and should, therefore, be retained along with

Dear Mr. Kerbs,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on March 24, 1999, regarding the
above matter:
WHEREAS, JON C. KERBS, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated March 3, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 24, 1999, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
JON C. KERBS, to clear property at 60' setback from the edge of
wetlands and maintain a non-turf, non-fertilized, no-disturbance
buffer area within that 60' and place a row of haybales on the
downward side of clearing line during construction of house.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear /Ir. Orlowski:
As per your request, I have conducted a review of the file and an inspecbon of the
abc, e referenced subdivision. The initial construction of this minor subdivision began back
in the late nineteen seventies and has been dormant with little or no work for most of the last
twenty (20) years. In September of 1993, an inspection was conducted by Melissa Spiro and
mi self. At that time, the property owner was informed that additional road improvements
w.' JId be required to bring the road up to the specifications that were in place when the
st ~division was approved.
The existing right-of-way is thirty feet wide and has been cleared of all trees and
evergrown brush. The road shoulders are generally rough graded and are reasonably
stabilized with grass and other vegetation. Drainage structures have als ~ b,- an added to the
road to prevent erosion, A catch basin was installed at the top of the ,~ill on the west W te
of the road at approximately 200 feet from sound view avenue. This [ ~sin was installer to
collect excess run-off from the road and pond at this location. A small culvert pipe also rJns
from this basin under the road to collect the run-off generated on th( east side of the new
road. The excess run-off collected in this new basin is then transmitted down the hill through
plastic drainage pipe to a bubble basin that disipates the energy and allows the water to flow
through the existing drainage ditch and into the culvert running under sound view avenue,
The road has been fine graded and a two (2") inch lift of 3/4" blue stone has been
added to provide a uniform and stable wearing surface and it has been placed and
compacetd in a satisfactory manner.
