Box 617 Cutchogue, NY 11935 Re: FRANK CICHANOWICZ SCTM#116-7-1 Dear Mr. Fitzgerald: The following action was ,taken by the Board of Town Trustees during its regular meeting held on February 24, 2000 regarding the above matter: WHEREAS, Proper-T Permit Services on behalf of FRANK CICHANOWICZ applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the. Town of Southold, application dated January 3, 2000, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 24, 2000 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter .97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of FRANK CICHANOWICZ to construct a single-family dwelling with on-site sewage and disposal and public water with the condition that hay bales be placed down during construction along the landward edge of the footpath, which is the boundary of the buffer zone, all in accordance with survey last revised 2/18/00 . BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Ehlers dated 11/2/99 last revised 12/23/99 is beyond Article 25 (Tidal Wetlands) jurisdiction. Therefore; in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required under the Tidal Wetlands Act . Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a 'permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project.
