January 13, 2000, February 3, 2000: March 2. 2000 FINDINGS OF FACT PROPERTYI FACTS(OESCRIPTION The subject property comprises 57,115 sq. ft in the R-40 Residential Zone Distract with 171 feet on Peconic Bay on the south and depths of approximately 325 feet on tete west and 348 feet on the east The property consists of part of Lot Nos. 7, 6 and 8 on the Map Of Marratooka Park filed on November 1, 1905 as Map#450. It is reached by a right- of-way from Part Avenue, which right-ot-way continues over the easterly 25 feet of the property all the way to Peconic Bay. An updated September 13 1999 survey by Joseph Ingagno shows a house with The following approximately setbacks at the closest points: 84 feet from the lower (outer) bUl"ad, 35 feet from the westerly property line, 32 feet from the right-of-way along the east side, acid 180 feet from the noriherty property line. Two accessory buildings are located in the front yard ao ng the west side of the property. BASIS OF APPLICATION: Building Inspectors November 8, 1999 Notice of Disapproval, denying a building pirmit application for a 20 ft. by 40 it, in, swimming pool, for the reasons that under Seetipn 100-33 (ref. 100-30A,4 for R-40 Zone) requires that acwssury buildings and structures or other accessory uses be located in the rear yard. AREA VARI �ryQg RELIEF REQUESTED: Applicants originally requested authorization to locate the pool in �be side yard, 12 feet from the westerly property tine. Following the first hearing, applicants submitted a February 3, 2000 revised pian for a narrower pool, with construction at 16 feet at its closest point from the westerly property tine. A$ONS FOR BOARD ACTION DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, Ute Board makes the following findings: (1) Appli is state that it is impracligl to locate the pool u7 either the rear yard or front yard. The newly built do facing the rear yard and Peconic Bay measures, at the closest points, 84 feet from the lower bulkhead and only 52 feet from the top of the bluff. This is too shallow to accommodate the 75-foot setback from the bulkhead required by Code Section 109-239.48. Applicants state that it is impractical to locate the pool structure in the front yard because of the need to relocate the driveway ano to destroy trees. Applicants further state that the pool must be in the side yard for reasons of chlid safety. (2) Applic2irttsrevised February 3, 2000 plan will riot produce an undesirable change in the character ofthe neighborhood or detriment to nearby properties because it places the pool about as far from the westerly property line as is feasible. (3) There is no evidence that the action set forth below will have an adverse effect or impact on physical or environmental conditions. The pool is proposed more than 75 feet from bulkhead. (4) Grant of the requested variance is the minimum necessary and adequate to enable applicants to enjoy the benefit of a swimming pool located in the west side yard, while preserving and protecting the character of the neighborhood, and the health, safety, and welfare of the community. RESOLUTION/ACTION: On motion by Chairman Goahringer, seconded by Member Dinizio, it was RESOLVED, to GRANT aitemetve relief for the location of a pool with a minimum 20 it at the northwest comer of the pool to the side property line and a minimum 1(5 ft. at the southwest comer, at its closest points, subject to the CONDITION that owner shall plant 3-5 ft high hedge or similar screening on the west side of the pool and extending from the garage past the pool, as a minimum (as agreed by applicant). January 13, 2000; February 3, 2000; March 2,2000 FINDINgg QF FACT PROPERTYIFACTS/DESCRIPTION The subject property comprises 57,115 sq.'ft in the R-40 Residential zone District with 171 feet on Peconic Bay on the south and depths of approximately 325 feet on the west and 348 feet on the east The property consists of part of Lot Nos. 7, 6 and 8 on the Map Of Marratooka Paris filed on November 1, 1905 as Map#450. It is reached by a right- of-way from Fart Avenue, which right-of-way continues over the easterly 25 feet of the property all the way to Peconic Bay. An updated September 13 1999 survey by Joseph Ingegno shows a house witha following approximately setbacks at the closest points: 84 feet from the lower (outer) bulkhead, 36 feet from the westerly property line, 32 feet from the right-of-way along the east side, and 180 feet from the northerly property line. Two accessory buildings are located in the front yard along the west side of the property. BASIS OF AlPPLICATION: Building Inspectcl's November B, 1999 Notice of Disapproval, denying a building permit application for a 20 ft. by 40 ft. in-ground swimming pool, for the reasons that under Section 10033 (ref. 100-30AA for R-40 Zone) requires that accessory buildings and structures or other accessory uses be located in the rear yard. AREA VA�INN RELIEF REQUESTED: Applicants originally requested authorization to locate the pool ince side yard, 12 feet from the westariy property line. Following the first hearing, applicants submitted a February 3, 2000 revised plan for a narrower pool, with const-uction at 16 feet at its closest point from the westerly property fine. REASONS FOR R_QARD ACTION QESGRi6ED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicants state that it is Impractical to locate the pool In either the rear yard or front yard. The newly built deck facing the rear yard and Peconic Bay measures, at the closest points, 84 feet from the lower bulkhead and only 52 feet from the top of the bluff. This is too shallow to accommodate the 75-foot setback from the bulkhead required by Code Section 109-239.4B. Applicants state that it is impraocal to locate the pool structure in the front yard because of the need to relocate the driveway an' to destroy trees. Applicants further state that the pool must be in the side yard for reasons of clgiild safety.
