The proposed construction on this non-conforming 20,881 square foot lot in the R-40 District is not permitted pursuant to Section 280-15, which states that accessory buildings shall be located in the required rear yard. An existing accessory one car garage will remain in the front yard, and the proposed accessory garage will be partially located in the front yard. The site plan drawing by Mark K. Schwartz, Architect shows a new two-story wood frame residence of 2,369.1 square feet with a detached 3 car garage with a second story with a workshop and a have bath measuring 1,747.5 square feet. The plan's site data indicates that the old septic system that will be abandoned and a new septic system installed. New leaders and gutters will be installed as well as drywells installed for both the new residence and the proposed three car garage. ADDITIONAL INFORMATION: At the Public Hearing held on December 6, 2018 several neighbors to the subject property gave testimony and several letters were received from residents asking the Board to consider the large scope of the project and objected to the large three-car, two story garage. They reasoned that the improvements would be too large and would dramatically change the character of the neighborhood. One neighbor expressed that the location of the garage would cause a problem of headlights shining into his home when cars pull into the garage. Additionally, the neighbors were concerned with too many trees being cut to accommodate the large home and the garage,which would lead to more flooding in the area, as evidenced by photographs that were submitted; a situation already occurring in the neighborhood. The existing one car garage has a pre-existing Certificate of Occupancy issued on November 3, 1995 to the previous owners. The applicant was asked to update the site plan, (pages S-I & S-2), in order to correct information relating to front yard setback averaging. A site plan prepared by Mark Schwartz,Architect was revised on December 6,2018 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 6,2018 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The area and community of Fleets Neck is comprised of mostly smaller homes and seasonal cottages. While the proposed home will be larger than most nearby homes the large size of the proposed three (3) car two story garage with a workshop and half bath along with the renovation of the existing one car garage on a small property exceeds what can practically be built on the lot. There is no evidence that there are multiple garages in nonconforming locations in the surrounding area. 2. Town Law 4267-b(30)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The size of the garage could be scaled down and moved to a conforming location. The existing garage has room for one car. Moreover, the Board did not receive any information as to the intended use of the second floor workshop in the proposed three car garage. 3. Town Law 4267-b(3)(b)(3). The variances granted herein is mathematically substantial, both representing 100% relief from the code for having a non-permitted front yard location. However, the existing one car garage already has a Certificate of Occupancy and will only undergo renovation to conform to the look of the new residence. Evidence has been submitted to suggest that the requested variances in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The neighbors and residents of the area wrote letters and testified at the Public Hearing that they object to such a large project in their community and such a large project would be detrimental to the character of the community as a whole. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitation on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a two story accessory garage with a workshop and half bath while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. After nearly two and a half years of working with our architect, navigating the Town of Southold permitting process and awaiting a hearing at the Zoning Board of Appeals, we finally received a complete stamped set of approved plans from the Town of Southold Building Department in December of 2019. On January 17,2020, we razed the cottage we purchased 24 years prior and broke ground to construct our retirement home. .Our contractors built the house and garage exactly as per the Southold Building Department approved plans. The second-floor garage plan clearly indicated its use as storage on the approved plan, and as such the insulation and electrical was installed by the various contractors in accordance with the approved plan. Upon inspection of the insulation by the building inspector, Mr. John Jarski instructed us not to finish the second floor with the installation of sheetrock because he felt in his opinion we would need to go back to the Zoning Board of Appeals to receive approval for this level of finish for this space; an approval that we understood we had already received as clearly noted of the approved plan. Based on Mr. Jarski's recommendation, although clearly included on the approved plan,we did not install the sheetrock. After much deliberation and extensive discussions with our architect and engineer,we decided that we would continue our effort to build as approved by the town. The only deviation from the approved set,of plans was the installation of a ductless split HVAC system. This system was installed in the upstairs garage space to ensure we have the ability to have conditioned storage to protect thousands of photographs of my extended family dating back to the late 1800s,as well as other valuable possessions that were passed down from my parents, grandparents and great grandparents. I was simply not aware that conditioning this space with a small ductless split would be an issue upon final inspection,and honestly had no knowledge that there was a prohibition on conditioning storage space. In fact,despite my extensive search, I was unable to find any such prohibition on the Building Department's posting of Town Codes(or state codes). Upon final inspection on April 30, 2021,Mr.Jarski inspected the upstairs of the garage and asked why we had not sheetrocked the space. I reminded him that we did not sheetrock the space because he instructed us not to sheetrock the space during the insulation inspection. He pointed out that although the plan indicated that we were approved to sheetrock and electrify the upstairs,he explained that in his opinion the notation regarding the approval of the installation of sheetrock and insulation on the approved plan was approved in error by the Southold Building Department. Mr. Jarski's cited three items on the inspection sheet: 1)Relief Valve Extension(hot water heater) [completed]; 2)Electrical Certificate [completed]; 3)Amend plans for accessory garage to include mini- split, HVAC details, and level of finish and usage.At that time, I did not have the Manuals S or J completed for the garage HVAC. I subsequently had all that work completed including the manuals and submitted all photos&documents to the Building Department for approval. Before leaving,Mr. Jarski indicated that he could not approve the upstairs portion of the garage for a Certificate of Occupancy. He said the only way he could approve the CO is if we removed all of the insulation and the HVAC from the second floor, which would prove to be a costly mistake to me made on behalf of the Southold Building Department. I once again raised the fact that the only deviation from the permitted and approved plan was the installation of the HVAC. I stressed the fact that the approved plan clearly indicated this level of finish on the second floor and was built precisely as per the approved plan. He reiterated that the plan was approved in error, and that despite the error,he could not approve it. I trust Mr. Jarski is simply exercising his responsibility to be a thorough builder inspector, however, it should be stressed once again that we spent significant time and money constructing this structure as per the specified plans approved by the Town of Southold Building Department.Mr. Jarski emphasized that he'd rather not have me undo the work already completed,however, a CO for this structure could not be granted in its current state. He once again recommended removing the insulation and HVAC, and once those tasks were completed, he could issue an approval.As a possible solution, he recommended we schedule another hearing with Town of Southold Zoning Board of Appeals and file application to make the space an accessory apartment. He explained that approach would require removing the downstairs garage bathroom that was just installed as per the approved plan (a costly installation)and relocating it upstairs for use in a proposed accessory apartment. While that approach may seem like a way to resolve this dilemma, an accessory apartment is neither within our plan nor budget. We have toiled more than a year with starts and stops of construction due to COVID restrictions, excessive lead times on materials and escalating costs,which have well exceeded the budgeted amounts for the construction of our home. To say the least, I am frustrated and disappointed to have completed this project as per the town-approved plans to now be faced with this particular issue after such a prolonged design/planning/approval process, not to mention the unprecedented pandemic and challenges of the past year. I respectfully request your consideration for the approval of our garage as constructed since it complies with current approved Town of South Building Department Construction plan. If there are specific local, state or federal codes prohibiting the conditioning of storage space, I respectfully request I be made aware of these codes so I can review the text and case law surrounding the prohibition. I feel compelled to emphasize that any modifications to the Town-approved/as-constructed plan would result in significant time lost and inordinate additional expense.
