Present were: John Stein, Chairperson Carol Brown, Member Caroline Burghardt, Member Maggie Merrill, Member Shannon Wright, Member Inga Van Eysden, Member— via Zoom Lauren Standish, Secretary Brian Mealy, Town Board Liaison Liz Gillooly, Trustee Liaison Absent was: John Chandler, Member CALL TO ORDER John Stein called the meeting to order at 4:50PM. REPORTS John Stein attended the Board of Trustees meeting held on Wed., March 15, 2023. The application made on behalf of M&R North Fork Properties was unanimously approved and 6 out of the 8 applications made on behalf of Silver Sands Holdings, LLC were approved. CLIMATE SMART COMMUNITIES NEW BUSINESS 2 Carol Brown requested an update on her End of Year Report. She recommended the report be submitted to the Town Board so other boards an can see what the CAC has been working on as a whole. John Stein questioned some of the numbers on the spreadsheet and suggested she merge the stats with those of the Trustees. Carol will follow-up with the Trustees office and obtain copies of their monthly reports. APPROVAL OF MINUTES Moved by Carol Brown, seconded by Caroline Burghardt, to Approve the Minutes of March 8, 2023. RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS USDHS PLUM ISLAND DISEASE CENTER for a 10-year maintenance dredge permit for ' the Plum Island Harbor. The dredging is needed to allow the continued use of the harbor for passenger and freight ferries essential to the operation of the facility. Spoils are proposed for use as beach/dune nourishment and placed directly on the shoreline south of the harbor to the location known as Pine Point. An estimated yearly maintenance dredge would generate up to 4,400 cy. of spoils. Located: Plum Island. SCTM#132-1-30 The CAC did not make an inspection, therefore no recommendation was made. Moved by Carol Brown, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of US DEPT. OF HOMELAND SECURITY for a 10-year maintenance dredge permit for the Orient Point Harbor to allow the continued use of the harbor for passenger and freight ferries essential to the operation of the facility. Hydraulically dredge Orient Point Harbor to an over dredge depth of-17.63 ft. or 16' MLW. Spoils are proposed for use as beach nourishment at Orient Point County Park. Up to 9,200 cy. of spoils is anticipated during the first maintenance dredge event with a total not to exceed 29,000 cy. over ten years. Located: 40550 Main Rd., Orient. Located: 14909 Route 25, East Marion. SCTM#23-1-2.8 Inspected by: Carol Brown, Inga Van Eysden 3 The CAC Supports the application with non-toxic materials that do not degrade over time. Vote of Council: Ayes: All Motion Carried Moved by Maggie Merrill, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of KENNETH WIEDEMAN for the installation of two 6"X 6" CCA timber wales on top of existing bulkhead to raise height of bulkhead, install new 2"X 8" untreated timber top cap on existing bulkhead, install new 4"X 6" CCA timber vertical batter boards along seaward face of existing bulkhead spaced 6" between boards to act as wave break, install 6'X 12' X 12" tall stainless steel gabion basket seaward of bulkhead for entire length to act as stone armor bedding and install rip-rap sizing from 204 tons along seaward face of bulkhead to armor existing bulkhead. Installation of a 6'X 12'X 12" tall stainless steel gabion basket landward' of existing bulkhead and fill with crushed gravel and set flush with top cap to act as a splash pad for wave action, install 40 cy. of clean sand fill from upland sources to fortify the new gabions and re-nourish the rear yard. Remove existing asphalt and concrete driveway and replace with new 10'X 45' long concrete driveway in same location as existing. Located: 55705 North Rd., Greenport. SCTM#44-1-14 Inspected by: John Stein, Caroline Burghardt, Maggie Merrill, Inga Van Eysden, Carol Brown The CAC Supports the application for the bulkhead repairs, as applied for. The CAC recommends a permeable driveway with drywells at the bottom to address the drainage. Vote of Council: Ayes: Maggie Merrill, Inga Van Eysden, Shannon Wright, Carol Brown, Caroline Burghardt Recused: John Stein Motion Carried CONKLING ADVISORS, LLC, Brick Cove Marina for maintenance dredging of the Sage Basin inlet and southeasterly area of the Brick Cove Marina basin and restoration and 4 -stabilization of the peninsula that flanks the east side of the inlet. (See complete project description updated February 2023.) Located: 1760 Sage Blvd., Greenport. SCTM#57-1-38.3 The CAC did not review this application. The Board of Trustees did not require an updated CAC or LWRP report since this is a lesser project description than originally proposed in 2021 and reviewed by the CAC on September 8, 2021. Moved by Maggie Merrill, seconded by Shannon Wright, it was RESOLVED to NOT SUPPORT the application of GIL BEN-AMI & TRACY BEN-AMI for the proposed demolition of the existing residential foundation and the construction of a new residence and I/A septic system. Existing northern retaining wall to remain, proposed southern retaining wall along southerly property line; proposed underground drywells for structure run-off and driveway run-off, and proposed 15' wide non-turf buffer. Located: 1800 Hyatt Rd., Southold. SCTM#50-1-4 Inspected by: Carol Brown, John Stein, Caroline Burghardt, Maggie Merrill The CAC does Not Support the application as submitted. The proposed structures are not compliant with Ch.275-Setbacks and should be located more than 100' from the top of the bluff. Vote of Council: Ayes: All' Motion Carried Moved by John Stein, seconded by Caroline Burghardt, it was RESOLVED to NOT SUPPORT the application of ROBERTS PREMIER DEVELOMENT LLC to construct a 16'X 32' in-ground swimming pool with pool equipment and pool fence to code. Located: 910 Glenn Rd., Southold. SCTM#78-2-27 Inspected by: John Stein, Caroline Burghardt, Maggie Merrill The CAC does Not Support the application with hand-written notes on the survey, and requests a final site plan with the proposed improvements. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by John Stein, it was RESOVLED to SUPPORT the application of ABBY ROSMARIN & DAVID ROSS to remove existing 12.3X 17.2 on grade patio and establish a.non-turf area 24'X 19' with crushed stone on sand and on grade. Cut down existing landscape wall down to 24" height to delineate area north and east of the wall as vegetated area. Relocate the east side of 24" tall wall a minimum of 15' from the property line. Non-disturbance area 1 5 designated seaward from "top of bluff' on filed map. 25' non-turf buffer landward of non- disturbance buffer (@ 15' of the 25' contains existing vegetation to remain). Located: 640 Lloyds Lane, Mattituck. SCTM#99-3-4.1 Inspected by: John Stein, Caroline Burghardt, Maggie Merrill Vote of Council: Ayes: All Motion Carried LINCOLN FRANK to construct a 90'X 4' fixed wood pile and timber pier in which 69' is waterward on the MHW and 77' waterward of the apparent high water line, including rails, and water/electric utilities, tie-of piles and two ladders. Located: 2736 Crescent Ave., Fishers Island. SCTM#6-1-8' The CAC did not make an inspection, therefore no recommendation was made. FI WHITE HOUSE LLC to raze and dispose of existing single-family dwelling; existing septic system to be pumped and removed or filled with sand; construct a new single- family dwelling with appurtenances, leaders and gutters; install two (2) 8'X 8' drywells for roof run-off; install new I/A OWTS system; install new water service and remove and replace existing paved driveway. Located: 4923 North Hill Rd., Fishers Island. SCTM#6-2-8 The CAC did not make an inspection, therefore no recommendation was made. BRADFORD R. BURNHAM to raze and dispose of existing single-family dwelling; construct a new single-family dwelling with leaders and gutters; install six 8'X 6' drywells for roof run-off; install an I/A OWTS system; construct garage; remove and replace water service; remove existing gravel drive and restore with loam and seed and install new gravel driveway. Located: Penninsula Road, Fishers Island. SCTM#10-4-13.10 The CAC did not make an inspection, therefore no recommendation was made. RECOMMENDATIONS —APPLICATIONS TO AMEND WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Carol Brown, seconded by Inga Van Eysden, it was RESOLVED to NOT SUPPORT the application of BRANKO & MARGARET PEROS to Amend Wetland Permit#7705 to add the construction of a garage. Located: 815 Rabbit Lane, East Marion. SCTM#31-17-18 Inspected by: Inga Van Eysden, Carol Brown 6 + u , The CAC does-Not Support the amended side yard setback and increased lot coverage: The CAC'Supports the in-kind construction only. Vote of Council: Ayes: All Motion Carried Shannon Wright will attend the next Board of Trustees meeting scheduled for Wed., April 19, 2023. The next meeting of the Conservation Advisory Council will be held on Wed., May 10, 2023 at 4:30PM in the Conference Room.
