After visiting the above-referenced site on May 27, 2000, 1 noted all existing construction,
including three sets of stairs leading to a deck. It is my conclusion that there is no need for
a variance for this project because applicant is proposing construction in-kind and in-place
without changes to the existing construction.

Dear Mr. Anderson:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27 , 1999 regarding
the above matter:
WHEREAS , Suffolk Environmental Consulting, Inc . on behalf of
RUTH E . MILLER applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated October 1, 1999 , and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public: Hearing was held by the Town Trustees with
respect to said application on October 27, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
RUTH E . MILLER to construct a 71X 22 ' deck addition, including a
7 ' X 9 ' gazebo, and repair/replace existing wood deck and stairs
in kind.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Ms. Miller:
Based on the information you have submitted, the New York State
Department of Environmental Conservation has determined that:
The property landward of the bulkhead greater than 100 feet in
length constructed prior to 8/20/77, as evidenced on Aerographics
Corp. Aerial photo (exposure#77-1999) and confirmed on Department
Infra-Red photo#820, is beyond Article 25 (Tidal Wetlands)
jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act . Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you"of
the responsibility of obtaining any necessary permits--or approvals
from other agencies. 7

1 . An undesirable change will NOT be produced in the character of
the neighborhood or a detriment. to nearby properties, if. granted
BECAUSE:
Yes, the proposed deck addition will be completely concealed from the road, as well as being
effectively buffered from the adjacent properties by landscape screening. In addition, the majority
of the properties within the surrounding area have decks of similar if not larger size which have
not caused an undesirable change in the character of the neighborhood.
2 . The benefit sought by the applicant CANNOT be achieved by some
method, feasible for the applicant to pursue, other than an area
variance BECAUSE :
The location of the existing dwelling restricts any practical alternative locations for the proposed
deck addition.
3 . The amount of relief requested is not substantial BECAUSE
The variance required is for a proposed attached deck which, if it could be sited at grade. would
not require variance relief.
4 . The variance will NOT have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or
district BECAUSE
Again, the location of the proposed deck addition will be effectively screened from both the road
and adjoining properties. In addition, the majority of the neighboring properties have decks of
similar sizes and, in some cases, are situated.even closer to the tidal wetlands than this
application's proposal, which have not resulted in any adverse environmental effects whatsoever.
5 . Has the alleged difficulty been self-created?
( ) Yes .

6 . This is the minimum that is necessary and adequate, and at the
same time preserve and protect the character of the neighborhood
