Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation(the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order time work suspended pursuant to ECL 71- 0301 and SAPA 401(3). They also plan to remove the north wall on the first floor in order to install new sliding doors. The existing cottage in the front yard will be demolished and a one car garage will be built 22 feet from the front yard lot line. The new Site Plan drawings submitted by Terry B. Porter, Architect and dated May 12, 2022 show the remodeled dwelling will now have three bedrooms on the second floor with two bathrooms and the first floor will have one full bathroom.The size of the proposed dwelling is in keeping with the size of other renovated two-story dwellings on Rabbit Lane. Town Law '267-b 3 b 2 . The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Due to the size of the lot and the pre-existing non-conforming side yard setback of the existing dwelling, further expansion would not be possible without variance relief. . 3. Town Law 267-b 3 b 3 . The variances granted herein are mathematically substantial,representing 37%relief for the front yard setback of the proposed accessory garage; 73% relief for the side yard setback for the existing dwelling,and 10%relief for the excessive lot coverage. However,the applicant is moving the proposed garage back 7 feet and has also proposed to remove the small shed in the rear yard which will decrease the lot coverage. 4. Town Law '267-b b 4 No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
