Date of Public Hearing: April 6, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is a 14,744 sq. ft. waterfront parcel located on the North Road (a/k/a County Road 48) in Southold. The lot is wide along the Sound and road, but very shallow at 63.28 feet along the east side. The property is improved with a 2- story frame house with open wooden decks as shown on the January 3, 2000 survey and bulkheading, returns and wood retaining walls in several areas. BASIS OF APPEAL - Building Inspector's Notices of Disapproval dated January 24, 2000, denying an application for a permit to locate a six-foot deep extension of the existing deck, for the entire length of the deck. The application was disapproved for the reasons that it will exceed the 20% lot coverage limitation of the Code and that it is located at less than 100 feet from the top of the bluff or bank of the Long Island Sound. Code Sections: Article XXIII, Section 100-239A(2) and Article IIIA, Section 100-30A(13). RELIEF REQUESTED: Variance for a 6' x 67' deck addition at 8+- ft. from the bulkhead at mean highwater of the L.I. Sound. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. The property is very shallow, and the house is very close to the bulkhead. No deck addition of any sort can be constructed without a variance for lot line or bulkhead setback. 2. The proposed deck addition is modest in scale. According to the Building Inspector's calculations, the addition adds 402 sq. ft., of which 255 sq. ft. are in excess of the allowable 20% lot coverage, bringing total coverage to 21.6%. The addition will not add massively to the appearance of the house and will in any event be located on the water side where it is not visible from the road. The deck addition will not add in any significant way to the visual crowdedness of the neighborhood, and will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. 3. On July 21, 1999 the Town Trustees issued approval for an Amended Permit to extend the existing deck out approximately six feet. 4.
