Authorizing the Following Work Activities:As per the attached Bay to Sound Trails Phase 5 Project. Clean up of Arshamomaque and Clay Pit County Parkland areas to create new walking only trails, small boardwalks,and access trail parking areas as described in Bay to Sound Trails Phase 5 Project. Construction within Arshamomaque County Park-for two boardwalks and a 50' by 25' parking as described in Bay to Sound Trails Phase 5 Project. Maintenance of existing Arshamomaque and Clay Pit County Parkland walking trails,newly created walking only trails, small boardwalks, approximately 1.3 miles of trails, and access trail parking areas. Construction within Clay Pit County Park-for one 60 foot long boardwalk and two short boardwalks totaling 13 ft.,and a parking area outside wetlands but within fresh water check zone of SO-3 as described in Bay to Sound Trails Phase 5 Project Maintenance of existing Clay Pit County Parkland walking trails,newly created walking only trails,small boardwalks, approximately 0.5 miles of trails and access trail parking areas. Permit is approved with the following conditions: 1. All work shall be performed in accordance with approved permit plans and in accordance with the Suffolk County Department or Park, Recreation and Conservation's (the "Department") specifications as directed by the Commissioner or his/her designee, and in accordance with the above referenced Contract and the specifications required by the Department. 2. All work shall be in compliance with the NYSDEC Article 24 Freshwater Wetlands Regulations. A NYSDEC wetlands permit must be obtained prior to the start of any regulated activities. 3. Prior to the start of any work, the permit plan and notes must be provided to the Department for approval. The Permittee must provide notice to the Department a minimum of 48 hours prior to the start of the work. 4. Permittee must ensure that above ground and underground utilities have been mapped out in the project area. The Permittee is responsible to ensure public safety in work area during their trail blazing activities. The Permittee may need to c!ose portiors ofai!s ancirr roa• v;kys while work is performed for the safety of park visitors and staff, but will do the best to minimize the impact of park use to the public. The Permittee will use appropriate personnel, safety devices such as signs, cones, drums, flaggers, shadow vehicles,warning lights, etc. The Department may order that the Permittee incorporate additional safety devices if it deems necessary. 6. The Permittee shall use reasonable efforts to preserve and prevent damage to the site. No trees or shrubs greater than one inch diameter will be removed. New trails will be no wider than six feet. Wood chips will be used to deal with exposed roots and low spots that tend to puddle No trees or woody debris shall be felled or placed to block any trails or public assess or gathering area. No heavy equipment will be used to create trails. All trail work will be done with hand tools. 7. The Permittee will notify the Department upon completion of this Project. 8. The Permittee understands and agrees that this Access Agreement shall be for no other purpose than those heretofore set forth. Any other reason to enter or use the Property shall be subject to a separate agreement by the parties. 9. The Permittee is not, and shall never be, considered an employee of the County for any purpose. Notwithstanding anything herein, the Permittee shall not be construed as creating a principal-agent relationship between the County and the Permittee or the Permittee and the County, as the case may be. 10. It shall be the duty of the Permittee to read, become familiar with, and comply with the requirements of Chapter 664 of the Suffolk County Code. The Permittee represents and warrants that it has not offered or given any gratuity to any official, employee or agent of the County or the State or of any political party, with the purpose or intent of securing an agreement or securing favorable treatment with respect to this Access Agreement or the making of any determinations with respect to the performance of any agreement. 11. The Department must receive proof of insurance as indicated on the application form before the commencement of any work at the site. 12. The Permittee shall protect, indemnify, and hold harmless the County,its agents, servants, officials,and employees from and against all liabilities, fines, penalties, actions, damages, claims, demands, judgments, losses, suits or actions, costs, and expenses caused by the negligence or any acts or omissions of the Permittee, including reimbursement of the cost of reasonable attorneys' fees incurred by the County,its agents, servants,officials,and employees in any action or proceeding arising out of or in connection with the Permit.
