The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, April 19, 2023:
WHEREAS, BRANIKO & MARGARET P,EROS applied to the Southold Town Trustees
for an Amendment to Wetland Permit#10058 under the provisions of Chapter 275 of
the Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated February 17, 2023, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found to be Consistent with the Local Waterfront Revitalization Program policy
standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 19, 2023, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit#10066 to demolish existing cottage and construct a new 14'x22' one-
story garage in same location; with the condition that the shed be removed; and as
depicted on the survey prepared by Michael W. Minto, L.S.P.C., received on February
17, 2023, and stamped approved on April 19, 2023.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.

County,Administrative Code Sections A 14-14 thrrr A 14-25 and"the Suffolk County Department of Planning issued
its reply dated august $, 2022 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETER:MINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards.The LWRP Coordinator issued a recommendation dated November 28,2022.Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department,as wcll as the records available,
it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is
INCONSISTENT with the LWRP Policy 4.1 based on the following:
The single-family residence does not require a location on the coast.
The setback relief requested indicated that the lot is being overdeveloped in an Environmentally
Sensitive Coastal area.
The structure is located within FEMA flood zone AE EL 6. The proposed 22 percent lot coverage
on the parcel is contrary to preventing loss to structure in hazardous area. The expansion and
addition of structures within these areas are subject to repetitive loss from surges and flooding and
should be avoided and/or minimized,
It is recommended as a mitigation measure that a new I/A sanitary system be installed as approved by the Suffolk
County Health Department to assist in avoiding any adverse environmental impacts, and would therefore deem the
action as CONSISTENT with LWRP Policies.
PROPI:,R"I"Y F .CT /DESCRIPTIOI : The subject property is a 6,7'80 square foot parcel located in the Residential
R-40 Zoning District. The northerly property Tine measures 50.00 feet and is adjacent to Lake Marion,the easterly

property line measures 136.00 feet, the southerly property line measures 50.00 feet and is adjjacent to Rabbit Lane
and the westerly property line measures 136.00 feet. The parcel is improved with a two-story frame residence.
Currently,there is an existing cottage in the front yard that will be removed and a proposed new one-car garage will
be built in its place. There is an 8.3 ft.by 8.1 ft.shed in the rear of the property in the northwest comer as shown on
the survey map prepared by Michael W. Minto,.LS,PC and revised June 2022.
BASIS OF APPLICATION: Request for Variances Article 111, from Section 280-15; Article XXIII, Section 280-
724,and the Building Inspector's June 3,2022 Notice of Disapproval based on an application for a permit to construct
second floor additions to an existing single-family dwelling and to construct an accessory garage,at; 1)the accessory
garage is located less than the code required minimum front yard setback of 35 feet; 2) the addition to the single-
family dwelling is located less than the code required minimum side yard setback of 10 feet; 3)more than the code
permitted maximum lot coverage of 20%; located at : 815 Rabbit Lane(Adj. to Lake Marion), East Marion, NY.

RELIEF REQUESTED: The applicant requests variances to construct second floor additions to an existing two-
story single-family dwelling measuring 2.7 ft. from the side yard property line where the code requires a minimum
of 10 feet, and to construct an accessory garage 22 feet from the front yard property line where the code requires a
minimum of 35 feet. Additionally,the proposed construction will result in 22%lot coverage where the code permits
a maximum of 20%. The proposed construction,on this non-conforming 6,780 square foot parcel in the Residential
R-40 Zoning District, is not permitted pursuant to Article XXIII, Section 280-124 which states: lots measuring less
than 20,000 square feet in total size require minimum front yard setback of 35 feet,a minimum side yard setback of
10 feet and further states lot coverage be a maximum of 20%.
DDITIONAL INFORMATION:. The Southold Board of Trustees approved a Wetland Permit No. 10068 on
February 16,2022 for the additions as applied for. The permit was conditioned that the applicant must establish and
perpetually maintain a 10 ft. wide non-disturbance buffer and a 10 ft. non-turf buffer tunning along the waterline as
depicted on the survey map prepared by Michael W. Minto, LS, PC. The applicant will be moving the proposed
garage back toward the dwelling by 7 feet so it will be further back from Rabbit Lane than the existing shed and
planter in the (cont yard that will be removed. The applicant is also willing to remove the small shed in the rear
yard. A New York State Department of Environmental Conservation Permit was issued to the applicant approving
the additions to the residence. Permit ID 1-4738-04752100001. No neighbor spoke or wrote-in favor or in opposition
to this application.
FNDrNgs_oFFAcT/-REAsONs FOR BQ_ARR-AcTION
The Zoning Board of Appeals held a public hearing on this application on December 1,2022 at which time written
and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property
and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law §267-bob)(1). Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. This is an old established waterfront community with many
small cottages that have been remodeled and enlarged over the years. The applicant is staying within the established
footprint of the dwelling.The applicant wishes to remove the present second-story and construct a new second-story
with a new 6.4 ft.x 11.2 ft.balcony. They also plan to remove the north wall on the first floor in order to install new
sliding doors. The existing cottage in the front yard will be demolished and a one car garage will be built 22 feet
from the front yard lot line. The new Site Plan drawings submitted by Terry B. Porter,Architect and dated May 12,
2022 show the remodeled dwelling will now have three bedrooms on the second floor with two bathrooms and the
first floor will have one full bathroom.The size of the proposed dwelling is in keeping with the size of other renovated
two-story dwellings on Rabbit Lane. Accessory garages in front yards with non-conforming setbacks are also

common on both sides of Rabbit Lane.The existing dwelling is closest to the easterly property line and the property
to the east is undeveloped.Therefore,an enlarged second story will have little to no impact on an adjacent neighbor.
2. Town Law 267-b 3 b 2 . The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue,other than an area variance. Due to the size of the lot and the pre-existing non-conforming,
side yard setback of the existing dwelling,further expansion would not be possible without variance relief. .
3. Town Law '267-b 3 b 3 ,. The variances granted herein are mathematically substantial,representing 37%relief
for the front yard setback of the proposed accessory garage; 73% relief for the side yard setback for the existing
dwelling,and 10%relief for the excessive lot coverage. However,the applicant is moving the proposed garage back
7 feet and has also proposed to remove the small shed in the rear yard which will decrease the lot coverage.
4. Town Law §267-bQJQ2A4A.,No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law 5267-bQ(b)(n. The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. "Down Lawn `267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of addition sto the dwelling and a new one car garage while preserving and protecting
the character of the neighborhood and the health,safety and welfare of the community.
RESOLUTION OI"UM,BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-B, motion was offered by Member Acampora seconded by Member Dantes, and duly carried,
to
GRANT the variances as applied for, and shown on the survey map prepared by Michael W. Minto, LS, and last
revised June 2022, and the Building Plans(including Demolition and Elevation Plans)prepared by Terry B. Porter,
Architect and last revised August 1,2022.
SXJBJIECT TO TIRE FOLLOWING CONDITIONS.
1. The applicant shall install a Suffolk County Board of Health approved Innovative Alternative Onsite
Wastewater Treatment System(UA OWTS).
2. The applicant shall adhere to the conditions set forth by the Southold Town Board of Trustees
in Permit No. 10068, dated February 16,2022 by establishing and perpetually maintaining a
10 ft. wide non-disturbance buffer and a 10 ft.wide non-turf buffer running along the
waterline as shown on the survey map.
3. To reduce the proposed lot coverage, the applicant shall remove the as built 8.3 ft. x 8.1 ft.
shed located in the rear yard from the property
This approval shall not be deemed effective until the required conditions have been met At the discretion of
the Board of Appeals,failure to comply with the above conditions may render this decision null and
void

The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or v possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback
or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
IMPORTANT°TIME LIMITS ON THIS APPROVAL
Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three
(3)years from the date such variance was granted. The Board of Appeals may,upon written
request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one
(1)year terms.IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE

2. Work Area Limits Any work, disturbance, and or storage of construction materials shall be
confined to existing lawn or developed areas.
3. Materials Disposed at Upland. Site Any demolition debris, excess construction materials, and./or
excess excavated materials shall be immediately and completely disposed of on an approved upland site
more than 100 feet from any regulated freshwater wetland. These materials shall, be suitably stabilized
so as not to re-enter any water body, wetland, or wetland adjacent area.

is sulajcct to inspection at reasonable hours and intervals by air authorized representative of the
Department of Environmental Conservation (the Department) to determine whether the penrritice is
complying with this permit and the ECL. Such representative may order the work suspended pursuant
to ECL 71- 0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced naps, drawings and special conditions, must be available
for inspection by the Department at all times at the proJect site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. relationship of this Permit to Other Department Orders, and Determinations Unless expressly
provided for by the Department, issuance of this pernrit does riot modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms,conditions or requirements
contained in such order or determination.
3. Applicatioaus For Permit Renewals,,Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Such application must include any "orrns or supplemental information the Department requires.
Any renewal, rriodifkation or transfer granted by the Department must be in writing.. Submission of

4. Submission of Renewal Application The permittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Freshwater Wetlands.
. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revolve this per-rit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;

Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on rellru a 16 2022,and
in consideration of application fee in the sura of$250.00 pard by Branlco & Margaret Peros and subject to the
Terns and Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and permits
the following:
Wetland Permit for the existing one and one-half story dwelling with a 1,200sq.ft.footprint,
existing 8'x12' (98sq.ft.) front porch and 460sq.ft. rear deck; reconstruct the northerly wall in
order to install new sliding doors; remove existing second story and construct new 32% `x24.8'
second-story with a new 6.4'x11.2' balcony; establish and perpetually maintain a 10'wide non-
disturbance buffer and a 10' wide non-turf buffer running along the waterline; and as depicted
on the survey prepared by Michael W.Minto,L.S.P.C., received on February 15,2022,and
stamped approved on February 16,2022.

TERMS AND CONDITIONS

as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Pennit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the Structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4, That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
T That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Pennittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
& The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this pen-nit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to The
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. and Mrs. Peros:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 16, 2022 regarding the above matter:
WHEREAS, BRANKO & MARGARET PEROS applied to the Southold Town Trustees
for a permit under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated October 12, 2021, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Consistent with the LWRP, and,
WHEREAS„ a Public Hearing was held by the Town Trustees with respect to said
application on December 15, 2021 and February 16, 2022, at which time all interested
persons were given an opportunity, to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of BRANKO &
